Lets start with the pictures clearly undercutting the president s claim he doesnt know lev parnas. Theres a trove of photos. Give us a sense of why this is significant. Reporter so, alex, if Parnas Parnas has become a key figure in this entire ukraine scandal. He works closely with Rudy Giuliani, the president s personal attorney. If parnas and giuliani were working independently, then perhaps it wouldnt be as big of a deal but more and more evidence is pointing to the fact that President Trump is directing giuliani, or at least listening to his advice. So when the president says over and over again he doesnt know lev parnas, its a lot harder to believe, especially now that were seeing more and more pictures between or with parnas and the president. And not only between those two as well, theres a lot of pictures that have been released with parnas and people who are very close to the president , including Rudy Giuliani, including the president s children. And so, thats why parnas is such a big deal at this moment, alex. What about the timing of these photos being released . What is with that . Is it that he was holding onto them, democrats were holding onto them . Did they not have them until just now . Why now . We know he pleaded not guilty in the Southern District of new york so he decided to cooperate with House Democrats. We told Rachel Maddow in her bombshell interview earlier this week that he was rushing to make the deadline for democrats before they submitted these articles of impeachment over to the senate so that it can be included in their case against this president. And so, that is why we are now seeing these documents. He turned them over before they sent over the articles of impeachment. And, alex, we could still see more documents, democratic aides say they are getting them out as fast as they can. We dont know what percentage of documents have already been released and how much more. But we could see more throughout the coming days, alex. What about where you are, capitol hill, the impeachment epicenter there. What are the managers doing as they prepare for tuesdays historic trial . Can you walk us through what they do over the weekend and into monday before tuesday, things get under way . Reporter they are all telling us theyre spending this long weekend preparing, trying to get ready for this. A lot of them are doing that remotely right now. But tomorrow they plan to be back in washington to meet as a group. And what theyre doing is theyre going to be preparing their evidence and how theyre going to present the case against this president. So as early as today they have a deadline of filing their brief with the senate. And then the white house has their deadline as well. Their deadline comes monday. So theres a lot of work to be done. Because this is coming extremely quickly, alex. Its all going to start on tuesday. Fast and furious to say the least. Thank you so much leann. Lets go to the newly released Text Messages from the house intelligence committee. Messages sent from lev parnas to congressional candidate robert hyde and also to a devin nunes aide. Joining me now to discuss, nbc legal analyst maya wiley and cynthia oxnad. These messages were exchanged with robert hyde and devin nunes, an aide to him. They show frequent contact with parnas. So with these messages be able to be allowed as evidence in court . The short answer is we dont know, because the senators are the ones who decide what evidence will be heard. That are in addition to what the house managers are going to bring in from what was subject to the house process. Certainly, its really hard to argue that this would be a fair and impartial trial if relevant evidence was not admissible evidence. And thats because, in trials all the time, sometimes there is new information that comes to light. That, if its relevant, on point to the very thing that has to be decided by jurors and its not prejudicial, its not irrelevant, incendiary, and it can be tested by the other side, the defense, then it comes in. So i think itll be interesting to see how it plays out but its a question of what 51 senators think should happen. If these messages are not allowed in court, whats the significance of releasing them now . By the way, i want to make a note that robert hyde is telling nbc news he was, quote, just playing with his messages about tracking ambassador yovanovitchs movements. Interesting game. But nonetheless. If we believe that. He doesnt seem to be a very believable character. Theres two juries here. The jury of Public Opinion and the jury in the senate. So it makes sense to release as much as possible in order to evaluate the credibility of parnas. Theres a lot up in the air. He comes across a credible guy, hes been well coached obviously. There are things hes saying that can be verified, the photographs, the schedules, and most importantly, you know, when he accuses the president of including barr in this conspiracy, the president basically said on that july phone call, check with my friend barr. So there is a lot of corroboration. But there are a lot of unknown things too that need to come out for the jury of Public Opinion. For example, we dont know why the Southern District of new york is not using him as a corroborating