investigation is ongoing. kirk gregory, nbc news. there is a storm that's moving very slowly and dumping rain all over our area. a lot of people could be at risk for flooding tonight. doug's up in the weather center with the latest on this, doug? >> the biggest concern is flash flood potential over the next 24 hours. after that, it's the bigger rivers that are going to have problems. already we have flood warnings along the shenandoah, and also around the monocacy river and antietem creek. flooding could be a problem around washington harbor. it's a scenario that will play out over the next couple days. you can see the rain making its way into the area, from the south, the rain right now, into portions of faulkeer county, and into west virginia we're seeing the heaviest rain right now. down to the south around gainesville, around the warrenton area, seeing moderate to heavy rain at times, this is going to be a steady rain for some, others -- notice washington there to the right of your screen, not seeing any rain right now. that's going to be the scenario over the next couple days. it's not going to hit you all day long, but when it hits you -- the latest on another tropical system. it's not lee, it's not katia, i'll tell you what the next name could be coming up 37. right now there are more than 14 million people in america unemployed 37 later this week, president obama will present to congress his plan to create more jobs. mitt romney is one of the republicans who wants to take mr. obama's job next year. he floated his own jobs proposal today. steve handlesman is on capitol hill with more. >> it is jobs week reboot on that big issue, critics are saying, what took so long? the president, the congress and the candidates are focused on our crippling 9% unemployment. third straight day. amid concerns about another recession. the dow jones fell about 101 points. the nasdaq was down by 6 points, and the s&p 500 ended the day about 9 points lower. a high school band teacher accused of soliciting sex from a minor on the internet was in court today. michael cook was arrested last week. his attorneys went to court to get him released from jail. elaine reyes is outside the fairfax county courthouse with the developments. >> we can confirm that he's no longer at the fairfax county adult detention center. he's been suspended without pay from the fairfax county school system and his arrest was part of a larger police investigation. >> after spending nearly a week behind bars, a fairfax county judge set bond at $10,000 for 43-year-old michael cook. investigate irs allege the robinson secondary band director solicited an undercover police officer online for oral sex. in court this morning, prosecutors said the officer posed as a 14-year-old boy and robinson student. according to the search warrant affidavit, cook e-mailed a photo of himself and discussed meeting the officer at a specific time and location in fairfax county. it never took place. >> the alleged incident occurred sometime this summer and the arrest took place on august 31st. it was not immediately released. this is an ongoing investigation. and we don't want to do anything that would jeopardize the investigation. >> defense attorneys say cook has no criminal record. michael cook directs the symphonic and marching bands at robinson. school officials e-mailed parents yesterday. >> our kids never said anything bad about him. >> my daughter took the area band as well as a friend of ours, we were quite alarmed about it, you know, that it happened. >> disgust and -- i was happy to get the letter. what people do in private, you never know. and so the fact that he was caught -- you know, it's only good. >> reporter: as part of his bond conditions, cook must stay away from the school. and is not allowed to have unsupervised contact with anyone under the age of 18. the robinson band and orchestra, parent organization said, our focus is working with the robinson school administration to ensure the ongoing high quality education of our children. michael cook's next court hearing is scheduled for october 25th. reporting live from the fairfax county courthouse, elaine reyes, news 4. >> elaine, thank you. police in annapolis maryland are looking into the first murder in that town this year. it happened in the 1,000 block of monroe street near bay ridge avenue and madison street. 19-year-old tiandre leanndra wallace was shot this morning. a person of interest has now been arrested. the city of annapolis only had four homicides all of last year. rudy giuliani once served as the mayor of new york city. in a speech today, he said security in the u.s. is quite different now from the decade since the september 11th attacks. the next attack on the u.s. might not look like what we remember from 9/11. >> he talked about that, jim. and he also warned against complacency as the tenth anniversary of the attacks approaches. america cannot ignore islamic extremism or repeat the mistakes made before the 9/11 attacks. >> it was the worst day in my life. worst day in the life of my city. to some extent i imagine the country -- pretty close to the worstdy in the country. and in some ways it was the greatest day because of the display of bravery, fortitude and strength that people showed. >> now a security consultant. giuliani told a national press club audience there have been 40 attempted terror attacks in the u.s. over the past decade. but he says, america needs to realize the next terror attack won't look the same as 9/11. in the meantime, the nation needs to get its fiscal house in order. >> when this country needs to worry about whether we're spending too much money defending us, this is a national security problem. >> security has changed around the u.s. capitol with barriers, signs and an increased police presence. some feel it's not enough. >> i personally feel that it's not much better. i feel like they