Beef Plan directors 'removed' based on 'legal advice'

January 14, 2021 11:49 am The co-founder of the Beef Plan Movement, Hugh Doyle, has said that two directors of the company were “removed” based on legal advice. AgriLand reported last week that documents had been submitted to the Companies Registration Office (CRO) in December which stated that directors Enda Fingleton and Alan O’Brien had resigned. However, Fingleton told  AgriLand that he and O’Brien had not resigned, and did not intend to do so, contending that they were removed over their scrutiny of the group’s accounts. Now, a letter signed by Doyle – typed on Beef Plan-headed paper – argues that the work of the organisation has been “stifled” following a mediation process involving Doyle (and his associates) and the two ‘removed’ directors that failed to find a resolution.

'Removed' Beef Plan directors lodge formal complaint with ODCE

January 12, 2021 5:12 pm Following the revelation last week that the Companies Registration Office (CRO) was told two directors of the Beef Plan Movement had resigned – seemingly without the knowledge of those directors – the two individuals concerned have launched a formal complaint with the Office of the Director of Corporate Enforcement (ODCE). On Friday (January 8),  AgriLand reported that documents submitted to the CRO in mid-December showed that Enda Fingleton and Alan O’Brien had resigned as Beef Plan directors. However, sources close to both men denied that they had done so. The documents that were sent to the CRO also showed that two other people had been appointed as directors, namely Jason Fitzgerald and Emmanuel O’Dea. A scanned document accompanying these papers includes a signature from Beef Plan co-founder Hugh Doyle.

Two directors resign from Beef Plan Movement company

In total, there are now four directors of the Beef Plan Movement company. \ Barry Cronin There has been a major shake-up of the directors of the Beef Plan Movement company in recent weeks. Documents recently filed with the companies office (CRO) show that Laois man Enda Fingleton and Kilkenny native Alan O’Brien have both resigned as directors of the farmer organisation in the run-up to Christmas. Both Fingleton and O’Brien had served just under two years as directors of the Beef Plan company. In their place, Cork native Jason Fitzgerald and Emmanuel O’Dea from Athenry, Co Galway, have both been appointed directors of the Beef Plan.

Beef Plan directors dispute company filings of their resignation

“I have never signed any documentation either.” “I will be taking this further, I’ll be taking legal action,” he added. Enda Fingleton also insisted that he had not resigned or signed any documentation to that effect. He added that he had sought, on multiple occasions, directors’ meetings with Alan O’Brien, Hugh Doyle and Eamon Corley present, but this had not happened. “I have not signed any documentation about resigning,” he insisted. Company law Under Irish company law, a director of a company may resign or be deemed to have resigned for a number of reasons, including an end of their term as a board member or due to a resolution passed by the board or the members voting to remove them.
