Jesse matthew now facing an Additional Charge. Hes now charged with capital murder during an abduction. This has to do with the death of Hannah Graham whos from Fairfax County a second year at the university of virginia. Now, we say an Additional Charge because he still faces firstdegree murder and abduction with aintend to defile. The Prosecutor Says if this goes to trial, she will seek the death penalty. We also heard from the prosecutor as to why they came with this Additional Charge. She said it had to do with new forensic evidence. These are never easy decisions. If i didnt believe that this case were worthy of a capital charge if i didnt believe that mr. Matthew or someone that would be appropriate for this ultimate penalty, then we wouldnt be standing here having this conversation. Reporter its been an emotional eight months to get to this point for the grahams. It started back on september 13th the last time hannah was seen alive walking on a popular downtown mall. Five weeks from the day she went missing, police found her remains. Surveillance video and Witnesses Led Police to Jesse Matthew. After a nationwide manhunt that ended in texas, police took matthew into custody. In february they charged him with hannahs murder. Just a short time before the court started, we did see Jill Harrington the mother of Morgan Harrington walking into the court house. You remember her daughters case still has no formal suspect. Jesse matthew has been linked to it but he hasnt been charged. I think that it is an obligation of mine to be here and to watch what happens. I want to learn. I want to see what happens when evil intersects with justice. And i will pray fervently that justice, whatever that may be eventually will prevail. That is my hope. Reporter and i can tell you that hannahs parents, john and sue graham from Fairfax County were escorted privately into the courtroom. They sat stoic as that Additional Charge was announced. Reporter bowser would not elaborate on why green was forced out, but multiple sources say a series of failed and delayed 911 responses, including a recent incident where the closest paramedic was not sent to a child who was choking on a grape. That child later died. And the problematic rollout of the new computer tablets used in ambulances and fire trucks which also led to delayed response times were all factors. Im very glad to see that the mayor is looking at some of these agencies and cleaning them out, because we need to use her in some of these agencies. Reporter sources say greens testimony last week that her call center cannot meet the National Standard of dispatching help within 90 seconds of getting a call was the last straw. We need to look at it. Weve been talking about it for probably over the course of the year that we need to change or update our current policies to reflect the National Standard. And so that we have something thats realistic to shoot for. We shoot for that one minute and 30 seconds but we dont make it. People rely on that. That has to be perfect because thats the last call somebody may make. So we need to do whatever we need to do and it includes changing the leadership. Now, mayor bowser wants to find a new director who can integrate new technology at the call center. Greenes departure comes on the same day as new fire chief begins his job. Darrell best that pastor is also a Police Officer. Investigators say they found pictures on his phone that constitute child pornography. Hes charged with abusing his 87yearold mother. I tried to talk to him about that today. James. James kirkland, tell me about your mother. I dont think i have a comment, pat, sorry. Reporter James Kirkland was a onetime candidate for the council in Montgomery County. Police say he lived with his mother in this house in bethesda. This is where they say the abuse took place. There were severe wounds on her backside and her legs and they were not maintained properly by the defendant. And there were compression socks she had on as well . Correct. They were on so long they were fused to her feet and had to be removed by doctors at the hospital. Reporter kirkland admitted to being his mothers primary caregiver. He would feed her bread and soup and at times they would split a can of fruit. Did he say where she slept when she was in the house . He did. He said she slept in a plastic chair in front of the television. He stated that was very comfortable. Reporter James Kirkland is out on bond. We were here when he left the house. Last year kirkland ran for the Montgomery County council az a republican but the Republican Party dropped him after the disclosure of an email he wrote containing antisemitic statements. Police say James Kirklands mother is in the hospital. They say her condition is described as serious. In bethesda, pat collins, news 4. One of the Police Officers charged in the death of freddie gray in baltimore filed a court motion today. He claims that grays arrest was legal because of the type of knife he was carrying. Also today we are learning about a plan by the city of baltimore to spend 50,000 to train police on how to legally stop people. According to the Baltimore Sun the training was already planned before gray died. And businesses that felt the impact of the riots last week in baltimore are getting a