made a lot of plans. but with the hurricane and earthquakes, all the confusion that happened. i don't see that anything was implemented. giuliani lashed out at the obama administration's plan for troop withdrawal. >> we should remain in afghanistan, in iraq, and in that part of the world until people in that part of the world, significant numbers of people stop trying to figure out how to kill gone or half gone. >> reporter: gone too is monica's home. >> we just found out our house is destroyed. right now i'm sitting and praying, because i don't know right now. >> it's the not knowing that's the hardest part for 5,000 families forced to evacuate. >> i'm looking at the fire right now, and thinking, that could be my property that just went up in smoke. >> crews battle the blaze from the air and the ground. but it may take mother nature to help gain the upper hand. >> as long as the winds stay down a little bit. firefighters will have a better chance of keeping the fire under control. >> control so desperately needed to stop more life changing loss. jay gray, nbc news, texas. >> drought in texas and we can't get a break from all this rain here. >> no, and believe it or not, they're both kind of from lee. our rain is from lee, but tropical storm lee is bringing winds down toward texas helping to fan those flamesp we're not going to see an end to this rain for the next three to four days. we're dealing with rain across parts of the area. but tropical storm lee also brought with it a number of tornados, even this one that affected an area to our south. just to our south around virginia, this is right along the north carolina/virginia border, it did affect us, you can see this convenience store and gas station really took a hit. numerous customers were inside when the tornado came through. good news. there were no injuries. you do get tornados associated with inland tropical storms and we still have tornado watches down to our south. outside right now, we're looking at 65 degrees as far as the temperature is concerned right now. it's still raining in most of the area, and today so far -- and i think it's going to stay this way, the coolest day since the middle of may. it's very cool outside with winds out of the northeast at 16 miles an hour, it feels even cooler. 61 in martinsburg, 61 in winchester. the warm spot is the pawtuxet river coming in at 68 degrees. that's how cool things are, we should be in the low to middle 80s this time of year. all this because of the rain, the clouds. the rain came through portions of maryland this afternoon. we're looking at more rain coming up from the south. we're going to watch to see if the nationals are going to be able to play tonight. i think they may get to start the game, but i expect some shower activity during the game. there may be a couple stoppages there. the live view showing where the rain is. light rain into faulkeer county. random showers around. the biggest concentration is around west virginia and berkeley and jefferson county. and right on the boarder between faulkeer and louden county, just to the north of gainesville. we go up to the north, toward jefferson county. washington county and frederick coun county. our friends in middletown seeing some of that rain. also around the shepherds town region you're going to see the rain on the moderate to heavy side. look how far the trail goes from maine all the way down toward the gulf coast and the atlantic, this is where our moisture is coming out of. did i mention the tornado watches? here they are. southeast portions of virginia and south carolina. all from tropical storm lee, which is spinning just to the north of atlanta. it's not going to move any time soon. a few showers, and maybe a few thunderstorms. i think most of those will stay well down to our south. expect the rain and once again tomorrow. tomorrow morning, just some skat heed shower activity. not real heavy rain. tomorrow afternoon, especially if we get sunshine, we could see thunderstorms develop during the afternoon with warmer conditions. high temperatures around 80 and maybe even a severe thunderstorm. the tropics, we have lee right now, this is katia, and this is tropical depression number 14. we're going to have to watch closely where this goes. it is on track to become a hurricane right around san juan puerto rico, day five. i'm hoping it will follow katia and head out to sea. that's what katia is going to continue to do. we talked about this before, right now it's a category two storm coming close to our area and right on back to sea. good news for us. the only impacts here will be rip currents along our shore line. areas of rain this evening, 60 to 65 grdegrees. tomorrow, temperatures, 60 to 64, rain likely. possible flooding. winds out of the east at 5 to 10 miles per hour. that could bring in those thunderstorms tomorrow afternoon. 77 to 81 degrees. as we move on through the next couple days, more rain likely. thursday and on friday. but here's the good news. >> 84 on saturday, sunday right now, coming in with a temperature of 83. i have the weekend dry for the most part. >> i'll go with a airspace across the entire region is restricted, keeping private aircraft away. the 9/11 attacks force d a chane in how the nation's capitol is protected. from a hangar near reagan national airport, a unit of the coast guard is always ready to take off high above the capitol region. >> usually you associate 9/11 with commercial airliners that got hijacked. that doesn't take into account all the cessnas. >> reporter: the federal government created two rings of flight security around the nation's capitol. think of the beltway as the imaginary line. only military, law enforcement and commercial airplanes are allowed within the inner ring. since 2006, it's the coast guard's job to keep unknown or unwanted aircraft out of both. the coast guard's mission is called rotary wing air