Bill cosby will be back in Montgomery County courtroom this morning as his lawyers argued to have his upcoming trial moved to another county or have jury brought in from another county. Todays hearing comes after a major ruling on friday in which a judge determined that only one of the 13 other women accusing him of Sexual Assault can testify at his trial in june. We will break this down. Fox 29 legal analyst ken role we willer is joining us with more. You are tough, ill tell you. When i get in trouble you will be representing me. Okay. This was a victory for defense but prosecution is not out of it. Huge victory for cosby last week. Remember there were supposedy about 50 women that claim he sexually abused them and, prosecution was trying to get 13 witnesses to testify. I had said if all 13 with men were allowed to testify bill cosby would have a hard time in the courtroom. Now that the judge has ruled only one out of the 13. There will be only two witnesses that will testify against bill cosby, Andrea Constand and this other witness. It puts more light now on the credibility of the Andrea Constand. I would say this is a huge, huge win for bill cosbys team last week. Coming up after this huge win we have what is happening this morning. Do you think they will get a change of venue when it comes to this. It is anybodys guest. One is a change of venue which means they take it out of the Montgomery County and put tonight another county or a change of convenient near which means they change jury panel meaning jury does not come from Montgomery County but another county and they bring it into Montgomery County. The Supreme Court will decide that. If they do that this judge rules that this Supreme Court might decide this might say we will take a jury from erie, and bring tonight to Montgomery County and decide the case. Isnt this a National Story , so where can you find someone that has not heard about cosby and the accusers. It doesnt make any difference. Thinks like o. J. Case. It will be like o. J. Case. It will have National Coverage wigs trial that will be going on at that time. I dont think it will make a difference in terms of where it takes place or if it is a different jury panel. Accuser number six, what do we know about this accuser. Not much. We will find out more when this person testifies. But this person says it happened back in 1996. This was an assistant to when he was represented by william morris. That is right, one of the agents. Yes. We will find out more about his persons testimony when she actually testifies. How do you steer defense if you are represent mr. Cosby. Well, you have to attack the credibility of Andrea Constand. Whole issue was it consensual or not. There are only two people in the room. Andrea constand says it wasnt bill cosby says it was consensual. It depends hot jury believes. He was americas dad maybe still is americas dad. He will have a big influence on that jury. Now that only one other woman is going to be allowed to testify, instead of the 13, i think it makes a big difference in this case. Believe me i thought if they marched all 13 in one after other after the other saying that bill cosby sexually assaulted them, i thought it would be tough for bill cosby. We said it was a huge win for them. Whatever happened will this be a big factor in the case if there is a change of venue or not. I dont think so. I think no matter where this case was tried, Everybody Knows about this case. I dont think this ruling will make a big difference. Ruling last week absolutely huge. Ruling this week, no, not at all. We want to get to the other issue we have been reporting on jewish cemeteries and there have been desecrating of it. Hundreds of many, up to 500 or more, what kind of punishment or charges could happen when they find whoever did this. It is vandalism and could also be a hate crime. If this was donna begins a specific group, donna begins jewish people for religious reasons, it can be a hate crime which means it could be prosecuted under federal guidelines which means that there would be an enhanced sentencing. Federal court. It could if it was a hate crime. There is no parole. You can serve decent time in jail. It strikes me if there were 500 stones overturned this had to be a group of people. It doesnt sound like one person would have done this it looks like, when police are investigating this they are looking for a group of people that did this f there was a group of people that turned over 500 stones it will be prosecuted under federal guidelines. Either way, it is disturbing. Does it make it difference fit is one verse 500. No, but makes a difference in terms of looking at who that group is and what they were motivated by. It will be hard to argue it was just mischievous teens, knocking over one or two. When i heard this i thought it was a bunch of kids, you know, just mischief but 500 stones. Do you think we have a rise , in our area, we have a strong, vibrant Jewish Community here but we have had a number of recent incidents happening at synagogues where they have been defaced and now suggest like this do you think we are seeing a rise in anti sem advertise many here. I dont know, i think there is a rise in the coverage of them. There certainly seems to be more. Although i will tell you i have lived here about 30 years and certainly 30 years ago you didnt see incidents like this over the last two years, three years it seems like they are happening and more and more. People are more and more brazen and taking these opportunities, and unfortunate liz we have not been able to call this a hate crime just yet but it did happen in the Jewish Cemetery. Philadelphia police have not ruled this a anti sematic crime verse just vandalism. Other people made their own conclusions but these kinds of things are terrible. Hate crimes in general whether they are against Jewish Community, muslim community, catholic community, any religious crime should not be tolerated by anybody. Well, we, yesterday there was sunday and we posted to our home page jewish philly. Org and posted throughout our social media, we have had over a thousand people donate to help for this clean up yesterday. We dont know what the clean up will cost. We have heard 450 per head stone to restore the cemetery, and without any real promotion other than a couple