break. They have been given a twoweek extension to file their april sales tax returns and payments. The definition of assault on a Police Officer could be change changechange change changing in d. C. A bill was introduced that would narrow the definition. Somebody impeding and opposing an officer is considered assaulting. If someone resists arrest they can only be charged with assault on an officer. The police union agrees a change is necessary but do not support everything in the bill. You can see it right along i95 just south of baltimore through the d. C. Metro area, all the way down towards fredericksburg and charlottesville. A lot of rain with this coming through right now. Lets do a couple of zooms for you. You notice from gaithersburg all the way out towards laurel right along 29 over towards columbia maryland and Howard County and right down towards the south, look at this shower that just popped up. A very intense shower right along 50 and 4 i95. That is exit 19a. That takes you towards the bay bridge and ocean city. Look around bethesda right on down through fairfax, lets zoom on this on this region because thats the region about to get hammered. Downtown not much going on. Youve got some wind down there but look at the rain coming at you. This is all in through virginia towards alexandria right down towards mt. Vernon. Some very heavy rain moving off towards the east. This storm not moving very fast. So maybe back towards northeast you might be hitting some of that. Down to the south, Quantico Woodbridge fredericksburg all seeing the rain. It is heavy rain but again notice not a lot of lightning or thunder with this. You may hear a little bit but were not expecting much. A few showers through the rest of the evening. The first round moves out. We may see another round around 10 00, 11 00, although most of us should remain dry. The nationals are supposed to play tonight. I do think their game may be delayed but i dont think it will be postponed. Tomorrow morning maybe some areas of fog and tomorrow afternoon we see more scattered showers developing. Satellite and radar showing we had clear skies earlier and then clouds moved on in. With those storms that came in through here, it is a ryanline. This is associated with a stronger system just to the north, bigtime frontal boundary and a lot of rain back to the west. But then we turn our attention down to the south. This is what jim was talking about, this subtropical storm down towards florida. This will make its way up the coast and sit here a couple of days and then it could move inland. Reporter a Fairfax CountyPolice Officer rescue essays Police Officer rescue essays a man from a burning car. This didnt happen the way you think. What it looked and sounded like just ahead. And well tell you about an unusual exception for a guy accused of p the man from ohio who is accused of plotting to attack the capitol will be allowed to see the evidence against him and hell be allowed to look at it by himself. His name is christopher cornell. Hell get to privately review the video and the audio files in the case against him. Hell have five days to look it over on the condition that he has no access to the internet or outgoing mail during that time. Cornell was arrested back in january. He pleaded not guilty to charges of attempted murder for planning to attack the capitol with pipe bombs and shooting government officials. There was a labor rally on the steps of the Wilson Building today. The d. C. Council passed a resolution standing with the united farm workers. Union members have been in a dispute with geruwan farming for years. The council is calling on the company to come into compliance with california and u. S. Laws. Calm turned to panic late last month on the beltway near i66. A multivehicle accident one car on fire but fortunately all the drivers were okay. Then something unbelievable happened. One of the drivers jumped into his burning vehicle, forcing the first Fairfax County officer on the scene to make a lifeordeath decision. Northern Virginia Bureau chief, julie carey, reports. Reporter this is all thats left of the car that was at the center of a dramatic rescue on the beltway. It was friday april 24th. Theres a vehicle on fire. Reporter heres what officer ramirez could see as he pulled up the camry in frames after striking two other vehicles and the jersey wall. Good news at first, everybody was out of the cars and okay. But suddenly what youd never expect. The camrys driver jumped back into the fiery car and locked the doors. Thats when i made the decision to break out the drivers side window. And upon doing that the flames started coming out of the drivers citedside window so i wasnt able to make my approach that way. Reporter ramirez didnt give up. You see, he was a long island firefighter before he became a Fairfax CountyPolice Officer. He broke out another window still no luck. But then the man climbed out the broken window and just as quickly tried to get back in. Ramirez grabbed him. You could tell he was still on fire. As i pulled him, thats when i burned my hand. But i was kind of determined not to let him go back in that vehicle. Reporter two other officers and a firefighter arrived to help and finally they subdued the man. He and ramirez were taken to the hospital to be