intercept, anything that is low to the ground gets met by one of these. commander andrew dutton and his team take off and send pilots of wayward aircrafts a message with this special board. this one says, you have entered a restricted area. >> we can get really close to people, talk to them on the radio. and we get them to follow us away from where the danger might be. >> most of the people that have been intercepted by us, they're lost. they just got disoriented. and sometimes they quickly exit those rings before we even have a chance to get out there. >> even if someone doesn't have hostile intent. just the fact that they enter the airspace aeb get too close to our nation's capitol, the white house bs the pentagon and k street. the mere fact that they get too close to those places can cause a lot of chaos. >> reporter: in five years, coast guard pilots have made more than 300 stops. in now one of the most heavily protected areas in the world. >> we cannot let this happen again. and the restaurant in carson city. two people were killed. the motive of the gunman still isn't clear. our national security has changed a great deal since 9/11. he spoke out today at the national press club here in washington. he warned against complacency as the tenth anniversary of the terror attacks approaches. he says americans cannot ignore violent islamic extremism. a $10,000 bond has been set for a band teacher accused of soliciting sex from a minor on the internet. cook is the director of the marching and symphonic bands at robinson secondary school. he's been suspended without pay. >> traffic debts were down in the district last year. police say photo enforcement is one of the reasons for that. >> the city announced more than a dozen speed camera locations across the city. derek ward has more on the efforts to make streets safer. >> some of us may pose the camera, getting flashed by one of these will cost you. starting this month, over a dozen more photo speed cameras will be on d.c. roadways, the new ones are already in place -- >> i think they have enough speed cameras in the city already. >> others are planned at the 48 and 4900 block in connecticut avenue northwest. and bladensburg road northeast. another proposed location here in the 600 block of missouri avenue northwest. one thing a lot of these locations have in common is lots of traffic. straightaways and a history of accidents. it's expected that the new cameras that are placed in heavy pedestrians areas will heighten safety for those on foot. no one would argue against pedestrians safety being an important issue. some motorists argue the city is more interested in revenue. >> d.c. doesn't have any money. i think maybe they need to look at how they divide the money with the company that runs the cameras. >> d.c. has wracked up more than $30 million in annual revenue from the ticket. while they don't result in points on your driving record, they still hit where it hurts. the latest wave of cameras began showing up this week. and there will be an educational period for ticketser ued that won't carry fines. come october, the fines will follow the flash. the metropolitan police department doesn't keep the camera locations a secret. you can find the list of locations on nbcwashington.com. for a lot of people today, they had no choice but to slow down. this is terrible traffic tuesday. marks the highest congestion on the year on the roads. police are keeping a close eye on traffic hotspots surrounding the new mark center in alexandria. the rain this morning added to the delays on 395 northbound. to make matters worse, d.c. drivers, we are told spend more time sitting in traffic than in any other city in this country. that's according to a recent study by the transportation institute. today the first day of school for a lot of kids in northern virginia. in alexandria, arlington, fairfax, falls church, prince william and stafford counties, they all went back to class. for the first time the school day was doubled in time for some of the kindergartners. many welcomed the longer learning day. >> reporter: it's a first day of school unlike any other. kindergartners headed to the bus after a full day rather than a half day of class. >> we're thrilled. i was trying to figure out how she would learn a full day's worth of curriculum in three hours anyway. this is just great news. >> reporter: most of fairfax county's 138 elementary schools have had full day kindergarten for years, 36 mostly in affluent areas did not. parents complained their children were getting short changed. in may their campaign paid off. the school board voted to take full day kindergarten districtwide. >> it gives them a prolonged period of time where they can focus on the academics. >> she has more time with the teach hes. >> the change to full-day kindergarten may be more significant for the teachers who were used to having to squeeze all the academics into a half day. now they get twice the time. sheila winn's been teaching half day kindergarten for 15 years. >> i did find that i said hurry up, let's go, let's go, hurry up a lot. >> reporter: now with full day kindergarten class she'll be able to slow the pace. >> we're allowed to pay attention to the developmental needs of children who move a little slower, to take things at a more relaxed pace in the beginning. >> you have time to explore and to know the chern in a better way. >> full day kindergarten also means jobs. 150 positions were added to expand the program. >> a former elementary school administrator pleaded guilty today to a child porn charge. 