Good morning, and welcome to way too early, the show that is still going to need time processing what we saw happen in the capitol this week. I am kasie hunt on this friday, january 8th. We will start with the news. And we begin with the new developments in the aftermath of wednesdays chaos on capitol hill. Weve learned that a u. S. Capitol Police Officer has died after clashing with the protrump mob that stormed the capitol. According to Capitol Police, officer Brian Sicknick was injured while physically engaging with protesters and he collapsed after returning to his division. He was taken to a local hospital where he died at approximately 9 30 p. M. Last night. His death is being investigated by the d. C. Metropolitan departments homicide branch, the u. S. Capitol police and their federal partners. Congressman tim ryan, who oversees the committee that funds the Capitol Police, told reporters yesterday that as many as 60 capitol Police Officers were injured in the riot including 15 that had to be hospitalized. The congressman said many were hit in the head with lead pipes. And House Speaker nancy pelosi yesterday joined over 200 congressional lawmakers in calling for President Trumps immediate removal from office. In caution for this seditious act, the president haas committed an unspeakable assault on our nation and our people. I join the Senate Democratic leader in calling on the Vice President to remove this president by immediately invoking the 25th amendment. If the Vice President and cabinet do not act, the congress may be prepared to move forward with impeachment. That is the overwhelming sentiment of my caucus. So, though she made clear there that impeachment is on the table, she also underscored that the preferred avenue for removing him would be invoking the 25th amendment. And in a video announcement, Adam Kinzinger of illinois became the first republican congressman to call for invoking the 25th amendment. And outside washington, marylands republican governor, larry hogan, said, quote, the country would be better off if trump resigned or was removed. Massachusetts governor charlie baker, also a republican, echoed that sentiment, saying he believes the president should, quote, step down, and the orderly transition of power should be led by Vice President pence. Sources tell cnbc secretary of state mike pompeo and treasury secretary Steve Mnuchin have also discussed invoking the 25th amendment, though there are concerns that the process would take too long. And we are going to hear more from congressman kinzinger when he joins morning joe later on this morning. So, after telling his supporters to march to the capitol to show strength and then telling them, we love you as they were ransacking the building, the president released a new video yesterday. Its worth a watch. Take a look. Like all americans, i am outraged by the violence, lau lawlessness and mayhem. Those who deniland the capitol have defiled the seat of american democracy. To those who broke the law, you will pay. Now congress has certified the results. A new administration will be inaugurated on january 20th. My focus now turns to ensuring a smooth, orderly, and seamless transition of power. And that is the closest that the president has come to a public concession. The New York Times peter baker and Maggie Haberman report that trump initially resisted taping the video and agreed only after being pressed by his aides. According to the times, quote, he appeared to suddenly realize he could face legal risk for prodding the mob, coming shortly after the chief federal prosecutor for washington left open the possibility of investigating the president for illegally inciting the attack. He was in the White House Press gallery when it was evacuated and stayed through the night until the certification of joe bidens election victory. Bres, as everyone calls you on capitol hill, its great to have you on the show. You and i have talked many times over the years, but i think this is the first time weve ever had a conversation in this forum, so i really appreciate you getting up early with us. Lets talk a little bit about what comes next here. We showed everyone what Speaker Pelosi said about the 25th amendment. Clearly, something was going on behind the scenes to prompt President Trump to put out that video. He was clearly reading off a teleprompter. He only really does that when somebody tells him to. What do you know about the pressure that is on the white house from republicans in congress and where the conversations stand about how to move forward . Well, republicans in congress definitely dont want to vote on anything more related to trump. Thats for sure. Ive heard that from both senators and house members. But there is the level of anger at trump from republicans is stunning. Talking to Senior Republicans across the house and senate yesterday, just furious, absolutely furious with the president s actions. And you know, the assault on the capitol i mean, were going to have some news on this at punch bowl news at about 6 00 a. M. , so, i dont want to give it away right now. But you know how about you give us a hint, brez. Listen, the president s supporting in congress right now i