MANILA - The Court of Appeals (CA) affirmed its earlier decision dismissing the petition of outgoing party-list Rep. Rodante Marcoleta, who wanted the Civil Service Commission (CSC) to impose graver punishment on a public school officialfor allowing a student with incomplete records to graduate. The CA denied Marcoleta's motion for reconsideration as he "failed to advance any new or substantial argument which justifies a reconsideration of the assailed decision" involving Alona Mallari, principal of San Sebastian Elementary School (SSES) in Tarlac. The CSC suspended Mallari for three months in 2018 for simple misconduct, modifying the Department of Education's (DepEd) Aug. 31, 2017 resolution that dismissed her from service for grave misconduct. In its original decision on March 2, 2021, the CA Special 9th Division held the lawmaker lacked legal standing to question the CSC ruling.
