A judge sided with Lake County Sheriff Oscar Martinez Friday on his legal battle to carry a handgun again while under a felony indictment. However, his ruling is on hold until the Indiana Supreme Court can review it and issue a “final judgment”.
A judge has struck down a portion of a state law that prevented Lake County Sheriff Oscar Martinez Jr., and all individuals under indictment, from carrying a handgun in public.
After exhausting all avenues in his appeals for a dismissal, Lake County Sheriff Oscar Martinez Jr. is now the closest he’s been to facing trial for his 2021 traffic charges.
Martinez is accused of failing to stop while driving an unmarked Jeep TrackHawk at 96 mph in a 45-mph zone in what police described as a "completely reckless" manner.
