India News: Bombay High Court ruled that while a sessions court can't dismiss an FIR, it can intervene in magistrate's orders to file one for cognizable offences.
The Bombay High Court was hearing the PIL it initiated suo motu on the April 1 incident of the drowning of two boys, aged 4 and 5, in a civic water tank that had no proper cover.
The court noted that the bail applicant was in custody for over three years and the trial could not conclude within one year time frame fixed by HC, although only 8-10 witnesses were to be examined.
The builder, as stated by Justice Abhay Ahuja, willfully breached undertakings given to the High Court and was absent on several dates, thereby interfering with the administration of justice.