of posts, almost a thousand people donated money any where from 18 to a thousand dollars per donation. People want to help. There was a rally in narberth yesterday not far from where im standing right now and almost 500 people showed up with just a couple phone calls to show their solidarity. Today, at 2 15 at Lutheran Seminary on germantown avenue there will be a show of faith religious lead hours will stand arm and arm to show their support for each other, in and against this heinous crime. I think that if you try to find something out of this, the fact that this can be viewed as a hate crime because it is done in a hateful way but to see such a response and people coming together to try to show love and support. It has really been unbelievable. Like i said, i was having a reasonably pleasant morning and then i found out about this. Still four months from the june 5th scheduled start of the trial but this is another Pretrial Motion to deciding whether or not to move the trial out of Montgomery County in this court house as cosby and his lawyers want or to bring jury in from people who live outside Montgomery County to hear the case at this court house. It is a cool moment but very awkward moment. I feel bad that moon light didnt get recognition but i feel bad la la land, those guys were out there three speeches deep and the awards taken away. From what i understand, and again, is there so many different stories happening. Look closely when Warren Beatty is holding the envelope and it as actress in a leading role, he was reading the award for emma stone winning best actress and according to reports ivoried there are two sets of cards and envelopes. My guess, he was given the wrong card but you can look at his face. When he opens up that envelope he looks down and he he is generally concerned. It is not the right card. So i think, la la land was such a momentum and everybody thought it would win, i think maybe he assumed it would win, he saw name there, feye dunn away. I dont blame Warren Beatty. I i predicted best picture, i said la la land and moon light i was right for about a minute and a half. Exactly. Partial credit. But best actor, again, another one i got wrong, this is interesting because i actually was very, very positive that denzel was going to win. I was looking at statistics about the sag, awards last 10 years winners of the sag won best actor at oscars and that was denzels first sag. But Casey Affleck had momentum all the way leading up to the beginning of the awards sees often. Im not shocked, casey won, i just really thought denzel would win. I thought he gave better performance. I thought Casey Affleck was great but i didnt particularly care for his speech overall. That was a big surprise. I wanted denzel to win that award. How about best actress who did you pick and who won. I got this one right. Emma stony got right. Oddly enough leading up to the awards season i am surprised it didnt go the other way. So he was diagnosed as a teenager. He had some problems that would require a year long stay at chop. During that time adam high manmade a important decision that forever changed his life. Lauren johnson has more on this. Good morning, lauren. Sometimes life just seems really unfair, right. We dont know why things happen. Adam didnt understand the symptoms he suffered as a teen and young adult and then it made perfect sense, one day he realized that the pain from his past gave him lifes purpose. Heres his story. I run every day. I have done 38 marathons. Reporter adam highman fell in love with running. It is my sanity. Reporter he became addicted. It is greatest thing i ever did. Reporter truth running gave him chance to escape pain of his past. I would have lots of stomach pains, cramps. Reporter started when he was 13. That time of my life i was playing basketball, i was having friends and doing things. Reporter sickness marred his memories. Basically my life involved going to the doctors and being in the hospital. Reporter doctors were unsure what was wrong with the teenager until they came to chop. They did tests and they diagnosed me with a syndrome. Reporter rare condition left tumors in adam pancreas and his stomach had too many as aid. Doctors removed his stomach but his problems followed him to college in moy sophomore year is when i got sick. Reporter complications from the stomach removal and reconstruction. Took me down, opened me up, kept me open to 48 hours. Reporter almost killed him i was in intensive care for two weeks. I was in the hospital whole year straight with infections, surgeries, bleeding, all kinds of complications. Reporter he remembers it being a dark time in his life. One time i ran away from the hospital with an iv, i was a teenager. I was down by palestra which is the greatest thing ever being a basketball fan and player. Reporter care from doctors and nurses helped him make a decision for his own life. How sit going with the coordinating. Reporter for last 17 years it is just great to give back and doing what im doing now. Reporter adam has been caring for most sick patients at chop. Just one more time so it doesnt block off. Reporter nineteen yearold Christian Smith came to chop at 12 days old. Probably at 12. Reporter over the years one nurse stands out in his mothers mind. We took my son in for his first treatment, for the transplant procedure. Reporter his mother, says it is people like adam who make chop so special. You know, there is no other words. I am still here because of my son because of the care he gets here. Reporter same care adam remembers when he was a patient and now life has come full circle in the oncology division. This is reason for me being here. Something has got to come out of this. Everything negative is a positive. It is now my career. And i dont want to give up i have heard that from a lot of adolescence. His message is the same. It is just a long journey and you just to have stay focused and have goals, realize, if you come out of this, and then you can go on with your life. Reporter just like he had. Does he still not have a stomach. As a runner how does he eat enough food. We asked, he explained it, it is very complicated. They basically reconstruction of his small intestines and he can still eat. Do you love to eat, not to eat so he makes it work. He still running.
