Right now President Trumps travel ban remains blocked across the country. Tonight attorneys from across the country tried to convince a three Court Appeals judge panel to reinstate the lower court and reinstate the ban. They had three main points, for us the most interesting claim is that theres no religious test in the executive order. They say it isnt a ban based on religion so it cant be blocked on First Amendment ground. The judges pressed the Justice Department attorney that President Trump and his top aids discussed the idea of a muslim ban throughout the entire president ial campaign. This was the doj lawyers response. It is extraordinary for a court to enjoin the president S National Security determination based on some news paper article, thats what has guessing of the National Security decision made by the president. For what its worth the judges didnt seem to buy that argument. But they havent said when theyll formally announce their decision about whether or not the ban will go back into effect or not only that they hope to rule fast by the end of this week. Whoever loses in this case will almost certainly appeal again to the supreme court.
