$1 million settlement reached in death of veteran who froze in Madison

The United States has agreed to pay $1 million to the children of an Army veteran who froze to death after he was discharged from a VA hospital in Madison. Vance E. Perry, 57, was found dead on New Year s Eve 2018 in a downtown Madison parking garage, several miles from William S. Middleton Memorial Veterans Hospital, where he was discharged a day earlier. His family filed a wrongful death case against the government in federal court in December. It was dismissed in March, according to federal court records. Their attorney, Terrence Polich of Lawton Cates in Madison, said the case had settled after the government agreed to the payment. A signed settlement agreement says it should not be construed as any admission of liability or fault by the United States and that any attorneys fees will be taken from the $1 million payment.