witness. We know he did lie to the Pretrial Services people. Theres a lot of questions about the ambassador yovanovitch issue. Theres a real question for me about, you know, why were they trying to fire ambassador yovanovitch a year before biden even announces. Is there an ulterior motive there we had still not developed . Theres a lot of information. If we had time to collect it all, there are a lot of easy ways to do it. And perhaps judge starr could help he was the king of finding extra little witnesses and making sure ts were crossed and is dotted. When it comes to the question of whether or not trump turned to his aide and said fire yovanovitch, we know the name of the aide. We havent talked to the aide yet. We havent checked with the secreta secret service on the schedule. Theres a lot to learn about judging his credibility. Definitely. With regard to the democrats who suggest calling john bolton and lev parnas. Then republicans could call their witnesses, that could include hunter biden and even the whistleblower. Do you think its wise for democrats to call witnesses if the this is their tradeoff . I believe its incredibly important to hear from john bolton, mick mulvaney, i think there are more witnesses than senator Chuck Schumer asked for that are relevant. So for example, not on that list was rick perry. He is clearly someone who has direct information and some of the aides there. And some of the other staff and also the documents are incredibly important, i think as weve seen with lev parnas, i think cynthia is absolutely right about the importance of corroborating anything that someone like lev parnas says because he has lied in the past. But he did bring some corroborating evidence in documents, Text Messages. Remember that the senate and the house, they have gotten none, none of the the house has gotten none of the documents that they requested. And thats extremely important to test the credibility of witnesses. So i would say its critically important. I think cynthia is exactly right when she says the public deserves to know. In a constitutional process also about what the public learns because at the end of the day, if they acquit donald trump, the public still has a right to make an informed decision about whether they want to reelect him. Rachel and her team have put together incredible documentation, which we were all able to view this week. Absolutely. In the last couple nights seeing how she ties together whats being said with facts and corroborating evidence. Its been extraordinary. Ladies ill talk with both of you in a moment, stay with me. Lets turn to the white house and nbcs Kelly Odonnell, whos following the president in palm beach, florida. The president is there for the weekend after releasing the name of his legal team, add to the list Alan Dershowitz, whos now revealing his plans for the president s defense, so what does that look like at this point . Reporter good to be with you. The president has named eight attorneys who will be leading his defense. There are some additional attorneys in in the White House Counsels Office who will be supporting players. Among them, yes, Alan Dershowitz, the retired harvard law professor, who has a long history of being prominent in the u. S. And he is trying to make a distinction that while he will be a part of the team, he says it will be a small role, it wont be part of larger legal strategy, but will be focussed on giving an argument to the senators. He said he wants to influence Democratic Senators on whether or not the offenses brought by the House Democrats rise to the level of impeachable offenses, even if theyre proven. He argued he would give this argument if any president were in this situation. And he said, he himself personally is a democratic that did not vote for President Trump. But in this instance hes arguing for the benefit of President Trump. Part of what he is saying is, he claims that the founders when writing the rules for impeachment in the constitution, considered things like abuse of power but did not put it in the constitution, Alan Dershowitz argues because they did not want it misused for political purposes. There are other scholars who take a different view who dont think dershowitz is right on this. Heres how he explains it in an interview with ari melber. Abuse of power, even if proved, is not an impeachable offense. Thats exactly what the framers rejected. They didnt want to give congress the authority to remove a president because he abused his power. They have to prove treason, bribery, they have to prove other crimes and misdemeanors. Im arguing on behalf of the constitution, to avoid a terrible precedence being set for future president s. Reporter and this legal team will be led by white house pat cipollone, along with pam bondi, as well as some of the president s personal lawyers who have been part of his team for a long time and, of course, he added ken starr, who came to fame as the independent counsel prosecuting the case in the investigation against bill clinton a generation ago. Some called it a curious choice. Donald trump in the 90s spoke deri deriseively of ken starr. Ill be interviewing Alan Dershowitz myself storm tomorro 12 30. Alan dershowitz since you touched on ken starr, cynthia, what