Police and an 18yearold boy. It happened back in 2011. And now the American Civil Liberties union is using to call for an end to a controversial anticrime tactic thats long been used by the d. C. Chapter of the aclu is calling to an end these jumpout squads as they refer to them plain clothes officers in unmarnged vehicles and the video from the day that rafael brisco was shot shows them in action. Reporter the ford suv seen speeding up the road southeast in the seconds before rafael brisco was shot is a police vehicle. The head of the d. C. Chapter of the aclu says it doesnt look like one and she thinks it should. Rafaels death remains the result of a disturbing and ongoing pattern of dangerous tactics and strategies employed by the metropolitan Police Department in black communities in the district of columbia. Reporter the images from a d. C. Police surveillance camera mounted on a utility pole begin with a shot of 18yearold rafael briscos shadow. Attorneys representing the d. C. Government told jurors it showed a gun in briscos handle. His lawyer says its his finger and a cell phone. The former High School Track runner is seen spribting away from the unmarked suv with d. C. Police officers inside. Neither side disputed a shot was fire prd the vehicle but lawyer who represents briscos family says the video also shows a gun, a b. B. Gun, being thrown from the vehicle toward the 18yearolds body. Still images taken by mobile crime scene technicians show the gun broke sboon two pieces. Video did not persuade the jury in the familys civil lawsuit against the d. C. Police department to the disappointment of his mother. Looking at the video, it was a driveby on him. So im just angry. Im very very angry and im not going to stop until justice is served for my son. Reporter billy ponds is the familys attorney. We will continue to fight. Well file a motion for a new trial. If we lose at that level, we will appeal. We will take every possible Legal Recourse to correct this injustice. Reporter we have a statement you can see released a few moments ago by d. C. Police. It reads, plain clothes and Undercover Police operations are used by mpd for multiple purposes such as investigating problem robberies, burglaries, drug, prostitution and gun offenses. They are not targeted at any particular community but used to address crime problems and citizen complaints. That is a statement from d. C. Police about what the aclu referred to as jumpout squads. Live in northwest, Jackie Bensen news4. Police who shot and killed a man in Washington State are drawing criticism and protest from as far away as mexico. A farm worker of latino descent is accused of throwing rocks at cars and officers. The incident on tuesday was caught on cell phone video. Officers yulzed a taser to try to stop the man. When that didnt work police ran after him and opened fire. Theer investigation and the officers are now on routine administrative leave. Police say a robbery suspect in the district shot and killed himself after trading gunfire with officers last night. Just before midnight patrol officers began chasing the guy who was suspected in backtoback armed robberies. One happened on riggs place. The other was on swan street in northwest. Police say the man fired at them and they fired back. Before they found him dead near caroline and 15th streets. Witnesses reported the man shot himself. Just in tonight, the news4 iteam is learning more about the National Impact of the smoke emergency that killed a woman on metro last month. We just learned that atlantas marta rail service and b. A. R. T. In San Francisco are having their ventilation systems audited by the National Transportation safety board. Its part of the nationwide review triggered by trast last months deadly incident in a tunnel outside lenphant plaza. One of the survivors from that smokefilled metro train gave emotional testimony on capitol hill today and news4s derrick ward was there. Reporter on capitol hill today, there was more information about why d. C. Fire and ems radios didnt work during this incident. D. C. s assistant fire chief said that metros tunnel equipment designed to boost radio signals underground wasnt working. However, all communications once we were back at the surface level, worked flawlessly. Reporter metros board chief says they satisfied most of the safety recommendations theyve gotten so far. I believe weve made Real Progress but we cannot claim that we are where we need to be in the face of this event. We need to do more. Reporter todays hearing was before a joint transportation and Government Operations subcommittee. It probably wont result in any legislation addressing last months incident but there is federal money for from metros Capital Budget for improvements and equipment upgrades, and its the culture of safety that most concerns all involved. Essentially metro is the nations metro system and it serves the members of congress. And so i think we have a vested interest. As for that federal interest the department of transportation will be doing an audit of metro safety procedures and the National Transportation safety board will hold two days of hearings on the incident in june. Now, the ntsb doesnt expect to have a probable cause for last months incident until sometime after those hearings. Thank you, derrick. New at 6 00, a struggle with a Convenience Store worker is caught on video during a robbery. A man with a mask ran into the highup food mart in sterling about 9 30 wednesday night. He jumped over the counter and grabbed money, then got into a fight with a the cashier. At one point the robbers mask came