the court rules thursday the insurance subsidies are valid even in states that did not set up zpanchs marking the second time in three years that the justices have saved president obama s signature health care law and on fridge the justices issued a 5-4 decision affirming the constitutional right of gay couples to marry in all 50 states. dan henniger joe raygo and wall street journalist columnist jason riley. joe, second time in three years chief justice roberts, john roberts has rewritten a law himself basically. the first time he said the penalty that s the way they put it is really a tax and this time he said exchanges set up by the states and federal government though there s not get real government part of those sentences in the law. if this with as a bankruptcy law for example, this would be an open and shut case.
language in the obamacare case. we re not qualified. i don t wait tells you about chief justice roberts. the same judicial activism he denounces in one case he endorses in another. it s very confusing. does that raise a question, dan, of the political motivations here for the chief justice? is he really thinking in his role as the chief justice that i have to be more of a politician here and i didn t want the court to overturn obamacare because the damage to the court from critics could be so severe that i have to invent some language to rewrite the statute myself to preserve it. if i had to read something into his mind it was that if they had overturned the affordable care act, it would have fall on the the republicans in congress who really had no idea what they wanted to do and the chaos the supreme court they would have gotten blamed for creating this fiasco.
