MDC rejects sex offender's early release

Matthew O’Neill A judge has ordered a convicted sex offender, an Albuquerque lawyer, released from a three-year prison sentence into a monitored program with the Bernalillo County jail. The reason: He cannot get sex offender treatment in prison due to the pandemic. On Feb. 17, 2nd Judicial District Judge Courtney Weaks suspended two years of 51-year-old Matthew O’Neill’s prison sentence. ...................... Weaks ordered O’Neill transferred to the Metropolitan Detention Center to serve the remaining year in the Community Custody Program. Under the order, O’Neill would be released but would have to check in with MDC regularly, register as a sex offender, wear an ankle monitor and abide by other conditions – such as not being around anyone under the age of 18, aside from his children.

District Court in ABQ gets 7 new judges

This story has been updated to correct the spelling of Catherine Begaye’s name.  Seven new judges joined the 2nd Judicial District Court in January, including six who were appointed by Gov. Michelle Lujan Grisham. Two of the seven were appointed to newly created positions in the Children’s Court, according to a news release. The Children’s Court appointees are Catherine Begaye, who is a member of the Navajo Nation and is the state’s only Native American district judge, and Alma Roberson, a former attorney in the Law Offices of the Public Defender’s Juvenile Division. Four were appointed to the Criminal Division: Bruce Fox, who most recently was the chief judge for Laguna Pueblo; Britt Baca-Miller, a public defender in Albuquerque since 2013; Joseph Montaño, who spent the past 10 years as a prosecutor for the 2nd Judicial District Attorney’s Office in Albuquerque; and Jennifer Wernersbach, who has practiced as a criminal defense and civil rights lawyer for 16 years.

Teen murder suspect faces rape charges

A teen accused of killing his young cousin now faces charges for sexually assaulting her. Jeremiah Morfin, 17, will face trial for first-degree murder, criminal sexual penetration of a minor under 13, child abuse resulting in death and three counts of tampering with evidence. ...................... Morfin is accused of raping his 9-year-old cousin during a sleepover at his house in January 2019, killing her and dumping her body in a nearby drainage tunnel. Morfin’s attorney denies that a sexual assault occurred. On Wednesday, 2nd Judicial District Court Judge Daniel Gallegos determined there was enough probable cause for Morfin to face trial on the charges.
