Hawke s Bay court: Six years into bitter dispute, Stefan Lepionka bankrupts Gareth Paterson

After six years in the courts, a Hawke s Bay developer has been bankrupted - again - by an orange juice mogul. The High Court at Napier adjudicated Gareth Paterson bankrupt on December 16, following applications by companies connected to Charlie s juice co-founder Stefan Lepionka seeking payment of more than $61,000 in court cost awards.
The cost awards followed years of bitter litigation after Paterson s development at Horseshoe Bend in the Tukituki Valley ran into financial problems. Lepionka took over Westpac s mortgage in a bid to protect a $463,000 deposit paid for four subdivision lots.

A Timaru man jailed for 27 months after threatening a woman with a chainsaw during a home invasion has had his sentence reduced on appeal in the High Court for personal mitigating factors. Justice Jan-Marie Doogue also granted Clint Huia Sorensen, 41, leave to apply for home detention after substituting his original sentence with 24 months imprisonment, ruling the sentencing judge “erred in applying insufficient discounts” for the Timaru man’s cultural background, prospects for rehabilitation, and remorse. Sorensen and his co-offender, Nikelle Richmond-Henke, had pleaded guilty to a representative charge of robbery with Judge Joanna Maze sentencing them to 27 and 23 months imprisonment respectively when they appeared in the Timaru District Court on August 6, 2020.
A court judgment, released by Justice Jan-Marie Doogue, doesn t disclose the relationship between the two parties. For 100 years, access to the Totaranui property had been over the Makakaho property, and Gerald Pearce sought an interim injunction to enable access over his neighbour s land to tend to Totaranui s stock and beehives. Roger Pearce opposed the order, but made some concessions as to limited access that could be granted under certain terms. These included a book for signing in and out. The access had never been legally formalised and Gerald Pearce s entitlement to use it was revoked when his neighbour entered the mānuka industry shortly after 2016.

A man who stabbed his former girlfriend at least 15 times in Napier just two months after being released from a jail term imposed for another assault on the woman has pleaded guilty to attempted murder.
Jordan Peter Rawiri Nuku, 35, made the admission when he appeared before Justice Jan-Marie Doogue in the High Court at Napier on Tuesday. He was remanded in custody for sentencing on March 5.

A serial Hawke s Bay sex offender who targets young teenaged boys has been sentenced to preventive detention with a minimum term of five years jail in a rare High Court decision in Napier.
But for the Crown s application for preventive detention, Robert John Brown, 59, would have been sentenced to four years jail with a minimum term of two years.
