Plaid Must Face Invasion of Privacy Class Action

A federal judge will allow privacy claims to move forward against fintech company Plaid, accused of posing as a number of banking institutions in order to collect financial data from people when they signed up for payment apps like Venmo. (CN) Financial services startup Plaid will have to face claims that it deceptively acquired consumers’ banking credentials without their permission. In a ruling late Friday, U.S. Magistrate Judge Donna Ryu found a consolidated class of customers adequately alleged that Plaid had violated their privacy under a host of California laws by hiding its role as a transactional middleman in order to secretly download their financial data.

Alameda County residents Karen Dhanowa and Nilima Amin are suing Subway for several claims including fraud, intentional misrepresentation and unjust enrichment. According to a copy of the lawsuit obtained by TODAY Food, the plaintiffs claim that an independent testing of the sandwich ingredients confirmed that the products are made from anything but tuna. Subway, however, stands by its products and denies the claims. “There simply is no truth to the allegations in the complaint that was filed in California. Subway delivers 100% cooked tuna to its restaurants, which is mixed with mayonnaise and used in freshly made sandwiches, wraps and salads that are served to and enjoyed by our guests, a Subway spokesperson told TODAY.