treated for burns, but the officers hand healed quickly. Only a few tiny blisters visible today. I would do the same thing all over again. The case of a former fbi special agent accused of trying to crash the gate at the cia. Shes also accused of making violent threats against the Security Officers when she got there. She was supposed to appear in court today, but that didnt go according to plan. Scott mcfarland broke this story on the nbc washington app last night and was there for todays hearings. Reporter in just the past hour prosecutors filed this paperwork specifying the charges against this former fbi special agent. In this very bizarre case, the charge is a misdemeanor. The Court Documents charge her with forcibly assaulting resisting, opposing impeding and intimidating cia Security Protective officers at the agencys mclean headquarters. At a Court Hearing late today davis did not answer the many questions about her case. She didnt show up at all. The judge said davis was not kwaup rating cooperating, that there was significant difficulty getting her out of u. S. Marshals custody and into her chair in the courtroom and that significant force might have been needed. The judge said the charges are serious and ordered an evaluation. Tunisia davis was an fbi special agent from 2004 to 2010 according to a cia investigator. In an incident first revealed by news 4 last night, that cia investigator said davis drove last thursday to the entrance of the nsa in maryland. Was turned away and then tried to enter the front gate of the cia in virginia. Court records say an officer had to physically stand in front of her car before she stopped. They say she reached towards an officers gun belt and later threatened to shoot police. Her Facebook Page includes many videos she recorded of herself. In some she is deeply critical of the federal government and at times vulgar. That Facebook Page was taken down after news 4 broke the story last night. At her apartment complex, friends say davis was a kind woman but often protested Police Conduct and the federal government. Her landlord tells news 4 he was surprised in midapril when davis notified him she was ending her lease april 30th. April 30th is the same day davis allegedly tried to enter the cia gate. And the judge has ordered tunisia davis undergo a Mental Health evaluation likely in the next day or two. At federal court in alexandria, Scott Mcfarland news 4. New reaction tonight to a big sewage spill in our area. A sewer main is leaking thousands of gallons of waist water along huron drive in oxon hill. Tracee wilkins just talked to the person who discovered this problem. Reporter i know that people here are really happy that this rain is washing away some of that smell, hopefully. It was the smell that helped this neighbor discover the problem. You could smell it. Reporter doug waller says he was cutting grass on wednesday when it smelled like sewage. Reporter thats when you noticed something bubbling from underground. Its been going on i dont know how long. But thats what i first noticed it friday. Reporter wssc Spokesman Says the crack in the 14inch sewer line has spilled 10,000 gallons of sewage. Workers are laying 7,000 feet of temporary pipe. That work could take days. And then the work to repair the actual line could take several weeks. It probably is a lot of damage but i dont know how long its been leaking. Reporter the leak is located behind homes on huron drive off of a field near Forest Heights elementary. Some of the sewage has gone into oxon run creek where we watched children playing today. There are about 20 signs posted at the site of the leak and a lot of caution tape urging folks to stay away. Something that weve got to deal with. Reporter wssc spokesmen are saying this will not impact drinking water. They are concerned about this getting into the creek and are monitoring that very closely. Jim, back to you in the studio. A woman from Northern Virginia could face life in prison for running down her exhusbands fiancee with a car. The womans name is margaret henry. She pleaded guilty to all three of the charges against her. Back in january, she drove past her exhusbands home saw him in the yard with his fiancee. She went back and drove her car across the lawn and hit the fiancee, pinned her against a parked trailer. The womans injuries were so severe that her lower leg was amputated. Henry is going to be sentenced in july. A big night in alexandria as longtime mayor bill eulle faces a challenge within his own party. He has been mayor since 2003. Hes a democrat and for the first time hes facing a primary fight. Former mayor, Kerry Donnelly and the council vice mayor, Allison Silverberg are hoping to unseat him. The primary will be held on june 9th. Hundreds of Law Enforcement officers gathered in Downtown Washington today for the annual blue mass. A service at st. Patrick cathedral honors local, state and federal officers who died in the line of duty over the past year. Archbishop donald wuerl led the solemn service. The 2yearold as taken to the hospital with whats reported to be a fractured skull. The 8yearold needed a few stitches. Were told that police want to thank all of the adults that were in the park at the time that this happened to help the other children get to safety.