off, giving us a good look at his face. The number of fighters reported to be involved in an attack by isis at the Al Asad Air Base in iraq has tripled. Were now hearing that 25 fighters were killed by Iraqi Security forces today. Reporter first i want to let everyone know that the store is back open. It was closed far while earlier today because of this investigation. It happened in the underground garage. If you drive down that ramp thats where it happened. And when you look at these new photos you realize this was a close call. This viewer photo shows the air bag deployed when a car slammed into the wall of a giant food store from inside the underground garage. It left a huge hole behind the dairy section of the store not far from shoppers and workers. Rescuers freed the trapped driver and passenger from the car and took them to the hospital. The store off connecticut 1 2 the Van Ness Center in northwest d. C. Was shut down as d. C. Inspectors made sure the building did not sustain structural damage. Reporter this man was trying to get something out of his car. No luck. Im across the street and just need to grab something from my car in between. And cant get into my car, so guess we have to just wait it out. Reporter police tell me the people in the car were not seriously hurt and no shoppers or pedestrians were hit. Theyre still trying to figure out what caused the driver to smash through the wall. So far no charges have been filed. Just a short time ago i was able to talk to someone with dcra the agency that sent the buildingment in or thes here. Im told they have been given the allclear. Tonight president obama is condemn kwhag heing what he calls the brutal and outrageous murders of three College Students in north carolina. He says the fbi will now decide whether any federal laws were violated. Thats in addition to the local charges. The family of the victims believe it was a hate crime. They think the victims were targeted because they were muslim. Today muslim groups held prayers in front of the white house. Craig stephens hicks is in kuls di for the murders. His wife says the shooting stemmed from an argument over a parking space and had nothing do with race or religion. A lot of people are scrambling to change weekend plans. Millions of people bundling up for dangerously cold weather this weekend. Temperatures are expected to be in the Single Digits in new york with windchills that are below zero for much of the midatlantic and the northeast. This is cold you dont kid around about. No and, you know, another blizzard for the boston area. Theyll see that for them. For us its just going to be dangerous cold here. We saw cold this morning but the real dangerous cold is tomorrow night into the day on sunday. And dangerous winds, thats going to be the other issue. Yes, its cold out there right now. Current temperatures sitting at 28 degrees, wind out of the northwest at about 8 miles per hour. Not much. Were not seeing the wind like we did earlier today or last night. We wont see that wind return during the day tomorrow. 28 degrees in d. C. 21 in gaithersburg 25 frederick, 27 in manassas. You saw it switch down to 23 in huntingtown. Its a cold evening. Its going to continue to be with windchills in the teens to around the low 20s in most areas. Satellite and radar showing clear skies so, that will help we move on through the overnight hours. So we are going to see a cold night tonight, but the real cold air, the real arctic air, our second blast up to the north right now. It will race through the region tomorrow and it will come in the form of rain and snow. So we have the cold air early tomorrow morning. But then well warm ahead of that system as we normally do. Look at this rain snow showers around portions of the area even around the d. C. Metro area around 5 00. Some could come down at a pretty good clip and if you see one of those snow showers you could pick up a quick half inch to an inch of accumulation tomorrow. Not everybodys going to see it but when you do see it it will come down fairly heavily during portions of the afternoon. By 8 00 at night when most of us are eating our valentines day dinner the wind starts to pick um. And when you come out around 10 00 it will be windy and man is it going to be cold. Tomorrow night is really going to be quite brutal as far as its concerned. Windchill watch in effect for areas to the west of d. C. 25 below to 15 below. That is brutal dangerous, arctic air. Watch out for that. Again, even around the d. C. Metro area not in the watch, but we will see an advisory with windchills below 5 below zero in the district. High wind watch in effect for everybody in our viewing area. Winds gusting upwards of 60 miles per hour. That of course dangerous wind. We could be seeing some of the trees down maybe some Power Outages during the day tomorrow. So this is not to be messed with. This is just the limbs down trees down and power poles could be down too so we could lose heat in the house. So be prepared for these stronger winds. Look at the windchills. As we make our way through the day tomorrow tomorrow afternoon, not bad. Were in the 20s. Its cold. Well we first came to maryland 1677. Reporter billy veers is an 11th generation marylander who can drive through rockville and see his name scattered about, veirs mill road paving. It was his great great great grandfather samuel clark veirs who built the mill the road is named for. It was a gristmill back in the 1800s. They employed i believe about 100 people. Reporter over the years the family has owned several thousand acres in rockville. They ran the mill for 9 