Court case that made headlines all across the country. 7 on your side iteam was the first to tell you about a district man banned from smoking in his own house after being sued by his neighbors. Now it seems that the legal battle is over. Investigator joce sterman joining us now to explain how this has come to an end. Joce edwin gray and his sister have been fighting an attorney who moved in next door for months arguing whether smoke in their house was impacting their neighbor. They got piles and piles of court filing because they represented themselves. Today, though, the family is claiming victory with one piece of paper that says, case dismissed. If they have done this, who will be next . What other neighbor will be next . Joce Mozella Johnson was outraged when a d. C. Judge banned her family from smoking in their own home last march. The decision was part of a civil lawsuit first reported by 7 on your side and brought by the family that moved in next door to their home in northeast d. C. The family claimed that edwin grays habit was sending smoke into their home through the hole in the basement and they sued him. The judge banned gray and his family from lighting up as the case worked its way through the courts. But now gray and johnson say their lives are going back to normal after seeing this. Prosecutors say the footage shows Charles Severance following Nancy Dunning before he killed her. Northern Virginia Bureau chief Jeff Goldberg was in the courtroom. He join us live from fairfax with the video that was shown in court today. Jeff . Jeff going into the trial, we knew the prosecution was going to be presenting this video as a major piece of circumstantial evidence connecting Charles Severance to the murder of Nancy Dunning. We saw that video today in the courtroom. While it was playing it did seem like everyone was intently watching the tv screens except for Charles Severance who was staring straight ahead. The question facing jurors today was this man in a dark jacket and jeans, carles severance . The prosecutors say yes. The Surveillance Video shown to jurors in realtime and in slow motion is from inside the target at potomac yard in alexandria on the morning of december 5, 2003. Nancy dunning went shopping at the store shortly before she was shot and killed at her home, fiveminute drive away. You see the man on his cell phone enter the store about ten feet behind dunning. Then kneel down to tie his shoe before heading in dunnings direction. The next video shows the man following dunning out of the store. She with a full shopping cart. He carrying nothing. Prosecutors alleged severance was tracking dunning at target and then followed her home and committed the murder. To try and further their case, prosecutors showed jurors sidebyside photos of the man at target and known photo of severance in 2003. Also today, testimony from dr. Rivercone, the medical examiner who performed the autopsy on Nancy Dunning. She said dunning died from three gunshot wounds. The doctor found black suit on dunnings skin and clothing indicating that the barrel of the gun was quite close when out fired. Likely well under a feet, under two inches. The medical examiner also testifying that after mark dunakin was after Nancy Dunning was shot she was likely alive for a few more minutes. The defense is surely to pick apart the Surveillance Video and argue its not Charles Severance in the footage. The shots rang out 24 hours ago in an alley between Montgomery Village plaza and Montgomery Village crossing. Mike carterconneen is live to tell us what we know so far. Mike . Mike maureen, late today, Montgomery County Police Confirmed the early reporting that the victim of the crime was a transgendered woman, 21yearold zella ziona. Initially investigators released her pretransition name, Deandre Smith. Her friends who created the memorial here said she started her gender transition recently and they suspect that is why she was killed. One bullet has left so many people hurt and broken.