mean, we could see where the senate is pretty much done with trump. They voted the other day by overwhelming margin, the vast majority of senators did not uphold the objections to bidens certification. So, there were a large number of House Republicans who continued to support that position. What were going to report is that something along those lines about that last faction of trumpism in the house is really under, kind of crumbling under his feet. And i think that played a role in his announcement yesterday. I mean, hes had some support on the hill, and thats even after he goes through the postelection challenge, and thats really crumbling. Well keep an eye out for that one when punch bowl news drops in a little while. Brez, lets talk for a second about the Capitol Police and the security failure here. Were going to have more conversations about where our reporting stands on that later on in the show, but i mean, you were in the building when this all happened. You have been going up to that building, walking through those mags for years. Theyre familiar faces. The Capitol Police are familiar faces to those of us who are up there. Can you just kind of give us a sense of how you felt about the breach that we saw . And it sounds like leadership are pretty angry with the leadership of Law Enforcement on capitol hill. What do you know about what happened and what drove this failure . Well, its just a shocking failure of, you know, intelligence and preparation, which is, as you know i mean, look, the capitol is, you know, is a working building. Its a museum. Its a tourist destination. Millions of tourists annually. But its also, you know, a building where, you know, the symbolic value is huge. And Capitol Police deal with protests all the time. You know, ive seen and theyre terrific at it, usually. Ive seen a capitol Police Officer talk a Samurai Sword out of a deranged mans hands and put it down. I mean, they deal with protesters. Theyre good at defusing these kinds of situations. When its preparation, they are so well prepared for the state of the union and other big events, inauguration. But this one, they just clearly had a failure of intelligence on their side, but also, in their defense, weve never had a president of the United States exhorting his supporters from the white house to go a mile down the road and, you know, protest congress. I mean, the situation is unprecedented. But i do think, you know, look, weve already seen Senate Majority leader Mitch Mcconnell force out the sergeantatarms on the house side, the Security Leaders there are going to be forced out. Theres going to be some wholesale changes, and theres going to be a pretty big investigation on this issue Going Forward. Yeah, i know, all of us always assume, while being in the capitol, its the safest place to be when Something Like this is happening outside. The United States has hit a grim, new marker in the covid19 pandemic with the country breaking an alltime daily record for both cases and deaths, and its the second day in a row. According to an nbc news tally, nearly 269,000 cases and over 4,100 deaths were reported yesterday. And this is the first time the u. S. Has reported more than 4,000 deaths in a single day. This week alone, over 1. 6 million new cases and over 19,000 deaths were logged. And meanwhile, the first cases of the coronavirus variant originally identified in the uk has been identified has been found, excuse me, in more states. Yesterday, Public Officials in texas identified their first case, while officials in connecticut reported their first two. The strain of the virus is considered to be more contagious. Health officials in pennsylvania have also confirmed their first case of the variant. The individual tested positive after known international exposure, at least that one may not be community spread. And although the variant has so far been detected in a very small fraction of infections, cdc Officials Say it shows signs of spreading and may become significantly more common in the coming weeks. At least 56 cases of this new variant have now been confirmed nationwide. Speaking to the media yesterday following reports earlier this week that there were discussions about possibly delaying the game, day didnt give specifics about ohio states roster, but he said the buckeyes will have plenty of players available. The team competed without multiple starters in last weeks semifinal win against clemson. So that only happens maybe once or twice every winter. So, this is the morning for you if you like a little snow and ice. The heavier stuff, though, is definitely in the mountains. The blue on the map shows you where its snowing, near richmond and norfolk and even raleigh. The north side of raleigh looks like the best chance of that snow. So, additional snowfall forecast. A lot of its already fallen in the mountains. Well get a little bit of additional and well also see a little bit of snow there, charlotte to raleigh. Predictions are about an inch, and that will mostly be on the grassy surfaces. So, for todays forecast, another chilly start in the northeast, but a decent afternoon. And watch the next storm. Its starting in the Pacific Northwest today. On saturday, we