mayor is cautioning him while he's walking a fine line. >> he understands that there are to be no political activities during work hours. and i just wanted to reenforce that. as well as to reenforce that we need to focus on the job at hand. >> reporter: chris driesbach teaches ethics and sees nothing unethical about the sign. >> this adversarial relationship has been growing by leaps and bounds. and that this stuff would be coming from either side is both tragic and unsurprising. >> reporter: as for that independent investigation, the state's attorney said the mayor says that would have to be done on a federal level. and his office told miss jessamy, if she has a complaint, she should file it there. >> thank you very much, mike. the primary is september 14th. mr. bernstein announced today that he and miss jessamy will have a radio debate tomorrow. the howard county teenager greatly injured in a terrorist attack in africa is back in maryland. kai is live in the newsroom now with the latest on emily kerstetter. >> the 16-year-old is being treated at johns hopkins, where she underwent her 12th treatment today. kersteter was seriously injured at a terrorist bombing at a restaurant in uganda last month. she was doing rescue with a church group. her grandmother is back at her home in pennsylvania and is being treated there. kersteter will undergo another surgery next tuesday and still faces a long road ahead. >> her classmates have scheduled a swim to raise money for her medical care. we have more breaking news to tell you about. a car accident in northern baltimore county. sky eye chopper 13 is over the scene. and mike perry has more on this. >> reporter: we're in kingsville, baltimore county. this is bel air road, between sunshine avenue and new cut road, with a single vehicle overturned, has completeley closed southbound newport. it appears the operator of the vehicle is going to be transported to a local area hospital. they have just reopened northbound bel air road. at sunshine avenue. and as you can see, more police are allowing one lane to get by. it appears that the car blocking the road is the severe problem here. and looks like they'll start two-way traffic here, once they did k get the med -- can get the medic units out of the way here. police are on the scene, conducting their investigation. >> thank you, captain mike perry. live in sky eye chopper 13. we want to update another breaking story for you. it happened on joppa road, around towson, 4:00 this afternoon. the police car was transporting a prisoner. no word on the extent of the injuries. fatal flight. two maryland men killed in a plane crash in massachusetts. with family and friends in shock, federal investigators are now looking for a cause. wjz is live. derek valcourt has more on the victims and that investigation. derek? >> reporter: these men were very good friends. they were both certified pilots. in fact, they owned that plane together. they were heading for a vacation in maine. they never made it. >> reporter: investigators in massachusetts now trying to figure out why this small, single-engine plane crashed in a wooded area in massachusetts. on board, two ellicott city men. 52-year-old jay jaso, a financial planner and father of two, along with his good friend and fellow pilot, jack johnson. the men took off from a small airport near fort meade on their way to bangor, maine. they stopped to refuel at an airport. but moments after resuming their trip, they crashed about one mile north of the airport. neighbors saw the plane flying low. >> right over those trees. and then my husband had said -- i went, oh, my god, you know. and then my husband had said, they're not going to make it. they're going to crash. and like seconds later, we heard the crash. >> just great deal of shock. just total shock. >> reporter: george solder had breakfast with his friend, jay jaso. he recalls jaso, who loves the outdoors, was looking forward to a vacation in maine. he can't imagine what went wrong with the crash. >> jay was in the plane with jack. and jack was an accomplished pilot. so i think between the two of them, it certainly was probably nothing to do with their piloting skills. >> reporter: weather may have been a factor in the crash. the national transportation safety board is investigating, while friends and family here in maryland mourn. >> i just can't express the loss. it is to the family. and to me personally. and i'm sure many people that knew jay that consider him as a friend. >> reporter: weather forecasts indicate there may have been thunderstorms in the area at the time. derek valcourt, wjz eyewitness news. >> all right. thank you very much, derek. and wjz was not able to reach the family of jack johnson, the other pilot who was on board at the time. problems for commuters, heading home on the light rail. the train struck a car downtown on howard street in front of capten yards. camden yards. there were no serious injuries, but the accident is causing serious delays. sex assault charges against four current and former morgan state students are dropped. now, one of their defense attorneys is calling for new charges against the accuser. wjz is live. adam may has more on this legal turn of events. >> all four were held without bail for almost 30 days in jail. now, they have been cleared of any wrongdoing being released from jail. four current and former members of the morgan state band accused of sexually assaulting a band mate next month. people who live next door to the apartment, where it allegedly happened were stunned. >> i never hear any screaming. or, you know, somebody said "rape" or anything like that, no. >> now, the charges have been dropped. because of what the spokesman describes as conflicting evidence. >> there are varying accounts of what happened, who did what. >> reporter: dale lawton's attorney tells wjz, he can prove the sex was consensual, claiming the accused sent text messages, arranging the group encounter. >> this may be something that can follow you for the rest of your life. >> not only dot falsely accuse -- do the falsely accused have this to face. but three were assaulted tuesday night in jail, right before they were supposed to head to court to have the charges dropped. >> they were being called rapists as they were being attacked. >> what do you think should happen next? >> the young lady who made the accusations who changed the story, she needs to be prosecuted. that's the way you keep this from happening in the future. >> reporter: but prosecutors defend the initial investigation. >> there is definitely probable cause here to go ahead and charge this case. so the answer to that question would be no. >> reporter: and tonight, the defense attorney says he is considering suing the state department of corrections for failing to protect his client behind bars. >> two of the men taken to the hospital after the assault, have now been released. well, another day with uncomfortable temperatures in the mid-90s. live look outside now. be sure, bob says, to stay hydrated, if you're going out. we're live with first warning weather coverage. bob will update for us. >> temperatures are slowly, slowly dropping as we head toward evening. take a look at the evening. still, most places above 90. 93 here. ocean city, 81. the dew point has come up from earlier this afternoon. up to 65 now. and when you combine the temperature of 93, the dew point at 65, it feels like 95. 88, ocean city. 95 is the way it feels in hagerstown. and 98 in washington. and 99 still over in easton. we do have shower and thundershower activity, not too far away from the maryland region. portions of west virginia, virginia, getting pretty good shower activity. we have a chance, better chance tomorrow afternoon, of getting some of those relief, cooling showers, along with cooler temperatures the next few days. we'll have those numbers coming up. >> with no relief from the heat, a battle is brewing over funding to keep the city's pools open. donations have rolled in, meaning some will remain open. but others will remain closed. as weijia jiang explains, it is now becoming a political issue at city hall. >> despite all of the recent donations, several remain closed. and the mayor says, the money to reopen them is simply not in the budget. >> they approved a monumental budget in june, it included funding for a six-week pool season that ended on sunday, august 8th. now, the council president is calling for a special session on friday, demanding cash from the city's rainy day fund to extend the season. claiming it was not clear to him the pools would actually shut down. >> i didn't know you would actually close the pools until after you did the study. i thought all of this was going to be next year. >> on wednesday, the mayor's office announced someone donated $300,000. and price donated. still, $177,000 is needed to keep 13 smaller pools open. >> reporter: but the mayor calls it fiscally irresponsible to dip into the city's rainy day funds to keep the pools open. and she said during budget discussions, none ever brought up funding. >> any of them could have come to me during budget negotiations and said, listen, this is my priority. to do it afterwards, i can't work with a moving target. >> every time that i met with the mayor, i said i want recreation and parks to be held harmless. and when i said that, i meant all of it, which includes the pool. >> anyone who says otherwise is just being untruthful. >> reporter: parents and kids are grateful for the extra pool time. >> it's a give and take. >> reporter: the mayor's office expects even more donations to come in. and a spokesperson for the council president says, if there is still a shortfall friday, he plans to hold that special section to use city cash. earlier this week, a donor gave the city $90,000 to keep the druid hill park pools open. well, the ravens' preseason opener is just over 24 hours away. and if you've been around town, you know how excited fans are getting, even talking super bowl already. wjz is live at m&t bank stadium. jessica kartalija has more on very high expectations. jessica? [ ding ] [ maltry the subway achin'steak & bacon melt.n. tender juicy steak, sizzlin' hot bacon, fresh veggies on a blanket of bubbly cheese on freshly baked bread. and when morning rolls around, the new steak and bacon muffin melt with fluffy egg, melted cheese, and, oh yeah, bacon. all on a fresh toasted english muffin. mmm. guess we should leave you lovebirds alone now. crank up the flavor at subway. mike shoe reports, the mayor presided over show and tell on the landing pad of the roof of police headquarters. the potted plant next to the police helicopter is just that. pot. reefer. dope. 34 marijuana plants came to rest on top of the city police heliport. because -- it is the fox trot helicopter unit that found the drug. no easy feat. sure, this stuff is easy to identify at arm's length. but you see what it looks like at 500 feed. this is video shot from fox trot. amidst all of this green. try to find the marijuana. it's green, too. but a slightly different shade. see it there? it's just a bit darker. >> not easy to detect. but once you see it the first time, you can take it out pretty readily. >> those are fox trot guys down there in the weeds. >> city police say these are not the only plants that the helicopter has found this year. >> they've spotted weed growing in cherry hill. curtis bay, near morgan state. and twice now at lincoln park. >> i want to thank them for going above and beyond. they're not just responding to calls. but they're also, while they're up there, making sure that we're getting the best bang for our buck. >> reporter: the mayor not only patted the grew on -- crew on the back. but her administration, too. during the budget crisis, the mayor threatened to close these off. >> because of these actions, the fox trot is still airborne. fighting crimes, drugs, and violence, and assisting our police officers on the ground, every single day. >> we are very happy to still be back up in the air, serving baltimore city. and our air crews are making sure they spend every minute in the air, doing something productive. >> at the heliport, mike schuh, wjz eyewitness news. >> and we were told that that marijuana will be added to other seizures and will be burned in the city's incinerator. also tonight, baltimore city police make a drug bust, stopping a drug operation, right being run out of a car wash. officers say they found a number of guns, cocaine, and heroin, and thousands of dollars in cash. several suspects were taken into custody, including the owners of celebrities car wash, along with employees and a suspected drug find. the race to the top program may be under the radar for a lot of people. but not for states competing for billions of federal education grants. maryland is one of 19 that has made the preliminary cut. in tonight's school watch report, alex demetrick reports, today, it made a pitch to be a finalist. >> all the stripes are different colors. >> reporter: whether it's the beginning years of education, or college level classes at high school, getting more students to perform at higher levels is the goal of the obama administration's race to the top program. and it is putting $4 billion in grants to support it. only 19 states have met the requirements. not all will win. >> there's florida. [ laughter ] >> we're much better than you guys. very competitive. >> we felt we had a very strong presentation today for race to the top. i think, as many of you are aware, that could mean about $700 million to florida. >> did maybe $250 million for maryland, which brought up teams in washington to make a final pitch to the department of education. our sales pitch is maryland has a long history of success. we've had many, many national recognitions. those continue. and therefore, investing in maryland is a great idea. >> reporter: but if plans to improve with states that spend a lot of time outlining behind closed doors, with race to the top administrators. >> reporter: strides being made at prince george's. strides at baltimore city. increased number of children taking ap courses. i mean, all of those things had to have impressed this panel. >> reporter: one of maryland's biggest strength may be its small size. >> there are only 24 jurisdictions in the state of maryland. we are able to come together, share best practices. >> reporter: but in return for the money, test scores, and teacher accountability must meet federal standards. a big string for those racing for the grants. >> it's expected only 10 of the 19 states will become finalists. the winners will be announced next month. >> and florida, we're coming for you. winning weather headed our way. cooling cooler and dryer air appears. and that is pressing slowly to the south and southwest. it's what we call a back door cold front. instead of coming from the northwest, it's coming from the northeast. up here in northern new england, drying out. beautiful, very pleasant weather. lower temperatures or lower humidity. south of that front. that's where all of that heat and humidity is. we have the showers popping up. out to the west, this stuff over michigan, looks like it wants to head down to the south and southeast. tomorrow, we have a pretty good shot. we'll have scattered showers and thundershowers. look at all of the rain to the south. that's going to stay there for now. but we have cooler conditions. temperatures tomorrow, only in the mid-80s. and risk of scattered showers begin deadly plane crash in a remote part of lass lass that killed -- alaska that killed five people, including former senator ted stevens. joel brown reports for wjz, from washington, with the latest on the crash and the survivors. >> reporter: medics and crash investigators had a tough time reaching the remote alaskan mountain side, where a small plane crashed, killing five. among the dead, former senator