Just hours ago, a federal Appeals Court rejecting the administrations request to restore the travel ban. Just so everyone is up to speed. This all started nine days ago, when President Trump signed the executive order temporarily banning all refugees plus visitors from seven majority muslim countries. It set off protests at the airport and a flurry of legal challenges. On friday, a judge blocked parts of the travel ban. Last night, the Trump Administration appealed that decision and asked for the restraining order to be lifted. Early this morning, an Appeals Court rejected that request. So many questions. So many angles here. We have team coverage. We start with david wright with the president in palm beach, florida. David, good morning to you. Reporter good morning, dan and paula. It was a in federal Appeals Court overnight. At this point, the case is likely to go all the way to the u. S. Supreme court. Its worth noting that the legal battle over the travel ban is likely to drag out longer than the ban itself would have. Overnight, a major setback for the Trump Administration. No sooner did the department of justice appeal its case to the ninth circuit, but hours later, motion denied. The federal Appeals Court rejected the governments bid to immediately restore the travel ban. Youre People United reporter outside maralago, protesters made sure they could be heard. Keep moving reporter inside maralago, President Trump insisted hes confident hell prevail. His bid to keep out refugees and visitors from seven predominantly muslim countries. For the safety of the country reporter all day long, he went on a tirade. Attacking the seattle judge who dared to defy him. My question there been terrorist attacks in the United States by refugees or other immigrants from the seven countries listed . Not since 9 11. Reporter trumps tweets came fast and furious. The opinion of this socalled judge is ridiculous and will be overturned. Many very bad and dangerous people may be pouring into our country. A terrible decision. And, the judge opens up our country to potential terrorists and others that do not have our best interests at heart. Bad people are very happy. Even as the appeals process continues, at home and abroad, the protests show no signs of letting up. Meanwhile, trumps answer to bill oreilly in an interview set to air before the super bowl is raising eyebrows, as well. Do you respect putin . I do respect him. Do you . Why . The administration essentially accuses the judge of violating the separation of powers. Trying to usurp the president s authority. And the democrats kind of accuse the president of the same thing. Saying hes trying to bully the judiciary. Theyre threatening to make this part of the confirmation battle over Donald Trumps Supreme Court pick. A lot more at stake than just in policy. David wright, thank you. The question of a constitutional crisis was addressed in an interview between George Stephanopoulos and the Vice President , mike pence. George asked the Vice President pointedly about his tweet, referring to the judge who issued the temporary restraining order as a quote socalled judge. This is a judge who was nominated by president bush. 990. Confirmed. How is he a socalled judge . Well, again, theres simply no question under the constitution and frankly under federal law that the president of the United States has the authority, in the interest of national security, to determine who has the right to come into this country. And were going to challenge the judges order on that basis. Because the reality is, we face a dangerous enemy. And the president is determined to use the authority that he has under the constitution and under the law. But were doesnt this judge have the authority to do what he did as well . He certainly does. Thats why the administration is complying with that order as we speak. George is with us now. George, good morning. Pence did not seem to want to go there on this socalled judge issue. Dont these comments undermine the judiciary in some way . Well, thats the point the democrats are making. Youre likely to see opponents bring this up in court when they meet again tomorrow. But the Vice President has been put in a pretty tough spot there. He says, the president speaks his mind, thats okay. He didnt like having to go there during that interview. This is going to be interesting to see what happens tomorrow when they finally have the arguments in court and we see whether or not the ban is actually going to be upheld. As david said, the democrats led by chuck shumer in the senate, are already saying this is going to impact the questioning of judge neil gorsuch as he tries to become a justice. Setting up quite a battle. Lets go up to the comment about russia in that interview. Trump said, quote, weve got a lot of killers. What, you think our countrys side is so innocent . The campaign. Even when presented with the evidence about putins crackdown on the press and his opponents in russia, which has included killing at times. So this is really something right there for the president to do that. And i have to say. A very different line from what the Vice President took in my interview where he said russia is now on notice, that were watching russia very closely. So you see some dissonance there between the Vice President s words and the administrations actions right now. What if president obama had said Something Like that . How do you think the republicans would have reacted . I think you can imagine. They would be saying exactly what the democrats are saying right now. That its unbelievable that the president is equating russia with the United States. Remember, president obama was criticized several times for going on a socalled apology tour for the United States where he talked about mistakes of the United States in the past. Had he done Something Like that, i think