Tonight a family looking for justice in the death of 28 year old Ryan Bolinger is suing jack local fives kattey ortiz is here with the latest in tonights big story, kattey . Kattey Police Released this dashcam video of the june 9th shooting last month. Despite its release and the officers clearance of any wrongdoing by a grand jury and the police chief. His family says it was a wrongful death. Were pursuing Constitutional Rights that were violated. A lawsuit filed wednesday alleges des moines senior Police Officer Vanessa Miller was negligent when she shot and killed Ryan Bolinger after a bizarre lowspeed chase in june. The major issue that the jury is going to have to determine was whether ryans right to live and be arrested by lesser means was outweighed by the officers right to fire her weapon under those circumstances. Dashcam footage shows bolinger pulling up next to an officer conducting a traffic stop. After bolinger gets out of his car and acts erratically in the middle of the road, he takes off. Officer miller joins the chase. Later. Bollinger pulls a uturn and is blocked in by both squad cars. He gets out and runs nats she pulls the trigger. The attorney for bolingers family says there are a number of Different Things officer miller couldve done instead in the amount of time it took her to withdraw her gun, point it aim it and shoot it, one would think you could easily put the car in reverse and back away. An internal review within the Police Department found millers actions were justified and she did what any reasonable person would do. Beattie alleges the department hasnt been transparent throughout the investigation, especially now that the internal review process is over. We wanted witness statements, we wanted investiagtion reports, we still dont have the police report. I soon came to the conclusion that filing the lawsuit was the quickest way to get that evidence. Kattey beattie adds it wasnt a surprise officer miller was cleared. And while no amount of money can bring bolinger back. He says Justice Needs to be served in the interest of all iowans. The private College Offers Financial Aid and scholarships, but this year, spanish major erie french has to pay for college on his own. I talked to my mom about it. I told her mom, were going to have to come up with some money for the first time. She just urged gods brought you this far, hes not going to abandon you now. French attended high school in southern california. He says he didnt consider coe, until he was offered a diversity leadership scholarship for four years. When french needed a fifth year, his scholarship ran out. Just trying to find a way do what i have to do to make sure i finished what i started five years ago. At the start of this semester, french enrolled in a work study program, and found another job working for cedar rapids day school. He says during the job search he fell behind on tuition payments. French says he wont be able to sign up for his final semester, if he cant pay off tuition by november 17th. So he decided to start a gofundme page. Right now, curtis small is the new city councilman at large with 161 votes, while Dennis Williams got 160 votes. Final results will be announced next tuesday.
