That are happening outside the courthouse too. The other news of the day, a ruling that was decades in the make ruling that was decades in the making and today a judge overturned a conviction for three men for a deadly fire that they did not set. We are in down the town brooklyn with the details and reaction as well. Reporter and thats right, a fire that was in fact never set. This is the address where a woman and her five children died in a horrific fire 30 years ago. Three men were arrested and convicted for set that fire but tonight, those convictions have been thrown out. Two served just over 33 years in prison. A third man, their friend, died in prison. Prosecutors here many brooklyn admitted today that the men were innocent all along, that they had been framed by the billings drug thedealing landlord who later made a death bed retraction. Reporters that the men were also victims of the Fire Investigation itself, that marshalls declared the cause of arson based on theories of arson in the 1980s that are now widely discredited and the fire is now believed to have started accidentally. The fact that two of the men today spent 33 years in prison because they were wrongfully convicted is not what we should be about here in brooklyn. And so with took the steps today as prosecutors to do the right thing and to give them back their good name. Those years, nothing in the world could give them back, no money, no nothing. Just like i lost myself in prison. I lost 33. 5 years of my life. I went in at 30 and come out at 65. Reporter 65 years old. I asked him today that while he thought about other states that carried the Death Penalty for this kind of crime. We will give you his answer on Eyewitness News at 6 00 tonight. Channel 7 Eyewitness News. Thank you. Now to breaking news in queens where a crash injured children. The accident happened a little bit more than an hour ago at junction boulevard and 55th avenue. We are at the scene. And what can you tell us about the situation there . Reporter liz, david, this is an ugly scene and its very much an active investigation. You can see the truck is still on the scene. It has not moved. It is still spinning. The cement truck. From what we have learned, three people were hit by the truck as it was turning on to 55th avenue from junction boulevard. And as you of them were children. All three of them were taken to elmhurst hospital. But as you can imagine, the busy intersection is gridlocked. 55th avenue is closed off. So cars having to turn off. Its creating quite a scene over here as Police Continue to investigate. And i just have to tell you, upon closer inspection of this scene, getting closer to that truck, sadly you can see a pair of sneaker, one of them underneath the tire and unfortunately, you also see some blood. Again, we do not know the extent of the injuries but three people were hurt and two were children. They were taken to the hospital after they were hit by the cement truck. Also in queen, police are searching for the man behind a brutal attack on a teen as she walked to school. The 16yearold Exchange Student slashed in the face and stone. This at about 8 30. Up behind the teen and cut her twice. Now authorities plan to release a photo of the man who is described as wearing a surgical mask, hooded sweatshirt and white gloves. The victim is in the hospital in stable condition and people in the community are horrified by what they have seen. Send your children to school in the morning and you dont want to hear that they have been hurt, let alone something as vicious as being slashed. I dont even have words. This makes my heart race. I feel like really bad right now. I hope that person gets caught. Thats terrible. Police say the victim a chinese Exchange Student thats been in the country about eight months. Her brother and sister are with her at the hospital. Well police on long island today are searching for a hit andrun driver who killed a 32 yearold man last night. He is a father of three, and he was on his way to have din we are his family but to have dinner with his family but he never showed up. We are at the scene of the accident with the latest on the reporter well, liz, this is the intersection where he was struck. If you take a look, you can see the orange lines coming down. This is where we believe the suspect vehicle came down and t intersection. And police say the car that the suspect was driving had been reported stolen last week. The 32yearold was supposed to have dinner with his mother last night. She noticed that she didnt get a phone call. And thats strange because he always called everyone to make sure theyre okay. Reporter the father of three never made it to his mothers house. Someone driving this trailblazer hit his car, killing him. The driver of the trailblazer ditched the car and ran away. Im not mad. Im more upset. You know, i feel like the person that did this, they have to live with this now. Reporter er the family doesnt want the person to live with it. The family doesnt want the they want them to come forward to police. I hope youre watching this and just please, or whoever knows anything, just please contact them. And just help us find who did this. Reporter police say they do know where that trailblazer was stolen from last week but theyre not releasing that information because its part of the investigation. Police say an investigation revealed two students sprayed mace in the hallway of west Babylon High School at lunchtime on tuesday. Officials initially thought the fumes were the result of a chemical leak. 35 people were taken to the hospital for treatment. Classes resumed at the school after that. The students responsible will be punished. And the ntsb today releasing documents on the investigation into a deadly crash between a metro north train and an suv in westchester county. The wind is southeast and the pressure is steady and the high 52. So running actually nine degrees above average. And the overnight lows should be around freezing. Nos not close to the records but there could be record warmth down the road. And a quick look at the weekend outlook where it will feel like 30s on saturday. And 46 on sunday. And the next seven hours shows drizzle that tries to move in after 10 00 tonight. And meanwhile, the numbers are in the you beer 40s. Numbers in the meshes from 45 to 51. And police have released video of the man wanted for a vicious attack on a student. Investigators say the man walked up behind the 16year old Exchange Student and then slashed her in the face and in the neck. She is now recovering. The attack appears to be random. He desperately wished things would change. And a man with a you gun and a clear anger towards police ended up killing him and his partner. And now one year later, she has now found her voice and with that is carrying on her husbands legacy. Its pretty much been a roller coaster of emotion. Reporter she doesnt try to sugar coat it, is brutally first time about the sudden violent death of her husband, the nypd detective. I think we need to refocus on who Police Officers are and what it is theyre trying to do on an every day basis. They leave their homes and families behind and move forward to help everyone else and sometimes they dont get to come back home. Reporter december 20th of last year, he and his partner did not come home. The men were sitting in the patrol car in brooklyn when without warning a man pulled out a gun and assassinated the officers. He ended up committing suicide. It was just days before christmas. She tells me she was waiting for him to get home to go buy gifts when she got the call he was dead. In a split second, the man she was married to for 22 year, a religious man who was a hero to his sons, he was gone. Hope and a lot of love. And he always wanted to do something more. Reporter which is what she is now doing, launching the foundation to help foster better relations between police and she says minority neighborhoods and give back to those who have supported her through all of this. I just want to thank them all from the bottom of my heart. My family is forever eternally grateful. Police say the 15yearold girl was on a subway platform at the Barclay Center last week when a man grabbed her. The next day, she says the same man approved her again and tried to grab her one more time. And this time she snapped a photo of him and police are trying to identify him. And also new at 4 00, a store clerk in the Hudson Valley area took an intimidating took on an intimidating robber with a shotgun. Security cameras recorded the man holding up the clerk yesterday. He grabs the suspects arm as you can see. And he throws a shoe at the gunman. The clerk then chased the robber out of the store and into the parking lot. Police say the suspect made it into a car and drove away on was not hurt in that ordeal. A new video of a plane veering off a runway and into a ditch at Nashville International airport. Take a look. Passengers on the Southwest Airlines flight from houston say it was a frightening experience. You just heard, everyone get off the plane. Leave your luggage. The flight attendants told u you know, down, down, down. 133 passengers onboard and they evacuated the plane by using the emergency chute. Eight people suffered minor injuries.