is the significance of adding him to the team . You first, maya. The significance is essentially that hes been a donald trump loyalist and has been outspoken even through the Robert Mueller investigation essentially defending donald trump and donald trump has clearly assembled a team he feels is going to say what he hopes will be said in public. Thats fair enough. Thats what everyone does when they pick lawyers, pick people they feel are going to aggressively defend them. Whats problematic here is that Alan Dershowitz is making an argument that all four constitutional scholars disagreed with, including the republicans constitutional scholar john turley in the house process he said of course abuse of power is impeachable. The question is whether theres sufficient evidence. Does Alan Dershowitz help or hurt the president . Or does he sow confusion . You know, i think he gives the president a talking point and thats why hes there. Its interesting that even ken starr, in addition to jonathan turley, who was the president s constitutional scholar on the house side. Ken starr doesnt agree with him either, the other media star on the president s team. Bill clinton was impeached for abuse of power and ken starr obviously supported that. And now hes on the president s team and hes only available because he looked the other way at a sex crime scandal. So none of the president s lawyers agree with dershowitz about this abuse of power argument. His claim you have to have a crime in order for it to be abuse of power doesnt make any sense because there was no federal criminal code at the time of the writing of the constitution. Hes a talking point and not an effective one, in my opinion. Oh to be a fly on the wall within that trump team as they collaborate getting ready for this. Ladies, thank you so much. If the existing case is weak, House Democrats should not have impeached in the first place. To that point, did House Democrats rush impeachment hearings too quickly . I remember we were talking about how quickly they should go. Should they take methodical time but there seemed to be that christmas deadline. Should they have called these witnesses a couple months ago. Lets not forget that the republicans originally argued that the impeachment inquiry and process was going too slow. Then they changed their mind and said it went too fast. The reality is this, alex. What the houses job was to do was to act as a grand jury, to see if there was sufficient evidence to bring articles of impeachment against the president of the United States. And thats exactly the process we did. When it moves to the senate, it is the senates job to conduct a trial. And that means, introduction of additional evidence. Evidence in the form of documents and witnesses. So we need pompeo, we need mulvaney, we need bolton all to testify. This is what the Republican Senate should be concerned about. As we have seen in the last month, the evidence keeps coming out. And they push this trial through quickly, and we start seeing additional evidence and testimony come through after the potential acquittal of the president , people like bolton, coming to testify in front of the house or otherwise provide that information, a lot of senators on the republican side are going to deeply regret not doing their constitutional duty. Im sure that you have heard Rachel Maddows incredible interview with lev parnas. What is your take on all that he said. And for those who are skeptics, many republicans who say, look hes an indicted criminal, and all this is true, if hes somebody who as they allege is working with democrats now to try to lessen a sentence, why would he potentially add perjury to the list of things he would have to face . I think when you look at parnas testimony that he provided on Rachel Maddows show, it was very clear that he was validating what we already have seen transpire. I mean, the comments about attorney general william barr being involved in the process. Heck the president of the United States said that in the call memorandum. He literally told the president of ukraine to reach out and talk to rudy and attorney general barr. So parnas is just confirming exactly what we know. That there are people within this administration that are also culpable in action and behavior that needs further investigation. As long as attorney general barr continues to act as personal attorney of the president of the United States, this country will not get the investigation it deserves of his behavior and others around him. Okay. I want to throw a question quickly about 2020. I know yesterday you endorsed Mike Bloomberg for the nomination. According to the mercury news, bloomberg dropped more than 10 million on california house races in 2018, including your campaign. Theres something reported in the form of 10 million in ads opposing your opponent. There are critics out there who feel hes buying some of the support hes getting. Is that fair . I dont think its fair. I think its fabulous that we have somebody like mayor bloomberg, with the experience he has from the business side. Obviously hes created one of the most successful businesses our country has seen, coming from a moderate background of a middle class background. In addition he was mayor