Hagens Berman Loses Privilege In Thalidomide Sanction Fight
Law360 (May 24, 2021, 7:34 PM EDT) The law firm of Hagens Berman Sobel Shapiro LLP must turn over documents related to its dropping of thalidomide lawsuits against GlaxoSmithKline, after a Pennsylvania federal judge ruled Monday the firm waived any privilege attached to those documents when it shared them with an outside expert.
U.S. District Judge Paul S. Diamond agreed with a special master s opinion that Hagens Berman had waived privilege by sharing evidence with expert Abraham Reich and must now share the documents with defense attorneys seeking to sanction the firm for allegedly pursuing dozens of cases over birth defects past the point when they had been.
