Joyce mitchell provided contraband to the escaped killers but did not provide them with power tools to break through their prison cell. This comes as a Community Remains on enj. The manhunt is on its seventh day for the killer whose escaped a maximum security prison in new york. The new search area just miles from the prison. More than 500 Police Officers joined by search dogs and helicopters are combing through dense forests and going door to door. Bloodhound picked up the scent of one or both of the inmates, and that that prompted Law Enforcement to zero in on a roughly 30 acre section of rugged terrain in dannemora, three miles from theclipten correctional facility. Its crazy. Its scary. So close to home. Family in the area has been pulling together. We have been close in contact, making sure we know where everybody is and theyre okay. John yang joins us live from a police road block in morrisonville, new york. Good morning. Good morning, jose. Lets start with what the District Attorneys been telling us about Joyce Mitchell. He was here at the checkpoint a little bit ago to say that to confirm information that Joyce Mitchell had been under investigation within the past year based on a complaint from a guard about her apparent closeness with inmate david sweat, one of those who escaped, was discovered to have escaped on saturday. In addition the District Attorney cleared up one of the Big Questions a lot of people have been wondering about. Im not going to get into the details of exactly what she brought into the facility. I have been consistent with that in this investigation. Im going to continue to be consistent with that in this investigation. But to confirm she has not brought power tools into the facility based on our investigation. He would not get into how they think those power tools did get in. But only to say that Joyce Mitchell was not the source of those. He said Joyce Mitchell was reluctant to give information or gave only minimal information at the beginning of her questioning, but has really become a lot more talkative as days have gone on. Meanwhile, the search has resumed. Its focusing on a 30acre area about three miles or so southeast of the prison. