Thought the suspect could be phillips. He was staying with his mom, who lives down the street from the victims. Police say phillips own parents came forward, saying they believe he was capable of doing Something Like this. They said he suffers from ptsd and hes currently a reservist in the military. His father told Police Phillips has had recent severe anger issues. This is a very scary situation. You have somebody who the victims dont know, goes right in their house and attacks them in the comfort of their own home. And theres probably nothing more scary than that. Two small children. The victims were fighting to survive. And this guy got after that and got up and left. Friends and neighbors tonight tell us the victims got out of the hospital, they went back to the house, got everything they own, and moved back to ohio yesterday. Live in volusia county, kelly joyce, fox 35 news. Officer William Anderson cleared after firing his gun while being run over, not far from universal studios. Speeding on south kirkman last july. The passenger bailed. The driver thin hit the gas, running over officer anderson. The state attorney ruled anderson was in fear for his life when he opened fire. Bob the state attorney also deciding that he will not file criminal charges after this springs. A father and baby were killed in october. The driver slammed into the cars in front of her at a red light. 35yearold jose and his 1yearold son were killed. The childs mother suffered a traumatic brain injury. The state attorney revealing the elderly driver had no drugs or alcohol in her system. And is at most guilty of careless driving. A fox followup now after a dramatic standoff in melbourne. Hundreds of shots fired between the suspect and police before the takedown. Fox 35s derrol nail is live in Brevard County to explain how it reporter good evening. It all began last night when police were called by two relatives of 47yearold Michael Taylor who were inside this condominium here in melbourne called garden coves. It deteriorated significantly from there, into a an allout gunfight between police and a former army veteran each of the windows in 47yearold taylors condominium were shot out while outside an entire row of car windows were shattered. This is just some of the damage from what police say was a 12hour gun battle with an estimated 500 rounds exchanged. Between a 47yearold army veteran and close to 50 officers. It seemed like it was almost like the army versus one man. John and his girlfriend sheltered the entire time inside their condo just five units away, as bullets flew. You could feel the vibrations of them shooting back, like on our floor. Night around 11 14 with a domestic call. Pans with food scattered on the asphalt. The shooter allegedly angry about how his dinner was prepared. When police arrived, the gunfire began despite efforts to coax him out. All of a sudden it was just unloaded and you could feel the vibrations, like were talking you never know whats coming at you. Right around 10 00 a. M. Sheriff wayne ivey, whose deputies were also involved in the shootout, chose a different course, bringing in a longterm veterans advocate, george taylor, to talk to the shooter soldier to soldier. His whole mood just kind of relaxed and he was more receptive. It worked. After 12 hours, the combat veteran put down his weapons and gave himself up to police, still wearing an army helmet at the time. Amazingly, no one was hurt. We are extremely glad and injured in this situation. Taylors relatives were taken by the red cross to a nearby shelter. Meanwhile, residents who were evacuated during all this have since returned. As far as the shooters concerned, taylor himself, hes facing 23 counts of attempted murder on a Law Enforcement officer. In melbourne, derrol nail, fox 35 news. Bob Orange County sheriffs investigating a possible grenade at the 7eleven on conway road, morning. A man collecting scrap found a box with that item inside, drove to the nearby 7eleven and called deputies. The intersection had to be shut down for hours. Orange county says it looks like a grenade but theyre still trying to figure out exactly what it is. Investigating what they call a suspicious shooting death of a former corrections officer, dead in front of his house late last night in ocala. This is a photo from the scene. He was employed with Marion County from 2007 to 2014. If you know anything, please call police as soon as possible. Bob an accused killer is in court today, was in court. His former his mother in law, former motherinlaw, ran out of the room crying when his statements to police about seeing his stepchildren dead inside the home came up in court. He was accused of killing he denies killing the children but says he killed the woman in selfdefense. The trial starts january 19th january 19th in saint august team. 40 of kids set to fail, sounds like a scary number but its actually better than many had feared. It all has to do with the new tests given in Public Schools. And fox 35s dana jay joins us now live to explain. Good evening, dana. Yesterday the state board of education took a couple of votes on how students, schools, and on the new florida standards assessment or fsa. Based on the responses of local school districts, the results of those votes werent quite as bad as they could have been. The florida standards assessment exam that Public School students took last year was meant to be tougher because it tests kids on tougher curriculum, aimed at better preparing them for jobs and college. There were some who believed the system used for scoring the test should make it really hard for kids to get a passing grade on the fsa. There were a few different thought processes out there. One was to raise the bar really, really high and make it very difficult for students to be proficient. The fear among Public Education officials, like superintendent griffin, was that the bar would be set unreasonably high and set up a huge number of kids to fail the fsa in the first year. So when the state board of a system where about 40 of kids are projected to fail, it was something of a relief for school districts. I think the commissioner still raised the bar, but hit an area where its achievable for us. The new benchmark still means more kids will fail this year than last year. Statewide, its a little bit higher and a little bit more rigorous than last year. And the state board of education also voted on a formula for assigning school grades. The fear again was that many more schools would get ds or fast this year compared to last year. It doesnt appear that that will be the case. It seems kind of backwards in a sense that the tests would be set up so a certain percentage of kids will pass and a certain percentage will fail. Why not just test students on what they should be learning and see how they do . Well, thats a really good question that sort of gets to the heart of the objection that a lot of people have with the fsa exam. I will tell you that setting system for scoring is meant to allow you to compare how your child is doing compared to how other children are doing, how proficient they are, but, really, a lot of people think this should be black and white and we should be able to say either yes, my student knows the standard that theyre being tested on or no, they dont. The compact that was proposed more of a change to the existing compact, does not become valid unless ratified by the legislature. And the new deal means big changes, more casinos, plus for the first time craps and roulette. It is an expansion to the stint that it authorizes without violating the exclusivity of the tribe, two new permits, one in palm beach, one in dade county. Just like i said earlier, why would you ever say, you must continue to run the track to keep the casino licensed. But the gambling has lots of questions that could shut the deal down, like how could miami and palm beach get new casinos and brevard not . The economy is saying, yeah, were going to have continued growth, its not going to be robust but it wont be as anemic as years past but well be moving forward. Absolutely. So, youve got a recession in the Manufacturing Industry already. You have very depressed holiday sales so the Consumer Sector is shaky, too. We know overall growth is about 2 . At least its moving in the right direction. Its nothing to get excited about. But theres some serious broad pressures, headwinds on the economy that are stunting growth. And i do think in terms of earnings and let me talk about macys because theyre just doing all this costcutting, closing stores, laying off workers, but the stock is up today in this market because investors are encouraged by the fact that the company is looking at the big picture and recalibrating its Business Plan to match a slow growth environment.
