Court Grants Stay In Lawsuit Over Trump-Era Fair Housing Rule

Inman Connect A federal judge in Massachusetts has suspended a lawsuit filed against the U.S. Department of Housing and Urban Development (HUD) over a Trump administration rule that would have established a higher threshold for bringing housing discrimination claims under the Fair Housing Act. The suspension comes on the heels of an executive order from President Joe Biden directing HUD to review the new rule’s effects. On Sept. 4, HUD finalized a new rule for its implementation of the Fair Housing Act’s “disparate impact” standard. The 2013 Obama-era disparate impact rule was meant to prevent discrimination against protected classes under policies that appear neutral on their face but nonetheless have a disproportionately adverse effect on minorities or perpetuate segregation without justification, regardless of their intent.

Thus, while the bishops condemn (as well they should) the president’s decision to send American tax dollars overseas to fund abortion, they heartily commend his endeavors in other tense areas of the social, political, and economic arenas.

January 26, 2021 12:42 p.m. The Biden administration on Tuesday rolled out a series of presidential actions on racial justice, including multiple actions that re-established policies of the Obama administration that were subsequently done away with by President Donald Trump.  “We’ll hold the federal government accountable for advancing equity for families across America,” White House Domestic Policy Council Director Susan Rice told reporters Tuesday. An Obama-era rule called “Affirmatively Furthering Fair Housing,” a target of Trump’s that the former president used to exploit racist stereotypes about the suburbs, took top billing. The Obama effort requires that communities take steps to identify and end racial discrimination in housing. But Trump did away with the rule and frequently referred to his election-year action as “saving the suburbs.”
