charged with conspiracy in the death of robert wone. he was found dead in a dupont circle home nearly four years ago. kristin fisher has more on what we can expect for today. >> reporter: for are starting off let's be clear here the three men standing trial today are not accused with murder but are charged with conspiracy, obstructing justice and tampering with evidence. in'd's opening arguments, prosecutors accused the men in a carefully constructed cover- up but defense attorneys argue the case is weak on evidence and instead they argue the case is based on speculation and on all the defendants ' sexual orientation. >> reporter: prosecutors allege that 39-year-old dylan ward, victor saborsky, and joseph price were three gay lovers who made a pact to protect their powerful bond by covering up the death of wone. he was an attorney for radio asia and met one of the accused, joseph price, in college. price led him and his family on a tour of william and mary. price's defense attorney says it is that 16-year friendship that would have kept price from hurting wone or allowing his two house mates from hurting him. but when he slept at price's home in 2006 he was fatally stabbed in an upstairs guest room. the three said an intruder did it but court documents say the crime scene had been tampered with. >> reporter: defense attorneys say not one of the fingerprints matched those of the defendants but prosecutors say that fits in perfectly to their theory that the three defendants tampered with the evidence because after all they did indeed live in the home where the crime took place. wone's wife is expected to take the stand when testimony resumes in the trial and we will have more at 6:30. >> thank you. maybes are on edge while the hunt goes on for two killers in centreville, virginia. police say pair of robbers shot a gardener at the home. they suspect they were trying to rob the family. a local businessman who owns a plaza on centreville road in manassas. >> it is horrible. everyone says not in my neighborhood but that is really bad. >> it seems rare and anytime you hear something like that you usually get results so hopefully they find someone. >> reporter: the suspects they say broke in to the garage when the gardener confronted them. they believe robbery was the motive. expect delays in the foggy bottom area. work continues on the water main break. steel plates covered the break at pennsylvania avenue but after the rush, crews will come in to repair a broken connection and that could take a few hours. the coast guard says this morning small balls of tar are washing up on beaches in the florida keys it is likely from the underwater spill in the gulf of mexico. it was the focus of hearings on monday. bp, which operated the exploded rig says it will pay for the laneup costs and reimburse businesses. right now it is only liable for $75 million in damage and they question this government response. homeland security janet napolitano says she is monitoring cleanup efforts. >> we are overseeing bp. the responsible party in its efforts to stop the leak at its sour. reduce the spread of oil. protect the shoreline and and environmentalists are expected in richmond, virginia today. they will protest against a company that owns the west virginia mine where 29 people died last month. hundreds turned out at last what led to last month's explosion and spill. the wife of robert wone is expected to testify in court today. he was killed inside of a dupont circle home four years ago and no one has been charged with his murder. kristin fisher has a look at one of the district's most bizarre murder cases. >> reporter: no kidding. these three defendants decided they did not want a jury trial so their fate is in the hands of one judge, judge lynn leibowitz and she will be listening to the evidence presented in the murder mystery. as you said this morning the victim's wife kathy wone is expected to be the first person to take the stand. her husband was found stabbed three times in a dupont circle home of the three defendants. they are 39-year-old ward, 44- year-old saborsky and joseph price. they claim an intruder did it but court documents say the crime scene had been tampered with and that's why they are charged with conspiracy, obstructing justice and tampering with evidence. they are not accused of murder nor has anyone else been charged with the murder that took place four years ago. in the opening statements prosecutors accused them of a carefully constructed overup with price acting as they ring leader. they were buddies at william and mary. but defense attorneys say it was not based on hard evidence but on speculation and his clients ' sexual orientation. the defense says the three defendants refer to themselves as a family. they are all in a loving, committed, three-way relationship. that's what the defense says p but the prosecutors says it is that very bond which motivated this allege cover-up. prosecutors believe they were trying to protect each other. keep in mind, that's what the two sides are saying and again, wone's wife is expected to take the stand first thing this morning. an accused ivy league fraud will have his day in court today. he's accuse of lying, cheating and scheming his way through harvard. he was a senior, applying for scholarships when a professor notice his application was plagiarized. he lied about his sat scores, high school score and grades at mitt. and he used it to get $40,000 in grants. >> actions, cheated. those who competed honestly and fairly for admissions and for the scholarships that this defendant fraudulently obtained. >> he is charged with 20 offenses including identity theft. the school has not said how he was able to do it for years would you being caught. people in one maryland condo complex have a mystery on their hands and the investigation could fall in to the hands of some csi types. in seven minutes the traffic lights at the four-way stop because we have a few of them out there in that area. and 95 is feeling the impact of the 395 accident so far. plus 15 to 20 minutes to make it from the prince building wants to claim responsibility. so steve franz, a board member and dog owner here has come up with a unique solution, dna testing. >> just swab the inside of the cheek like csi does it. if poop is found in the building they have another kit that is used to collect the poop. send it off and it is analyzed and matched with whoever might have done it. >> reporter: there's been talk of putting in more video cameras in the building to try to i.d. the culprit, but steve says with his solution only dog owners, like himself would need to spend any money to get the problem solved. >> the camera solution kind of putts the onus on all of the owners in the building where the doggy dna solution puts the ownous on the dog owners. the others don't participant -- don't participate in the company and there's it's not a problem for them. if we live in a nice place and if you step in a pile of poop in your own hallway it is a big problem. >> for sure. >> if the bad dog's bad owner is found they face there -- $500 fine. >> how about an eviction. >> how about a bag. >> just be the responsible owners. >> why would you want the place where you live to have any kind of unpleasant odor 395 with respect to the accident at northbound shirlington. it is now clear. as we switch the camera over you can see we have those lingering delays that will be with us all morning long. they are stretching back to the mixing bowl, even before that on to 95 and we are delayed on 95 starting at the prince william parkway. taking you about 30 minutes at least to make it from the beltway past shirlington. take it over to the maps and show you about the utility pole that was on fire earlier. that is now out but it is still impacting the area. northbound germantown road is closed between orchard street and fairfax boulevard area and we also know we have traffic lights that are on flash or completely out, which means you want to treat it as a four-way stop. move to the water main break. some better news here in northwest dc. things cleared before we thought they would. looks like they put steel plates on the ground on pennsylvania avenue going westbound between 20 and 21st. so that's what you want to watch for. meanwhile you are able to get by. finish up with 270, where we are crawling from father hurley to the split. plus, 20 minutes for that. back to you. the search continues this morning for the robber who targeted a bank of america in montgomery county. armed with a shotgun, the thief held up an armored car driver on new hampshire avenue in colesville. no one was hurt. the robber got away with money and the guard's gun. a man nearly killed when his truck fell on top of him had a chance to thank a medic that helped to save his life. chris larson has undergone 19 surgeries since the truck fell on him in oxon hill. his mother says a paramedic not only saved his life but helped him to turn his life around. >> his life was not going in a good