of new york city, the largest city in the United States, larger than 39 states. I say that to put it in perspective of how big of a job it is. He is the only candidate running who truly has such depth in both business and politics. I think the fact that he is using his own money and not using outside money whatsoever to drive his race is a positive thing. Can i ask quickly, why not biden . There are voters who think hes the candidate that could defeat President Trump. I like joe biden. I like anybody who can beat trump. Whoever is the eventual nominee im going to support 100 . That unfolding at the pentagon that was set up after trumps military leaders became concerned about, quote, gaping holes in the knowledge of the United States key alliances. Joining me now, gabby orr, daniel strouse, and rick tyler. I got to say, i always wondered what the catalyst was for that comment by rex tillerson. Whats the most shocking revelation youve seen from this book . I think it was that meeting that led rex tillerson, who by the way was the only person to stand up to donald trump in that meeting, the way the authors describe it, mike pence sat there like he was a wax museum figure, mattis fell in line, he was infuriated but would not stand up to the president. To paraphrase reagan, its not that donald trump doesnt know a lot, its just that so much of what he knows just isnt so. He just reveals himself over and over. And these military and state Department Leaders who were in the room at the tank were basically made a huge miscalculation, but they were trying to educate trump on American Leadership around the world, that we are a better planet when we are we are deployed and using our assets wisely around the world. And trump turned it into we should be making a profit off the military. Which is i think the most singularly shocking, almost treasonous revelation of trumps complete misunderstanding of why people go into the military. And here was mr. Bone spurs giving all these people who put their lives on the line in the military a lecture on being in the military. Many of whom have sons and daughters in the military, too. That is remarkable. I know gabby, since you cover the president , does any of this surprise you and what does the white house have to say . The white house is radio silent on the book by two authors who like myself have closely followed the Trump White House since the beginning of this administration. I dont expect theyll put out any statement. Typically when books come out that are damaging to the president or contain anecdotes that are embarrassing or alarming surrounding his fitness for office, the white house remains as quiet as possible about them. None of this is really that surprising, if you talk to white house officials on a daily or weekly basis, there are moments theyll describe when the president doesnt grasp something or doesnt have any sort of motivation to learn about a topic that hes dealing with as commander in chief. Yeah. That is consistent across this administration, and so reading the passages from this new book werent that surprising. With regard to rick went into detail about this one particular meeting. Donald trump says that he is a president who always sticks up for the u. S. Armed forces. But the revelations in this book, do they indicate otherwise . Look, these dont these already pile on public feuds President Trump has had with past generals and past National Security advisors. John bolton, remember, is a former National Security advisor for this administration because he didnt get along with President Trump. This goes back to the earliest days of his administration when he gave a controversial speech at cia headquarters. We shouldnt be surprised that despite throughout his presence on the National Political stage the fact that he said he is a a president or a candidate who really is focussed on repairing and rebuilding the american military. At times he has strongly disagreed with them. And that disagreement has gone so far that military officials have spoken out against him. Gabby, the book also details a president with a fundamental lack of understanding for basic geography, as trump tells india, its not like youve got china on your border. As someone tasked with making major Foreign Policy decisions how concerning is this to those around him . Its something that members of the administration have noted privately for many months now. They talk about what the president does or doesnt understand, what he does or doesnt know about the Foreign Policy that hes often tasked with talking about. I will say its important to note the characterization we heard in the one anecdote about how steve bannon was behaving and how he helped form the president s mind and guide his policy. Something recently that happened with that, the strike against soleimani. Its often the president doesnt think through things before pulling the trigger and moving forward. Heres something he likes from an adviser and moves forward on it as quickly as possible. Yet in polling recently, politico put out a poll that showed that was very popular with a lot of voters. 