Pacheco the proposal they were comfort with that and liked the idea that consolidating easier to use some groups are very weary of changes reacted negatively and spent a lot of time responding to letters and emails when they bring up an issue ill counter that with how it is working thats why that southern is negated i would able to win over a lot of people but i im willing to meet and talk with people about them. Do you think that all of the changes may not have a lot of impact for the existing businesses. I certainly hope not were keeping controls the same for example, were pulling out uses from the other rare sales and Services Category theyll be permitted before the way they were previously a neighbor can come in and go to the supervisor and change that that allows that to heap for more finegrain controllers from the commercial districts but as it effects the existing businesses it may help future businesses i hope the code will be clear and easier to understand so a Small Business owner what get information from planning staff. Ive spent a lot of time with you aaron starr and got things done in north beach my question do you feel that consistency should take precedence over the needs of mcd. So i think that we are preserving a lot of the uniqueness so like i said the definitions were really predator indicated an article 7 and it preserves the controls in the neighborhood district so the specific controls were decides on by the community and makes each neighborhood unique are being preserved i dont think that is a trade off between consistency and between specializetion or zoning controls i guess youre not squaring won over the other. Not necessarily positive changes and each will district i mean, i reality appreciate that aaron took the time with us to acid for many, many hours to make sure that to continue to preserve what is a special district but you know, i was surprised that even though districts did not spend the time for example, we got put in our part of code a new definition about commercial manufacturing so we can allow for example, a regional aspect to come in as a different category and thought that the districts would have would have been interested so. And so secondly im trying to look at the names of the file number included in the packet that is referencing something in the code has to do with with the grocery specialist designation and im just trying to understand everything that is pertaining to that sector the liquor store and i wanted to know if something that for a grocery speciality is inside or outside what that use. Speciality grocery will no longer allow the seating to help to distinguish between limited restaurants. Thats new. Inside and outside we dont dictate seating outside but i mean on the sidewalk so the dpw handles that. Probably not we get a referral but, yeah im sorry we specialities grocery will no longer be available to have. Nancy and others have concerns there was no significant differentiation between a limited and grocery so out of conversations with the Zoning Administrator the way we made more depiction is seating at the speciality grocery that will not be limited to restaurant use so full foods a speciality. So if the chose shop wants to make cheese sandwiches or meat sandwiches can you be prepared and offsite to be eaten. Well, i guess you no seating but can stand and eat the sandwich. But full Grocery Stores is different that was a definition added a while ago. All right. Thats definition the changes proposed. Yeah. They prohibited them citywide but since 2013 upper market and haight and the Zoning District have been amended to allow the games. Right now a bakery is considered a limit restaurant that is allowed to happen and allowed to produce and sell food on site and be a bakery north beach has concern about their long term bakerries that have a connection to the italian past heritage being switched to a coffee shop and not a bakery no more so supervisor Peskin Office created a definition for the speciality Food Manufacturing to help protect those uses in north beach specifically because we didnt want to introduce new use citywide and not you know require doing outreach and sort of talking to the neighborhood groups we put it there special use district north beach has north beach and north beach sud so only applies to the north beach sud. So potentially if required. At this point well have to add it as a use in the code and add it to all neighborhood districts and so phenomenonly this speciality for all neighborhood is that what youre saying and a neighborhood will require would be possible to do it thats my question. Well have to set up an sud. No, but right now the use is permitted in every neighborhood commercial district my understanding correct me if i am wrong the reason they wanted it in north beach to protect the longstanding businesses in north beach a particular need for that district but. Let me clarify when Supervisor Scott Wiener chained the planning code for restaurants. Uhhuh. What happens was everything that was only restaurant or limited restaurant unfortunately what heaped that included therefore every bakery with limited restaurant and everything was a limited ice cream trucks was a limited truck we experienced that someone ought to say a candy shop and became a restaurant they just said were a limited restaurant so we were concerned of preserving additional businesses and making that easier for them or a new one to make that easier for them come into the district not be considered a restaurant. Well to be Clear Limited restaurant are permitted throughout the city and now the specialty informed manufacturing requires a cu so im not sure it makes that easier but makes a distinction between the two and it prevents the business from turning into a restaurant that way. The distinction didnt exist. Only in the north beach sud. It could be added to other neighborhoods. It would take another ordinance and could be added to the code. Thats part of changes were tubbing. The department went through a large exercise the consolidating the eating be institutions in 2011 but really created some large rules on how we regulated restaurants like you can serve ice cream in a cup but a toaster you can have a heating port we tried to solve for the Small Businesses can adoptive their plans and respond to the market and needs without having enforcement staff saying you need to unplug our toaster and take it out of building im not exaggerating our team did that or that ice cream has to be served in a cup but not a cone thats the noah valley ordinance called for and rather not go back that way. Commissioner dooley im continuing to attend mostly meeting with the mta representing neighborhood commercial that districts and i think were its really a positive situation i think that were bringing up a lot of issues seems to be quite a bit of agreement on what issues we need to be honing in on and continue to meet monthly for at least another 6 months and then well push back to maybe every other month but i think that is a good forum for neighborhoods needs and comments.
