(Tori Weldon/CBC) A Sackville landlord was ordered to pay $10,000 to the town for ignoring multiple requests to comply to local zoning bylaws. Gordon and Barbara Beal have to pay this fine on top of covering moving expenses and any increase in rent for the 15 tenants who had to find new accommodations after the building was found to be unsafe back in January.  The Town of Sackville brought the matter to civil court because the owners of the historic mansion committed a zoning infraction and were doing work on the building without the proper permits.

AFCA amends complaints rules following court case subscribe A A The financial services ombudsman has changed its rules after the NSW Supreme Court found that it had acted against its obligations and did not have jurisdiction to consider certain types of disputes against licensees. The Australian Financial Complaints Authority (AFCA) has confirmed that it has amended its Complaint Resolution Scheme Rules after a direction from ASIC to do so. The rule change seeks to “provide clarity for consumers and financial firms regarding AFCA’s jurisdiction to receive complaints about the conduct of an authorised representative of an AFCA member”. It updates the defined terms for what constitutes a “financial firm” and “representative” of a financial firm.

Judge admonishes AFCA for prompting filing of complaints

Those products were the EFSO Ameen Investment Program which saw EFSOL placed into liquidation in late 2019 but gave rise to 127 complaints and debts of $21.8 million. The court had heard that a number of complaints had been raised against EFSOL but that some of those complaints were only directed towards DH Flinders when an AFCA staffer drew the attention of complainants to DH Flinders’ status as has having granted authorised corporate representative status to EFSOL and suggested they join the company in the their complaints. The court heard that the complainants would not have known of the DH Flinders corporate authorisation in the absence of having been informed of it by an AFCA representative who then suggested “as discussed, you may lodge a complaint against DH Flinders and I can assist you with lodging that complaint”.