year s89 years. Its now gone but the road is bier than ever. It was a path that once looked like this. Kind of makes me feel proud. Reporter why name this particular stretch viers mill road . This route used to be used by customers in rockville and kwheeton to get to the old mill. Its now bustling filled with houses Apartments Stores and restaurants. But no matter how prominent and known around here as long as i can remember it was misspelled. Reporter for some the name is a little tricky. It could affect your valentines day. Tonight how First Responders are getting ready for winds that could reach 60 miles an hour. Two moms two hotels and two cases of kids being left alone in rooms. In one case all weekend long. At 6 30 now, the d. C. Snow team is getting ready to send out more than 200 trucks tomorrow to treat roads around here before potentially a mezy saturday night. That snow wont be the biggest problem. Its going to be the wind and the windchill. Doug and amelia are tracking all this for us. Doug if we thought this morning was bad, were going to be in for even worse, right . Yeah. Thats for sure. Of coursitis coming during the weekend when a lot of people have plans for the weekend. Take a look and well show you whats going to be happening the next couple days. You mentioned the snow monopoly not expecting too much. Could see up to an inch in some areas but it will stick as a result of the cold temperatures. Then we see winds gusting to near 60 miles per hour. Thats dangerous wind. The time period were really looking at is going to be saturday night into sunday morning. During that time winds could gust near 60 miles an hour. Take a look at the forecasted gusts. This is tomorrow morning. Just breezy outside, not a big deal. Lunch tomorrow still breezy. Its dinnertime 8 00 p. M. When we start to see wind gusts between 30 and 45 miles an hour. The wind are howling late saturday night into sunday morning. 7 00 a. M. Sunday morning we could see winds gusting up to 50 to even 60 miles an hour and with winds that strong we could see some Power Outages across the area. And then winds start to die down throughout the day on sunday. So as far as the damage is concerned, if you can, avoid parking by trees because we could see some downed trees and cant rule out Power Outages, again, and this is only not shot of cold air in a string of many we were forecasting. Quite a few cold days out there, high wind watch in effect into the day on sunday. Im david culvert in Northern Virginia where these fairfax firefighters and medics are readying their rigs for a deep freeze. If this frees up it could crack a line or Something Like that and it makes it inoperable. Reporter one place you dont want a pipe to burst, on the scene of a fire. So theyre prepareing to drain the tanks on whats expected to be an even colder weekend. If we need to we can shut off our tank pump valve, then i just open my drains and let all the water out. Reporter the technician showed us their warm weather gear insulated gloves and full bodysuits. They need to be ready to stay outoutdoors for hours. They all keep a small go bag. Even on the coldest days were hot and sweaty and we have something to change into to be dry. Reporter they recommend the same for all of you working outside. The many layers and hard labor can also make you dehydrated. So just like the hot summer days they warn drink plenty of water. We found just about everybody bundled up for a walk outside with their dogs. Elie here even willing to give a hug, just to keep me warm. Off. Reporter but medics warn even if youre planning to be in a warm car, prepare for worstcase scenario. Make sure they have a coat with them thats appropriate for the weather conditions and, you know possibly have some gloves just to stay warm if you are stranded. Reporter in arlington, im david culvert, news4. After spreading like wildfire this winters nasty flu season is finally peaked and even appears to be on the decline now. The flu is still considered widespread in 32 states according to the latest report from the centers for disease control. That includes maryland and virginia. But its no longer widespread in d. C. And its become less widespread and less intense in the last couple of weeks in most parts of the country. The flu reached its highest levels at the beginning of january and then stayed there for weeks. A woman from Fairfax County is going to have to wait a bit longer before she sees Jesse Matthew face trial. Today a judge in the county moved that trial to june 8th. It had been scheduled to begin in march. But matthews lawyers wanted more time to look at dna evidence. Matthew is accused of raping and trying to kill a woman back in 2005. Earlier this week he was indicted for the murder of university of virginia student gramhannah graham. She disappeared back in september. Matthew was one of the last people seen with her. The trial in fairfax is expected to last about two weeks. One of two men suspected in a Shopping Center shootout in Loudoun County is going to stay in jail. The other is in a hospital. A judge today set a preliminary hearing for Jared Williams for march. Hes one of two men taken into custody after an armored car robbery in the east gate marketplace in south riding yesterday. Police say the armored car guards fired back hitting the other man. Officers later stopped williams and the other man on the Fairfax County parkway. Two mothers are facing child neglect charges tonight, one in Loudoun County virginia another in Prince William county. Both are accused of leaving their kids alone in hotel rooms. Our Northern Virginia bureau