The province “was ready to go to trial with several expert reports refuting the allegations of systemic negligence,” Belobaba said.
Just before the case was to go to trial in March, the province and Koskie Minsky came to a settlement, he noted.
A trial might have led to success for former residents but it was equally possible, perhaps even likely, “that the entire litigation could collapse with no compensation for anyone,” the judge said in his decision.
About a dozen class members objected to the settlement in writing and about 20 more did so in person via Zoom video June 23, less than five per cent of the expected number of claimants, Belobaba said.