ted stevens. he and eight others took off in a light rain, around 3:00 monday, from a lodge on lake mirka. they were heading to another fishing camp three miles away. visibility was approximate three miles. they crashed near gillingham, about 325 miles southwest of anchorage. >> we really have very little information to go on right now. so until we gather that information, we're going to be looking at everything. >> reporter: federal investigators will also be talking to the four survivors, include former nasa head, sean o'keefe and his son. the weather was so bad, they had to spend the night in the wreckage, alongside the five dead bodies. >> reporter: stevens was the senate's longest-serving republican. senators plan to honor him thursday when they return to capitol hill. >> stevens' senate career ended in scandal, after he was found guilty on corruption charges. the case was later thrown out, but not before he had lost his seat. in a statement, his family said he loved alaska with all his heart. his legacy is the 49th star on the american flag. >> i will never stop fighting for the people of alaska. >> reporter: he represented his state for over 40 years. joel brown, wjz eyewitness news. >> reporter: tonight, former nasa chief, sean o'keefe is in critical condition. and his 13-year-old son is in serious condition. the flight attendant who allegedly cursed out a passenger and quit his job on a packed flight is out of jail and talking. 38-year-old steven slater faces a number of charges for his actions. but he is becoming an internet sensation for the same reason. slater posted bail last night in new york. monday, he became frustrated with a female passenger, cursed her out on the intercomsystem, grabbed two beers and used an emergency slide to get off the plane. he spoke after being released late last night. >> it seems like something here has resonated with a few people. and that's kind of neat. >> are you going to lose your job? >> more than likely. >> reporter: do you care about that anymore? >> no. >> tell me about -- >> no comment at this time. >> slater is charged with criminal mischief. reckless endangerment and pres passing. counts that could get him up to seven year in prison if convicted. tuesday, more than 20,000 people signed up on facebook in support of slater. a race against time to find a possible serial killer before he strikes again. the suspect who viciously stabs his victims appears to be targeting african americans. he has struck in several states, including nearby virginia. police are on the hunt for this man. believed to be a serial killer, responsible for 20 attacks in three states. five of them deadly. >> i would consider this man to be very desperate, and very dangerous. >> reporter: the most recent case happened saturday, outside a church in toledo. >> toledo, 911. >> hi. i have a man who is bleeding. i'm not sure if he's stabbed, shot. >> the victim, anthony leno, survived. >> walked to the car to give him directions. at that point, he was stabbed. >> reporter: earlier this week, police say the attacker struck three different times in the northern virginia town of leesburg. a 15-year-old boy stabbed near a gas station. a 67-year-old man attacked with a knife, while sitting on the steps of an apartment building. and a man hit in the head with a hammer. all three are minorities. all survived. >> we became convinced early saturday, and into sunday, that we were dealing with a race- based crime. >> reporter: the killing spree began in flint, michigan, where police believe one attacker has stabbed 16 men since may. of the five victims who died, all were african american. authorities in michigan are now taking a close look at similarities among all the cases. the suspect descriptions seem to match. a white man with a muscular build, often wearing a baseball cap. so, too, does the description of the vehicle, captured on surveillance video in virginia. believed to be a dark green chevy blazer, with tan paneling on bottom. critical crews police hope will help stop a serial killer. elaine kehano, cbs news, new york. >> many of the attacks happened early in the morning between midnight and 6:00 a.m. several children injured in a day care crash. pictures from the scene in glendale. the suv overturned. and the driver was trapped until firefighters freed him. has injuries are nonlife threatening. the children range in age from 6 to 11 years old. governor martin o'malley's re-election campaign. in all, it reports that it has more than $6.7 million in the bank. republican challenger robert ehrlich, who is running in a rematch against o'malley has not yet disclosed how much he has on hand for this race. time now for a quick look at some of the stories habitat for small sea life. larger fish will congregate below. >> what this material does is it has a lot of little spaces inside of it. >> reporter: the aquarium placed more than a dozen of these inside to see would happen. they were filled with mussels, aquatic worms and microorganisms. >> people don't think there is a lot of animals in the inner harror. but -- harbor. but there really are. early ther week, the -- earlier this week, the waterfront project launched a similar project just a week away. his goal, to make the harbor swimmable and fishable by 2020. >> it's a lot of work. >> do
