The petitioners could not establish that the ‘Dhangad’ community did not exist in Bombay when the ‘sacrosanct’ Presidential Order of 1950 was issued, the court observed.
The Court added that it was unethical of the Indian father to claim that he was subjected to racial discrimination by his former wife when she had spent several years with him as a married couple.
A division bench of Justices GS Kulkarni and Firdosh Pooniwalla directed the CGST commissioner to file a reply to the petition and posted the matter for hearing on February 20.