59 of voters agreed to strike soleimani but also called for increased nato participation in the middle east. Although the Decision Making may not be adeideal, often times th decisions are popular with his base and those outside it. But pulling the trigger first and then dealing with the consequences and also the portrayal of the president being uninformed, to both you rick and daniel, how concerning is this . Rick, you first . Its very concerning. A National Security concern. When the president doesnt understand the president s role around the world, doesnt understand basic facts around the military and doesnt seem to grasp the information or be interested in it, and puts his own personal knowledge above everyone else, by virtue of believing it, it it ascribes a truth to it, which is really remarkable. Quickly to you, daniel. Look, i mean, this is a topical aspect of this book right now. The United States just, i guess you would say, deescalated to an extent with iran, and it looked like the president was bringing the country to the brink of war. New pressure today on Senate Republicans to call witnesses in the impeachment trial as House Democrats release another round of documents from indicted Rudy Giuliani associate lev parnas. Hes accused of breaking Campaign Finance law and was arrested this fall at a washington airport with a oneway ticket out of the country. It comes after parnas talked this week exclusively to Rachel Maddow about his relationship to the president and the dealings in ukraine. So i want to go through some of the biggest revelations from that interview. First up, parnas said President Trump was aware of his work in ukraine. President trump knew exactly what was going on. He was aware of all of my movements. He i wouldnt do anything without the consent of Rudy Giuliani or the president. I have no reason to speak to any of these officials. I mean, they have more reason to speak to me. Why would president zelenskys inner circle or minister or all these people or president poroshenko meet with me, who am i . They were told to meet with me, thats the secret theyre trying to keep. President trump said again yesterday he didnt know lev parnas but parnas says thats not true and the two met on several occasions. He knew exactly who i was. Especially because i interacted with him at a lot of events. I sat a lot of one on one conversations with him at gatherings with house special, like these round tables where there would be six people at a table, we had several of those. Basically i was with rudy more than four or five days out of the week. I was in Constant Contact with him. Parnas then discredited the idea the president was rooting out corruption in ukraine. He said it was solely about the bidens. It was all about joe biden, hunter biden, and also rudy had a personal thing with the manafort stuff, the black ledger. That was another thing they were looking into. But it was never about corruption. It was never. It was strictly about burisma, which included hunterer and joe biden. And he made it clear he was in ukraine as a direct representative of Rudy Giuliani and President Trump. The first thing i did was to introduce myself and tell them im here on behalf of Rudy Giuliani and the president of the United States. We put rudy on the phone, rudy relayed to him basically we were there on behalf of the president of the United States. You were there to speak on trumps behalf . Those exact words. And parnas says Vice President mike pence also knew exactly what was going on in ukraine. Do you know if Vice President pence was aware that that was the quid pro quo . That was the trade and that that in fact is why his inaugural visit was called off . Im going to use a famous quote by mr. Sondland, everybody was in the loop. When nbc asked the Vice President about this he said he didnt know parnas, and everything he said was false. Whats the most striking thing you heard in that conversation . Well, look. What was striking to me is all the series of questions that were not asked of him, starting with the criminal charges that he is facing in the Southern District of new york. I presume that part of the ground rules is he was not going to answer questions about that. But that is clearly the driving force for him coming forward. In fact, his lawyer made it clear, in a separate interview with the new york times, that this is all about trying to cut a deal with federal prosecutors in the Southern District. Michael, i get that and theres a lot of questions about that, but my question is, why would he add perjury to his list of charges he is now facing . Why would he continue to lie . Why would he not tell the truth . Well, first of all, he was not under oath in his true, but he might be if hes called as a witness. No, he would have to cop to a guilty plea in order to get any kind of deal from the Southern District. He would have to admit, yes, he was guilty of the charges that hes facing and he clearly is not prepared to do that. Look, theres a whole series of other questions that he needs to answer. That caught in many different directions. Including lets go back to what Rudy Giuliani said some months ago that he wasnt charging donald trump for his legal services, but that he did, in august of 2018, get 500,000 from parnas. So, in effect, it appears that parnas may well have been paying for Donald Trumps legal fees to Rudy Giuliani.
