eastern on9:00 c-span. joining us from palm springs, california is matt schlapp. he is the chair of the american conservative union. and joining us in our studios in washington with questioning, alexis simendinger, national political correspondent for the hill and thehill.com. and gabby orr, she covers the white house for politico. matt schlapp, let me begin with some action this past week in congress. in the senate, a resolution that basically disagrees with the president s move to pull troops out of iraq and afghanistan. and as the senate republican leader mitch mcconnell said, a third government shutdown is like a third kick in the mule. i m wondering if we are seeing some real divisions within republicans in congress and this president. matt: i think you are seeing a shift under president trump on some issues. in some ways it is a contrary contrary in view but in other ways it is a new approach. president trump was crystal clear about top agenda items, he would like t
price-fixing, market allocation, bid-rigging. that is probably 50% of our portfolio. the other is on the civil side, which includes mergers for mergers of companies. recently you heard sprint and t-mobile merging. we are reviewing that. or at&t and time warner. disney and fox. those are mergers that go through us and we determine whether or not they violate the antitrust laws by reducing competition in certain markets. antitrust on see the surface, or is it a deep dive? makan: i think to do it properly it is more of a deep dive. it depends on the market. if there is only very few number of players in a particular market and it is a highly regulated, therefore tough to break into those markets and they try to merge, you can intuitively look, but you still need to analyze it to see if in fact it reduces competition to a way that violates the law. host: when you looked at at&t - time warner on the surface, what did you think? we know what you saw when you got into the deep div

if you all could sort of settle down with your lunches and we will get started. so we spent the morning talking mostly about the emergency powers that congress has given to the president, but there is also the question of what eemergency powers if any the constitution provides. and our speaker has done a great deal of thinking and research into that very question. it s my pleasure to introduce the james monroe distinguished professor of law at the university of virginia law school. i was fascinated to come across his work on emergency powers. he is studies closely issues of separation of powers and the reach of executive power. he s the author of the book imperial: from the beginning, the constitution of the real executive. and i think you ll be very interested in what he has to say. professor prakash?