take that storm with some snow in the rockies, especially from denver into areas of wyoming. And then look at sunday. We get a southern snowstorm in areas of texas, oklahoma, and even new mexico. We have the possibility of seeing significant snow in areas that dont typically get it. Biden on thursday announced rhode island governor and former venture capitalist gina roamedo as his choice for secretary of commerce and boston mayor marty walsh, a selfdescribed lifelong champion of working people as his choice for cabinet labor secretary. The two are expected to, perhaps, balance each other out. Raimondo has often been at odds with labor unions, whereas walsh, a union member, has seen strong support from the major unions. And speaking yesterday in delaware, biden also introduced his pick for attorney general, merrick garland. I want to be clear to those who lead this department, who you will serve. You wont work for me. You are not the president or the Vice President s lawyer. Your loyalty is not to me. Its to the law, the constitution, the people of this nation, to guarantee justice. The first confirmation hearing for a Biden Cabinet member has been scheduled, but there is also growing concern that his Incoming Administration might not have a single official confirmed by Inauguration Day. The Senate Armed Services committee will hold a confirmation hearing for lloyd austin to be defense secretary on january 19th, just a day before biden is sworn in. The hearing means the retired army general likely wont be confirmed in time for the start of the new biden administration. According to the washington post, this upsets a tradition going back to the cold war, ensuring the president enters office with at least part of his National Security team in place, and they did give donald trump, President Trump, the courtesy of confirming jim mattis the day of the inauguration. A nonscaleable, 7foot fence was respected yesterday, surrounding the capitol complex. 6,200 National Guard troops are also set to deploy to washington this weekend and are expected to remain in the region for a minimum of 30 days. For now, those troops are expected to be unarmed. The National Guard was also mobilized during the riots, and about 1,100 troops were sent to assist local police during the insurrection. Meanwhile, the acting u. S. Attorney here in d. C. , mike sherwin, charged 55 people yesterday for their roles in wednesdays riot at the capitol. Nbc news has learned that charges range from unlawful entry to assault and theft. Eight suspects face gun charges, including one who allegedly had a militarystyle semiautomatic rifle and 11 molotov cocktails. Thats terrifying. Sherwin says federal and local investigators are now searching social media for photos and video clips of suspects engaged in unlawful activity. The department of justice suspects the search for suspects to last all year. The fbi issued a public call wednesday night for information about the suspects, and they say theyve received more than 4,000 tips so far. The mob incited by President Trump that ransacked the capitol is raising serious, obvious questions about congressional security. As nbcs Julia Ainsley reports, defense officials said yesterday that federal Law Enforcement and washington, d. C. , officials requested only modest support from the National Guard, not anticipating largescale violence on wednesday. Pentagon officials claimed that more troops were offered, but that they were turned down by city officials. In addition, three top Security Officials on capitol hill are resigning, including the house sergeantatarms and the senate sergeantatarms. Steven sund, the capitols police chief, says he will leave his position after House Speaker nancy pelosi called for his resignation yesterday, noting that mr. Sund, quote, hasnt even called us since this happened. That is stunning. Nbc news correspondent Julia Ainsley joins us now with this new reporting. Julia, walk us through what we know about how this happened. And i think my question is you know, i was trying to figure out from reading the quotes and your story and what weve learned, whether this was a situation where the Defense Department was simply trying to pass the blame off to someone else. So, if you could walk us through how this came to be and what your sense is of what was the root of this failure . Yeah. I mean, i think you have to look at the three major federal agencies that would have been able to provide support, and theyre all really telling the same story at this point, whether youre talking about homeland security. They can provide people like we saw this summer. They can provide customs and border protection. They can provide more people. They can provide i. C. E. , people who can go and fortify, add numbers to Capitol Police. Same with the Justice Department. They can provide atf to look for explosives. They can provide the bureau of prisons. Then you have the Defense Department that can provide the National Guard. All of those agencies said that they were essentially sitting on their hands watching in horror on wednesday, seeing the Capitol Police be outnumbered, but they had been told that they did not need additional federal