Air Enforcement: Tennessee Air Pollution Control Board Proposed Order/Civil Penalty Related to McLemoresville Cotton Gin | Mitchell, Williams, Selig, Gates & Woodyard, P.L.L.C.

The Order provides that Espey operates a cotton gin (“Gin”) in McLemoresville, Tennessee. The Technical Secretary of the Board is stated to have issued an operating permit to the Gin in 2015. The Gin was identified as an emission source. Condition 4 of the permit states in part: The number of bales processed during a ginning season shall not exceed 57,500 bales. Condition 5 of the permit states: Records shall be maintained to establish the number of bales processed during each ginning season. These records must be maintained at the gin location or business office and kept available for inspection by the Technical Secretary or his representative. At the end of the cotton ginning season and no later than April 1, a report of the number of bales processed during the ginning season shall be submitted to the Division[.]

The changes under consideration include changes based on the rules’ 5-year review required under Ohio Revised Code (ORC) 106.03. At this time, Ohio EPA intends to amend rule 3745-352-01 for non-substantive punctuation and terminology corrections, and update reference dates. The rules became effective Saturday December 12, 2020. The amended rule language can be found on here.  The Director’s action in this matter is pursuant to the procedural requirements of OAC Chapter 119 and is based upon the record of the public hearing conducted by OEPA on September 28, 2020. No comments were received during the public comment period. The Director’s action is final and may be appealed to the Environmental Review Appeals Commission pursuant to Section 3745.04 of the OAC.
