Arlington police say once inside he began knocking on doors, claiming he was a Maintenance Worker. When the victim opened her door, police say the man attacked her and sexually assaulted her. Had the building does have a 24 hour concierge desk. Police believe the suspect might have piggybacked in with a resident. I do think i saw him before. I think hes tried to get in this building it out. Im going to tell my kids now they better keep the door locked because things like this happen even here. So we take it block by block, and we go on different blocks and talk to businesses and evaluate their situation and make recommendations, you know, how to store their trash, how to store their greece, you know, and rodent control plan in pl place. Mr. Brown, hem ask you before you goat those businesses, because it takes long time sometimes to go block by block, if any businesses are watching right now listening to you, what is some advice that you have for them for way they may be able to do thing different toll cut down on the rat problem . Well, the most important thing that business which is do is put waste in the proper place and by that i mean put trash in sealed containers. No clean around the grease containers. Clean food waste from under the dumpsters outside and monitor the area for droppings and rub marks make sure rats not are not there. It sounds like the onus is on the businesses, but how does the city help . So the department of health has a rodent control program. We have nine licensed pest controllers and four Code Enforcement officers. Pest control are respond to complaints from 311 and they conduct inspections on private and public space. Cone enforcement Officers Police the area around commercial establishments for nissan station violations that can attract and support rats, and we issue ticts it could start at 500 and after that it doubles. But the most important part of this is education. We want to educate people. We want to work with people and try to improve the conditions that attract and support rats. Can we do anything, can the city do anything to control the population, though, as opposed to just catching the rats that are there, whether it be some type of berth control, anything like that . Is any of that a possibility . Its a possibility. Anything that works were there for but the most important thing is sanitation. If we eliminate the food source, we can win the battle. We turn to stunning developments in the case against two ro Rockville High School students accused of raping a younger girl at that school. We have concluded that the facts in this case do not support the original charges filed in this matter. Thats Montgomery County states attorney John Mccarthy on friday announcing his office did not have the evidence to go ahead with the rape charges against 17yearold jose mon ton know and 18yearold Henry Sanchez. The case against them gained nationwide attention after the white house weighed in concerning their immigration status. Theyre not entirely free. More legal action is expected day with mon ton know and later this week with sanchez. Joining from annapolis andrew jessick who was the defense attorney for Henry Sanchez. Good morning. At one point in this case police thought they had strong case here not just your client but both of these clients friday we find out that at least the rape c what happened in the meantime . Well thats right. This is basically duke lacrosse all over again. And the only difference from that case to this case is that the prosecutors in this case acted hono honorablely. What happened was the prosecutors invest add tremendous am of time and effort in investigating many witnesses and the cameras and the Text Messages and we also conducted an extensive investigation and the prosecutors looked at it carely after 60 days unfortunately my client had to be in jail for that long after 60 days they decided there was not enough evidence to go forward in short means my client henry was innocent. Innocent by the way that the prosecutor viewed it but your client to my knowledge never really said that he did not have sex with this person, right. Thats exactly true. He was not old enough to qualify for statutory rape so he was completely innocent of all criminal charges in relation to the sexual relations okay. First of all, lets continue on this thread right now. Pornography charges have they been filed yet, will they be, was this part of any type of agreement here on behalf of you and the courts . They have been filed. It was absolutely not part of any agreement whatsoever. We were extremely disappointed that the prosecutor chose to file these child pornography charges against our client essentially its the criminalization of adolescents in america. So this is fair warning that all children with cell phones in high schools and parents that pay the bills for those cell phones could theoretically be subject to the prosecution that my client is facing right now and thats just very diss disappointing. So that then was based on photos that were sent cell phone to cell phone . Well, thats the allegation. We intend to fight these allegations in court and were hopeful a jury in Montgomery County will acquit henry of all the charges. All right. So what is the status right there as far as what happens with these new charge court proceedings, et cetera, and what i guess game plan do you have now with this client based on these west charges . Well, the first step well file a motion for a bail review hearing and that will occur this week. Were hopeful Montgomery County judge will do what it happens in every case like this the client will be released and then ice will most likely pick up henry and hell be transferred into