29-year-old joshua myers of warrenton was caught in june during an undercover operation. during a search of his residents, it was discovered he was sharing files that contained child porn. he faces 5 to 20 years in jail when he's sentenced in december. coming up tonight, a snapshot that shows that littering has gone universal. the rain and flooding right moderate rain for the most part. it is a steady rain for most of the area. down toward leesburg, closer to fairfax and resten, down to the south and gainesville all seeing rain. notice washington, d.c., though. not in the rain right now, i think nats part is going to skip out on this latest round of showers. speaking of that, let's take a look at the fear cast as they take on the dodgers tonight at 7:00. 64 degrees, i think they'll start on time, there will be possible delays. make sure you bring those ponchos looking at the rain, just to the south. if there were delays and i think there is rain. i think we'll see a possible delay around 8:30. if strasbourg's pitching well, that puts us around the bottom of the fifth inning. the irs is offering money now to anybody willing to turn in tax cheaters. people willing to snitch will get between 15 and 30% of the cut. what that means is, the more the government gets from the law breaker, the more the snitch gets. the irs notes, there's no protection from retaliation, and they point out that the earnings that the dime dropper gets is taxable. >> of course. we're getting a new look at space travel history on the moon. a nasa orbiter has snapped the sharpest photos ever of what nasa left behind from the apollo 12, 14 and 17 trips which happened between 1969 and 1972. even after several decades, tracks from the buggy astronauts used to get around are still visible. they also saw the backpack the astronauts threw from their lunar landers before returning to earth. the new photos come just days before two robotic spaceships will explore the moon's gravity. >> fascinating. it looks like they're going to get the game in tonight? >> yeah, if we go by doug kammerer's baseball expertise, maybe a rain delay in the fifth inning. it looks like steven strasbourg will be pitching tonight. it will be good to see him out there. also, talking about maryland's big win making national noise. randy edsall talks about that colorful debut last night. i would imagine there are more than a few people out there really wanting to see what strasbourg's about. >> there's a lot of pressure on him tonight, isn't there? >> yes, there's a lot of media out here already. the fans trickling in. i think they're being wary of this game because of the weather. for the first time in 368 days we're hoping to see steven strasbourg on a major league pitching mound. last year during his debut he struck out 14 batters. technically he's still rehabbing that elbow. if something happens and he doesn't go, we'll see rookie brad peacock on the mound. if the game's cancelled, going to be a doubleheader tomorrow. strasbourg spent the last month in the minor leagues, making improvements on various levels. he flashed his old format times and did appear to get better and better. if the weather allows, everybody in the nats organization will see him back on the mound including general manager mike rizzo. >> we're looking forward to seeing steven back on the mound. i saw two of his rehab starts in the minor leagues. looking forward to seeing him tonight. and looking forward to the next step in his progression and rehab. >> it's unbelievable. i was telling the guys in the bullpen all year long, looking forward to the possibility of him making a big league start this year. and hope to see him again, as players, you know what he brings every five days is a playoff atmosphere. the fans are out here, they come outs want to see him. we as teammates want to watch him too. >> he's going to bring a full house. he win for our university, for the state. for the players, assistant coaches. i couldn't be more proud of the effort that everybody gave. we talked about, when i came here, i talked about building a team. and tonight -- i mean, really the whole team came through, the players did their jobs. the coaches did their jobs, the fans were unbelievable. the fans -- if we can create this kind of an atmosphere every saturday, we're going to be tough to beat. >> the players inside the uniforms are going to win this game. it's important -- >> maryland starting off the season in style. up a level, paper, pencils, notebooks and other supplies that help them get started. the principal says that program is a big help to the families. >> we have two out of every three of our students are in free metropolitan region have received backpacks. the university of maryland's football team has been the talk of the internet over the last 24 hours because of those new special occasion uniforms the team radar here, just down to the south. around the fredericksburg area, starting to see the rain moving in. that's the rain i expect to see around 8:00 and 8:30. we could see a little bit of a delay, more rain likely overnight tonight. some of it will be heavy at times. remember that as we look toward the next couple days, it looks like our temperatures will be on the rebound. high temperature around 80 degrees. any sunshine will lead to a better chance of showers and thunderstorms too. some of those storms could be severe even east of i-95. >> so even if we see this tomorrow it will be a sign of impending doom? is that what you're saying? >> got it. last sunday a german television station aired some video that's fast becoming an international sensation. the video shows a group of chimps being -- seeing sunlight for the very first time. their very first cautious steps outside. for 30 years, these chimps were locked up in cages inside laboratory facilities where they were used for medical testing. when the company was sold the chimps were taken to a farm. their keepers found it was not easy to introduce them to nature. when they were shown patches of grass, for example they would repeatedly throw them away. but it all did seem to click once they got their first taste of the outdoors. it is delightful to see that. it's also kind of sad. >> yeah. >>
