Huntsville Police Officer William Darby has been found guilty of murder.
Defense attorney Robert Tuten issued this statement, referring to Darby as Ben : Everyone is shocked by the jury’s verdict. While we appreciate their hard work and will give their verdict the respect that it deserves, we still disagree with their decision. Officer Ben Darby will appeal this verdict. Once reviewed at the Appellate level, this verdict will not stand. Officer Darby’s case is extremely important to all Alabama Law Enforcement. This case will clarify Alabama law regarding on-duty police shootings and will impact the way law enforcement protect Alabamians and perform their duties. We look forward to the appeal of this case.”

A jury is in place for the murder trial of Huntsville Police Officer William Darby.
In 2018, Darby and two other officers responded to a suicidal man, later identified as Jeffrey Parker, with a gun to his head.
After failed attempts to get Parker to put down the gun, Darby claims he feared for his and the other responding officers lives. He shot Parker to death.
An internal investigation by the Huntsville Police Department found that Darby followed proper procedure. But after the case was handed over to the district attorney s office, Darby was indicted by a grand jury.

We spoke with a Huntsville defense attorney about what we could see during the trial.

Huntsville attorney Mark McDaniel said Friday that the main issue in this case is whether William Darby was reasonable when he shot a suicidal Jeffrey Parker in 2018.
The issue is not whether Darby shot Jeffrey Parker.
McDaniel says the law on the issue is that a person can use deadly physical force if he reasonably believes the other person is using or about to use unlawful deadly physical force against him or another person.

Prosecutors can refer to the man who Huntsville Police Officer William Darby is accused of murdering as a victim, a judge ruled Friday.
Darby’s defense attorneys filed a motion earlier this month asking that prosecutors be prohibited from using the word victim when referring to Jeffrey Parker.
Parker is the suicidal man fatally shot by Darby while he and two other officers responded to the call in 2019.
Jury selection in Darby’s murder trial begins Monday.
The city of Huntsville is paying up to $125,000 for his defense.