immigration custody and then hell be entitled to another bail review in Immigration Court and were hopeful hell get out. Now keep in mind that ice was the one that held henry for 14 days. Investigated his background investigated whether there was gang advertise and decided to let him go and release him into his familys custody or familys care in rockville and he enrolled in school legally. Ice knew where he was. He was behaving properly. Didnt get suspended living a normal live. Does that change with these criminal cha charges now being r the scrutiny of the lollopy microscope in addition to the ice microscope . It certainly does if hes found guilty of these charges it will be very difficult for him to stay in the country. When we win these charges, which i expect we will, he still has to face the deportation proceedings in Immigration Court and im confident that well have a very good legal argument to keep him in the country, but you never know with immigration these days things are tougher for immigrants around the country given the new administrations policies. Mr. Jezsic let me ask you this when we go back to the Bigger Picture any time you have a sex crime in itself very difficult situation its very emotional situation. Particularly when you are talking about ages of these you were a prosecutor for long time. Youve been on both sides of these issues. Is the law written correctly when it comes to cases involving particularly juvenile rapes . I think the law is written correctly because its clear. Youve got to be four years older than the victim and thats been the law in maryland for decades. And nobody hasea as a matter of fact, in other western states, the law is more favorable to the defendants believe it or not in maryland has kept the law as it is which some people think is too today cone yann. Thats the law and i think its fair. All right. It certainly i mean it certainly a talk. Certainly something that just becomes not even a litmus test but really sparks lot of debate. Sparks a lot of emotion any time you have this particularly when something happens in a school itself. You mentioned as far as the future of your client here. Have you talked with your client recently . Do you still have access to your client now particularly with these newse nw oh, sure. Hes in Montgomery County detention center, and we see him as often as we can. Hes thrilled that the state has chosen to do the right thing. Hes maintained his innocence from the beginning. Weve maintain his innocence from the beginning. And hes just looking forward to vindicating himself with these new charges and also hopeful court. Basically hes very thrill. Very thankful for the prosecutors for doing such a thor roane professional job in deciding to dismiss the case in our parlance that means hes innocent. You mentioned in not, if things do not go your way and he is convicted of this new charge, you did say it would be more difficult obviously for him to stay in the country. If so, would this would he have to register as a sexual predator . He would. There are work, well, its complicate but its very likely he would have to register. But if hes found guilty hes very likely to be deported. All right. It wouldnt matter any way hes be back if this native country in guatemala. And as theyre standing there, the lady who just cut in front was making critical comments about an apparently muslim shopper who was wearing head dress and thats when the lady with the phone who also happens to be muslim pulled out her phone and started recording. Heres the first part of that little inter act. You play dumb and then you say that everybody is i got it. I shouldnt have let in you front of me. Im sorry. I wish i didnt let you in the country. Excuse m huh . I was born here. I dont know if you oh, you were. Okay. They shouldnt have let you in the country. The lady says i was born here. The woman being recorded you eventually see her face. Then goes off on former president obama calling him a muslim. A friend of the woman recording this video posted it on his fate book page. Its obviously gone viral. Generating lots of comments. Weve posted the entire video on our Facebook Page. The entire video is there and we have a few comments here. Here are just a few. From pam, she was just voicing her opinion. No violence, nothing physical just saying stupid stuff to another lady in the Grocery Store line. What exactly is the crime here . Annie says, hard to believe that this occurred in reston. You can see its kind of a little bit of a lag there because of stopping traffic as folks try to get around that big one by mlk, jr. Highway. This is 270 southbound just after father hurley boulevard. Two left lanes had been blocked. Now that crash moved over to the shoulder. But this is causing additional delays as you make your way down from frederick into Montgomery County just watch for a big slow down probably about an hour delay still even though those lanes reopened. From 70 to the beltway. Switch it over now and show i was look at our maps. New york avenue inbound at montana blocked with another crash. Look at 50 and 295 from Riverdale Park on 295 all the way down to the 11th Street Bridge completely stack and then 50 delays from outside the beltway to new york avenue just a parking lot. Try to avoid that route if at all possible. Outer outer loop crash as well center lane block at connecticu avenue look at those delays. Top side of the beltway basically parked from route 1 all the way over passed 270 spur. We are seeing about 45 minute slow down. Inner loop is jammed to connecticut as well. And 95 southbound from theism cc on down dealing with sluggish traffic speeds under 15 miles per hour. Empty street did reopen in southeast.
