New Hampshire's Safe Haven Law, which allows parents to leave babies younger than 7 days old at places such as hospitals, police or fire stations, was allegedly used by a woman who's now facing charges of killing her 5-year-old son.
The affidavit, which had been sealed since the arrests of Danielle Dauphinais, now 37, and Joseph Stapf, now 32, on Oct. 19, 2021 in New York, was released after a motion to unseal it filed by News 9 Investigates was granted.
The affidavit written by a Merrimack police officer sought arrest warrants for Dauphinais and Stapf, who police said fled the state shortly after an investigation into the disappearance of Dauphinais’ son Elijah Lewis, 5, began.