presence. And this not only came from the Capitol Police, but from the mayor of d. C. , who sent out a letter to all of those agencies on wednesday saying that she did not want additional federal presence beyond the secret service and the Parks Department and Capitol Police. She wanted this to stay local because she pointed to what happened this summer when there were unidentified federal agents in the crowds of protests outside the white house. She said that was a problem and it was uncoordinated, so they needed to leave this to d. C. And to the Capitol Police. Now, hindsight can be 20 20, but at this point, that seems like a big problem. And not only were they denied in those days Going Forward when they started to see this insurrection, people breaching the capitol, we heard that Justice Department officials, defense officials continued to offer their advice, and when they were finally taken up on it and they were allowed to send in people like a s. W. A. T. Team from the Justice Department, it was a little too little, too late, as you know, kasie. It was very much too little, too late. And julia, i know youre going to be following all of this. Im sure were going to be talking about this for the weeks, perhaps months to come, as we try to figure out how on earth this happened. That was former white house chief of staff john kelly telling cnn yesterday that if he were a member of the president s cabinet, he would support invoking the 25th amendment after the rioting at the u. Lets talk about where things stand in terms of the 25th amendment. What are you hearing behind the scenes on capitol hill, especially from i know you have good relationships with your republican colleagues. Does the president still have support from them in congress . Well, i think that as we saw, what happened even after the violence at the capitol, there are a significant number of republicans that are still supporting him. At the same time, there are also a surprisingly broad section of republicans, from members of the freedom caucus, to more moderate republicans, very deeply disturbed by whats happened, believe he i mean, even yesterday, ted cruz said he bears some responsibility for what happened, and they are concerned about the damage that can be done in the next 12 days now that we are down to. I think the question is, how do you hold this president accountable for his actions . How do you keep any real damage theres still 12 days. Theres significant damage that could still occur in those 12 days and how do you bring the country together at the same time . I think democrats are at a point that somethings got to happen. So, whats the plan in the event we dont see mike pence signal a willingness and Chuck Schumer and nancy pelosi both said publicly they tried to reach pence, they didnt, so they went out and said this in public in front of all the cameras. Pelosi said, we expect to hear from him by the end of the day. We havent really gotten a clear answer one way or the other. So, if pence declines in some way, sends a signal hes declining to invoke the 25th amendment, what will you democrats in the house do then . Well, kasie, i think we kind of got that signal last night when people were reporting that he did not think that that was the way that we should go, and youve seen two women members of the cabinet resign in the last 24 hours. I think their contribution to history could have been made in a different way. But i dont think the 25th amendment is looking as real as many people and i do know that there are republican members that thought that that was the way to go. I think that democrats are going to move forward with another impeachment, because they do believe that he must be held accountable for his actions that triggered, contributed, encouraged, enflamed what happened at the largest symbol of democracy in this country two days ago. Wow. That sounds pretty newsworthy to me. What do you think that looks like . I mean, is the house going to be called back to washington . Do you expect articles would be introduced quickly and passed . I mean, time is of the essence. I think youll see its not a decision one person makes. Our leadership is there. Chuck schumer and nancy pelosi are talking. Im not saying that this is a totally done decision, but now there are more than 200 members in the house and senate that believe that something must happen. There will be a Democratic Caucus meeting today at noon. Members will express their opinions. But i think that there is a great deal of discussion. I have talked to multiple, multiple members, and i think that that is the direction that we are headed. Now, theres one week left. There are nine days left on monday. So you know, the house can move quickly and move it again, but then the question is, can the senate hold a trial that quickly . I think that the real question is how do we minimize any further damage for the remaining days in this administration . And what you saw in the capitol is one of the consequences, but there are a lot of other things that can happen and that we all and im going to say this to my republican colleagues, the members of the cabinet and to Vice President pence you have responsibility to this country to