taking the judge s instruction to heart here. maybe working with each other more showing more deference, listening to each other, those were all things the judge said they should do. so they went back into that jury deliberation room at 11:58 after asking the judge that question what should we do if we cannot come to a consensus on a single count, how should we fill out the verdict form? the judge said to them essentially go back, try this, try it again, try some more. you know, that s standard what a judge does in these cases. it s often referred to as an alan charge in district court in virginia it s saucalled a sayer charge. that s something the judge gave to them. we haven t heard from the jury since. presumably whether they re working on one count or working on several counts, they have gone back to the deliberation room to continue here. yesterday we got word as to when we could expect to wrap up the proceedings for the day. yesterday it was 6:15.
lawyer, we asked if that meant a deadlock on a single count. he said they didn t know and they re waiting as we are. daniel goldman, in terms of how this typically works in a case, how often do you see a jury like this? how often does the judge answer like this? what does that typically result in? any light you can shed on that? this is very typical, steve. quite often, particularly in cases with this many charges, the jury will come back and say that they re deadlocked on all or some of the charges and the judge, at a certain point, and this was a little bit early because the jury had not mentioned it before they came with the note, the judge may send them back and say, keep trying or like he did today and read what is commonly referred to as an alan charge, which is a fairly lengthy speech that he gives the jury to tell them to reconsider the evidence, try to
and two men and so it really cuts the deliberation time in half and here the jury said we are hopelessly deadlock, apparently there was a single juror who was unwilling to vote to convict, it s unclear whether the judge issued an alan charge, dynamite charge to jurors urging them to reconsider and if there s a long holdout, you should consider the fact that you re all by yourself and your colleagues on the jury are unpersuaded. that s called a dynamite charge to try to dislodge that single juror. it s unclear whether the judge actually gave that dynamite charge today. he might have simply been convinced by the note that the juror sent to him and then questioning the jurors that there was no way that anything was going to dislodge that one juror. to he declared a mistrial. jenna: we talked about this case
