very unprofessional misconduct. two top officials facing accusations they may have lied in a lawsuit against former secretary of state hillary clinton. our chief washington correspondent, james rosen, is with us now. he, of course, covers the state department. so, james, why are we finding out about this now? reporter: well, jenna, good afternoon. these latest disclosures arise out of a lawsuit in texas that is set to go to trial this fall. veteran ds agent rick hiking by is suing over claims he was discriminated against by his superiors after he refused overseas work assignments because of his ill daughter. state has contested these claims. in late february two top ds officials one who was director of ds until february 1st and still the executive director of ds sat for videotaped depositions in which they were asked if they knew of criticism by other agencies to the effect that ds, diplomatic security, has failed to follow procedures or about pending
the attorney general. he testified under oath on the record. we want the answers from the attorney general. yesterday late yesterday afternoon we received a letter from the attorney general incorporating the answers into his own letter, but it still doesn t answer all our questions. it raises more questions than we asked because essentially now the contention is it is okay for the justice department to accuse a reporter of a very serious criminal action. he had probable cause to show he was an aider, abettor in violation of the espionage act that raises serious concerns that it doesn t square with what the attorney general said. number two, that seems to be an inappropriate way to get a search warrant and rifle through the chief washington correspondent s emails in order to see what
possibility that leak investigations may chill the investigative journalism that holds government accountable. president obama tried to justify his administration s aggressive investigations into leaks. sweeping up news organizations, though, in the process, new york times chief washington correspondent, david sanger joins me now. david is one of them. david i don t know if you can talk about the personal side of this. but your reaction to the president s tweaking, i guess you would say of the journalism investigations and calling for a report from the attorney general, though one would ask, one would wonder how could it have been ordered without him knowing broadly what the policy is. well, andrea, it s interesting, the president decided to reestablish what he basically laid out as a balancing test between trying to protect secrets for people who have access to classified information. and also, protect the first amendment issues here.
for the white house. that s not exactly a shocker. people have been talking about jeb bush and he s become in the spotlight over the national immigration debate. the former florida governor has just written a new book about overhauling the nation s immigration system. seems to be backing legal status for undocumented immigrants, but not a path to citizenship. which means in essence he s pissing off people on both sides of the aisle by doing that. so when bush began back tracking on his position, cnn s chief washington correspondent, jake tapper, jumped into that conversation. here s how that went. i have supported both, both a path to legalization or a path to citizenship with the underlying principle being that there should be no incentive for people to come illegally at the expense of coming legally. today basically the only path to come to this country other than family reunification is to come illegally. so, i m not sure that that s true. i think that the people who talked abou