you would see him getting harshly criticized. What about the current pace of news from the white house . Were dealing with an onslaught of news. How long can that be maintained . Is it in the best interests of the white house . Can you believe its only been two weeks. Its been their strategy. Their strategy. They wanted to show two weeks of action where the president is keeping his promises. A lot of supporters would say thats what hes done. E interview with vice est of president mike pence. He was visiting his fiance in turkey when the travel ban went into place. I couldnt stay. I was afraid for my future. I feel that hes racist. Reporter this doctor is in the middle of his residency. His wife, a syrian citizen. They told her while she was on the plane that her visa would be canceled. She was terrified. Reporter her visa cancelled. Hen she landed in d. C. Turned around, sent back. She spoke with us from syria. I really hope that everything is okay. We dont have a decision yet that will completely strike the executive order. Reporter but for this man and his family, given visas because he risked his life for the u. S. Government, the trip originally filled with frustration. I dont know what to do. Reporter also turned around a week ago. Finally, on their way to the u. S. Im happy to announce that we have been cleared to travel to the United States. Reporter and most airlines are now operating as if this travel ban never existed. Allowing anyone with a valid visa or green card to make the trip to the u. S. Guys . Thank you, eva. For the families or individuals trying to come or worried about if they leave, whether they can come back, how much of a window are we looking at . Theres going to be an expedited schedule. There are briefs due today and tomorrow. They could rule as early as monday afternoon. So the window could close then. If it does, it will be the same question we faced last weekend. A lot of people were intransit when the executive order first came down. So there will be a lot of questions about their status. Without peeling back all the layers and getting too wonky in legal speak, what do you think the next steps of administration are going to be . There will be briefed filed today and tomorrow. The ninth circuit could rule as soon as monday. Depending on who loses, that case could go to the Supreme Court quite quickly. It could be monday. It could be later in the week. I think this will all develop at a fast pace in the next couple of days. If this goes to the Supreme Court there are only eight justices right now. What kind of impact could this have for the nomination of neil gorsuch . Who President Trump wants to it drives home the stakes of who fills the ninth seat. There may be a desire to expedite the confirmation hearings. They were more likely to happen in march. You could see them try to push those to february, in order the try to get him into place sooner rather than later. There will be a lot of questions about president ial power and Judicial Independence that i imagine will arise at the hearings. And last question for you, considering this is so back and forthright now is there a possibility that well see some of those scenes play out at the airport again . The scenes we saw of the detainees . Last weekend, if you remember, was total chaos. It didnt seem as the same ruling were being applied anywhere. The Vice President made quite clear that the court had the authority to rule the way it did. And we have seen the department of Homeland Security and state department take steps quickly to implement the courts order. I dont think well see the chaos we saw last weekend. In southern california, one hiker is dead and four others injured after falling down an ice chute. In Angeles National forest on saturday. A helicopter hoisting the injured hikers to safety. Clearing them of accusations of mistreating a dog during the filming. The American Humane Organization releasing the results of an independent inquiry saying no animals were harmed. Initially authorities believed that susan winters killed herself. Now they say theres new evidence pointing to her husband, including a possible motive as to why he may have wanted her dead. This morning, las vegas psychologist brent dennis is behind bars, charged with murdering his wife. A stunning reversal in a case initially ruled a suicide. After attorney susan winters 2015 death, the coroner issued a report that says she used antifreeze and prescription drugs to commit suicide. The winters family hired a private investigator, who released a 49page report that led to dennis arrest last week. The winters family never was able to believe that their daughter would be reaching a point where she would be wanting to end her own life. Reporter following up on the lice in henderson, nevada, ings, reopened the case late last year. Detectives uncovering what they claim was a motive. In this arrest report, accusing dennis of having a cocaine habit that was draining the familys finances. Police saturday police adding that after winters death, dennis walked away with over 1 million in life insurance. Dennis, whose attorney saying he plans to plead not guilty to the murder charge, denying allegations that his wife threatened to expose his drug use. She said she was going to turn you in for using drugs. Fair . I dont have any recollection of that. What statements did she use when she threatened to discuss your drug use with the board that supervises you . Honestly, i dont recall any threat of that nature. Reporter according to investigators, dennis did multiple unsettling google searches. Including an alleged admission from dennis that just before his wife died, he researched how the kill yourself using antifreeze. Police say its still unclear how the substances that killed winters were introduced into her body. Dennis is expected in Court Tomorrow morning.