chief julie carey reports now with a story seen here only on news4. Reporter a Loudoun County grand jury just indicted this mother of two on felony child neglect charges. Lynn ann allen has been arrested twice in recent months for leaving her 7 and 11yearold kids alone in a room at this Extended Stay Hotel in sterling. We first learned of the investigation in search warrant documents. A detective says in october allen allens 7yearold son phoned for help after he was left by himself for two days with only sierra mist soda and cheetos to eat. In Prince William county yesterday, a different case similar circumstances at the Value Place Hotel in manassas. Evidently housekeeping went to a room to do their normal cleaning tasks and discovered a 2yearold baby girl left in aplaypen and no one around. Reporter about 30 minutes after Police Responded to the fourthfloor room the childs mother showed up. Shed been gone for at least an hour. After police finished questioning here 24yearold tia lasharma parker was charged with misdemeanor child neglect. We watched as an officer retrieved something from her car. Police tell us it was marijuana. So she faces a possession charge too. But her little girl was not taken into protective custody. She appeared to be healthy and well cared for and i guess social services decided it was okay to leave her there with the mother. Reporter across the road from the hotel we told shoppers about the case. Laura ainsley has four children. As a home schooling mom she was rarely far from her kids. She wishes struggling parents knew more about available services. I think a lot of people dont realize the dangers that are out there for kids and they just make a bad decision. Reporter the mom from this this hotel charged in the Prince William county case didnt have to go to jail. She was released on a summons. The mother outin Loudoun County bonded out of jail this week. Im wendy rieger at the live desk. We have new clues tonight into who may have set that fire at a chantilly walmart. Police leased these pictures of the man they think started it. That store had to be evacuated last wednesday when staff noticed flames in a clothing section. Police believe this this man ignited some sort of a device is that started that fire. Surveillance cameras took these picture just near the clothing section before the fire started. Police are asking for help to identify him. At the live desk im wendy rieger. Talk about lucking out. Youre talking about two women who survived a plummet by their suv 60 feet off the Hackensack River bridge up in new jersey today. The driver of the car says she swerved when a tractortrailer cut her off. She hit a snowbank on the bridge and that sent the vehicle flying through the air. It landed upright. Firefighters cut away the roof and the doors to get the women out. But they were only complaining about neck and back pain right now. A shocking scene at a Maryland Bank today. A boy who could be as young as 10 years old walked in with a suspected robber during a holdup. Happened just before noon at the Suntrust Bank in waldorf. When the man got up to the teller window, the boy turned around and waited by the front door. The man gave the teller a note implying he had a weapon and demanded cash but he left the bank before taking any money. Three Montgomery County High School Students are in some trouble right now after a scuffle that caused their school to be evacuated. Police say it all started in the cafeteria of the high school in Silver Spring at about 11 30 this morning. Two kids were about to fight, two boys. A School Security guard stepped in. Moments lamt err girl got involved and she started fighting with the boys and the guard. Montgomery county police were called. They came and the three teenagers were arrested on the spot. Coming up new at 6 00, the fight over a program to help young boys struggling in school. A new response to the d. C. Council member who says its sexist. And celebrating 40 years of a television institution. Today a d. C. Council member wonders if an all boys program is sexist or even illegal. Reporter duane goes to payne elementary in the district. I would want him to have a positive role mod toll look up to but its not a lot of them. Reporter they recently announced empowering males of color, a 20 Million Initiative to help black and latino male students to succeed. It includes the opening of a College Prep School for minority boy bus tonight the District Attorney general is reviewing the legality of the plan at the written request of mary shea a constitutional law professor. Doesnt mean you have to have a separate girls school but you cant not have a devotion of money and comparable resources to girls as well. So i wanted the attorney general to look at the regulations under title ix and title ix and also the equal protection clause. Reporter Council Education Committee Chairman david grasso counters shea with a bleak statistic. Just 50 of male students of color in dcps graduate on time. Just because were going to focus a little on these young males of doesnt mean well leave the girls behind. Theyll be engained in mentoring program, engaged in all of the academic programs we have. As far as im concerned, latino males and black males, got to have more focus on them because our males have fallen so far behind. Reporter middleton likes the idea of special programs for duane, but she likes it for little girls too. I think they should also open up an all girls school because everybody should have the same opportunities across the board. Reporter mayor bowser told news4 there will be no change in course.
