And records show 30yearold Tyrone Howard had multiple warrants out for his arrest at time he allegedly shot officer randolph holder in the forehead and killed him. My grief will always be here. Reporter question many including officer holders own grieving father is now asking, why was howard not in jail . I do not think that a criminal should be put back on the street after being arrested for, you know, certain crimes. Reporter cbs 2 news has learned that howards arrest in connection with a 2009 shooting injured a 11yearold and 70 yearold was sealed. He was granted youthful offender status even though he was 24. Court transcripts show that when howard was arrested in the fall of 2014, the District Attorney could not legally mention it so the judge didnt know about it. The judge agreed to howards Defense Attorneys plea for drug rehab because howard came from a family of addicts and deserved a chance. The alternate or the default should not be, lets keep them on the street and maybe by a miracle from god, he will do better there. Reporter a law professor says even without knowing from the gun case, the judge should have sent him to jail since he had four felony drug convictions and said howard got a deferred twoyear sentence to go to a rehab program. And now Tyrone Howard is right now being held without bail. Meanwhile, here outside of the station house where officer holder worked, you can see this memorial continues to grow in his honor. And now to a developing story, a former new york city Police Officer is under arrest on murder charges and is being treated at a hospital after jumping in front of a subway train. Scott rapoport has the story from midland park. Reporter the victim, a 48 yearold susan bardsel, a mother of two teenage son, stabbed to death in her car in front of her own home. Authorities say by her estranged boyfriend, a former nypd Police Officer whom she just recently filed a restraining order against. It happened thursday in midland park. Authorities say he confronted her in the driveway, broke her left window and attacked her with a large machetetype knife, striking her several time. The murder weapon was left inside the vehicle. Reporter were told she had dated him for three years after meeting online but took out a restraining order against him on october 5th. While there is evidence of a history of Domestic Violence between the victim and the assailant, it appears that she did not notify police and did not file complaints with the Police Department up until just recently. Reporter Authorities Say following the gruesome attack, front of a subway train in manhattan, suffering head and leg injuries and undergoing surgery at harlem hospital. A tragic elevator accident in brooklyn this month is making life miserable for some elderly and disabled residents in manhattan. Cbs 2 news is demanding answers after a viewer in harlem reached out to us. Reporter back on october trying to escape an elevator that suddenly dropped. After the accident, the Buildings Department ordered inspections for every elevator system of the same make because of the possible defect. And until they pass key tests, they are off limits. This elevator on east 131st street failed and will likely mean a major repair. And that means trekking up and down steep stairs for residents. I am disabled. Reporter she didnt live here to she didnt move here to live in a sixfloor walkup. Its like being in a jail. Reporter her neighbors have a baby. You have a 1yearold in a stroller. Yeah, every day, i have to carry all that stuff and then buy awe new bed for the baby, i have to carry all the way from the first floor to sixth floor. Reporter on the fifth floor, she is 86 terrible going up and down. Reporter resident thes keep calling Lott Community Development who manages the everybody is pushing it off to another person. The victim, a 48yearold susan bardsal of midland park, a mother of two the teenaged sons, stabbed to death in front of her own home, Authorities Say by her estranged boyfriend, a former nypd Police Officer whom she just recently filed a restraining order against. It happened thursday in midland park. Authorities say he confronted her in the driveway, broke her left window and attacked her with a large machetetype of knife, striking her several times. The murder weapon was left inside the vehicle. Reporter we are told she dated him three years after meeting online but took out a restraining order against him on october 5th. While there is evidence of a history of Domestic Violence between the two, it appears that she did not notify police and did not come in and file complaints with the Police Department up until just recently. Reporter Authorities Say late last night, he jumped in front of a subway train in manhattan, suffering head and leg injuries and undergoing surgery at harlem hospital. The victim, a 48yearold of midland park, a mother of two teenaged sons, stabbed to death with a machete in her car in front of her own home. Authorities say by her nypd officer whom she just recently filed a retraining order against. It happened thursday in midland park. Authorities say he confronted her in the driveway, broke her left window and then attacked her with a very large machete type of knife, striking her several times. The murder weapon was left inside the vehicle. Reporter were told she had dated him for three years after meeting online. But took out a restraining order against him on october 5th. While there is evidence of a history of Domestic Violence between the victim and the assailant, it peers she did not notify police and did not file complaints with the Police Department up until just recently. Reporter Authorities Say following the gruesome attack late last night, he jumped in front of a subway train in manhattan, suffering head and leg injuries and undergoing he now faces charges of murder and violating a restraining order. Reporter you know, these past few days have been extremely emotional and heart wedging for the family of officer holder and his Police Family here as well that worked at this Police Station with him. But they are also angry, demanding to know why his accused killer was on the street. Hes a career criminal with nearly two dozen arrests dating back to when he was 13 years old. And records show 30yearold Tyrone Howard had multiple warrants out for his arrest at the time he allegedly shot officer randolph holder in the forehead and killed him. My grief will always be here. It never goes away. Reporter the question many including officer holders own grieving father is now asking, i do not think that a criminal should be put back on the street after being arrested for a certain amount of times. Reporter cbs 2 news has learned that howards arrest in connection with a 2009 shooting that injured an 11yearold and 78yearold was sealed, sources telling cbs 2 news he was granted youthful offender status even though he was 24. Court transcripts show when howard was arrested on a drug case in the fall of 2014, the District Attorney could not legally mention it so the judge didnt know about it. The judge agreed to howards Defense Attorneys plea for drug rehab because howard came from a family of addicts and deserved a chance. The default should not be, lets keep them on the street and maybe by a more car length from god, he will do better there. The law professor says even without knowing of the gun case, the judge should have had four felony drug convictions. Instead, howard got a deferred twoyear sentence to go to a rehab program.
