john: one of the survivors of the attack that killed four idaho college students last fall is fighting a subpoena to testify in court. bryan kohberger s defense attorney says she could help clear her client. what do we know about the surviving roommate, dan? bethany funk was in her room in the basement when the murders took place and we know that she is not the roommate who got a look at the suspect right after the murders of the four people in the house. in fact, funk was barely mentioned in the probable cause affidavit filed by the police to get an arrest warrant for bryan kohberger. she told police she stayed on the first floor through the first time of the murders and after the bodies were discovered some eight hours later. but what the investigator told
to the court to get a subpoena to compel her to testify at the preliminary hearing. during the course of my investigation it became known to me bethany funk has information material to the charges against mr. kohberger. portions of the information miss funk has is exculpatory to the defendant. her information is unique to her experiences and cannot be provided by another witness. funk now lives in reno, nevada, fired a lawyer fighting the subpoena that it was issued without a hearing even though she s out of state and nothing in the court record she has anything useful either for the defense or the prosecution. kohberger s preliminary hearing set for june 26th in moscow, idaho. funk has been ordered to show up on the 28th. the hearing is expected to last five days. it s unclear what the magistrate will do with the motion to quash the subpoena. might be a hearing on the issue in the coming days, we ll have to see. kohberger is charged with four counts of first-degree murder