make sure there is no further damage to this democracy. So, do you think i mean, what is Chuck Schumer saying behind the scenes about whether there may be support among Senate Republicans to actually vote to impeach . I have talked to a lot of republicans. I dont think that youre going to see a significant amount of republican support for impeachment, but that doesnt mean you know, the dynamics are moving very, very quickly. Are moving very, very quickly. You are i mean, youre seeing all this. By the way, i want to say that as youre talking about security at the capitol, how did this happen, there are very conflicting reports that even if you look at what larry hogan said yesterday about wanting to send the National Guard but he wasnt being authorized, we need the facts and the truth. How the hell did this happen in the United States of america and people need to be held accountable and there are conflicting facts and people like me need to know the real facts. Joining us with a look at axios a. M. , hans nichols. Good morning. Things are moving very forecast but whats the 1 big thing youre highlighting this morning . Well, the 1 big thing were looking at is how joe biden plans to get stimulus money into americans pockets quickly and that means a twostepped approach to the stimulus package or relief package and that means going immediately going with covid. That includes the 2,000 checks. Moneys for state and localities, vaccine money as well. Then later on in the spring, kasie, doing a bigger package. This is part of his 3 trillion build back better plan, tax and infrastructure. A whole lot of things in there. So it really reflects the changing dynamic in the senate. Theres a great deal of confidence now among bidens team that theyll be be able to go back to congress multiple times. Yes, they have a thin margin in the senate but they still need and they have the opportunity to get the things done that he campaigned on. So we have had just a reset we have had a remarkable 48 hours. Lost in all of this, you know, you have talked about this a little bit. Lost in all of this is that the democrats won the senate. Joe biden is going to have a working majority in both the house and the senate and that has vast implications for his entire presidency. Not just in terms of infrastructure, but also in terms of judges and in terms of cabinet appointments. In terms of his entire agenda. Joe biden is in the drivers seat. Now, it is remarkable we had these two huge stories play out this week. So im glad that you reminded us of that. But of course, hans, first we have to get to the inauguration. What are you all reporting and looking at in terms of the thinking around the 25th amendment . We were just talking to Debbie Dingell. Sounds like democrats are more willing to move ahead with impeachment. I thought that was newsy, what do you know about that . In terms of the 25th it doesnt seem likely. There is some preliminary discussions at least with some agencies. Jonathan swan reporting that the conversations took place. Youre going to need pence, right, and theres no indication that hes willing to invoke the 25th. If you go the cabinet route or the other route, another body is congress, will so pelosi hinted that, you still need the Vice President and theres no indication hes willing to trigger the 25th. So in terms of what that means for senior officials at the white house, what we are reporting at axios is that theyre not going to carry out any unlawful orders and in some ways, some senior officials are being urged, pat cipollone, robert obrien, to stay in the white house to continue to be by the president s side to ensure that unlawful orders or anything untoward doesnt happen. So, you know, the time is getting very compressed on this. I tried to press Speaker Pelosi down on capitol hill yesterday on what her time line was for triggering impeachment proceedings, but 12 days is a tight time line and it seems as though the officials in the white house are trying to think what can they do not to prevent some bad potentially things from happening. Kasie . It does seem as though republicans and democrats are on the same page and thinking theres significant danger in this period of time and everybody wanting to try figure out the best way to mitigate that danger, but people are not on the same page of how to do that. Hans, i know you have been covering the biden team very closely. We did not hear the president elect yesterday come out and say, okay, yes, invoke the 25th amendment. How are they looking at this period of time . How dangerous do they think things are and what might the president elect do in this time . I think steady as she goes from the president elect. They want to give space to make decisions for whats best for the country and thats a preview on how biden is going to approach Senate Republicans. Not question their intent and give them the ability to make a deal. So i think theyre leary of making any public pressure on republicans and specifically on this. You saw the Vice President using some Strong Language yesterday, right . You know, again, it comes down to what is the best way in the next 12 days to ensure that untoward, bad things dont happen.
