College student, 22, convenes her OWN grand jury using an 1887 Kansas frontier law after prosecutor refused to bring charges against classmate she accused of rape
Madison Smith, 22, accused Jared Stolzenberg of raping her in his dorm room at Bethany College in Lindsborg, Kansas, in February 2018
She said they were initially having consensual sex before Stolzenburg started slapping and strangling her
McPherson County Attorney Gregory Benefiel refused to bring rape charges
Benefiel said it was impossible to prove that Stolzenberg knew Smith had withdrawn her consent because she couldn t say stop while she was choked
Smith took matters into her own hands with an 1887 state law that allows citizens to summon a grand jury when prosecutors are neglecting to bring charges
