Tort Claimants Can t Alter Committee Makeup In Cyprus Ch. 11
Law360 (May 18, 2021, 4:08 PM EDT) A Delaware bankruptcy judge Tuesday denied a request by a group of talc personal injury claimants to change the makeup of the tort claimants committee in Cyprus Mines Corp. s Chapter 11, saying she did not see any conflicts of interest involving its current members.
While U.S. Bankruptcy Judge Laurie Selber Silverstein expressed concern that committee members may be delegating their responsibilities to their counsel, the fact that those attorneys also represent parties involved in the creation of a settlement with Cyprus parent Imerys Talc America does not in and of itself create a conflict of interest, she ruled.

Cyprus Mines To Depose Candidates For Ch. 11 Claims Rep
Law360 (May 11, 2021, 7:36 PM EDT) Bankrupt talc miner Cyprus Mines will be able to depose two candidates proposed by the debtor s past insurers to represent the interests of future injury claimants after a Delaware judge approved a discovery timeline Monday related to competing motions to appoint such a representative.
Cyprus Mines Corp. and its former insurers have proposed separate candidates to fill the future claims representative position in the debtor s Chapter 11 case, and the discovery schedule approved by the court calls for any document production and depositions to be concluded by May 19, with a hearing on the competing motions set for June 2..

Judge Urged To Rework Talc Claim Panel In Cyprus Ch. 11
Law360 (April 5, 2021, 10:45 PM EDT) An attorney representing talc-related asbestos victims urged a Delaware bankruptcy judge Monday to modify a tort claimants committee in Cyprus Mines Corp. s Chapter 11, citing potential conflicts with the closely connected Imerys Talc America bankruptcy plan and settlement.
William D. Sullivan of Sullivan Hazeltine Allinson LLC, counsel for a group of asbestos personal injury plaintiffs alongside Kazan McClain Satterly & Greenwood, said the move was justified by overlaps among law firms representing Cyprus Mines TCC members and firms involved in the Imerys case.
Five firms representing members of Cyprus tort claimants committee were also members of an ad hoc Imerys committee that developed a compromise.
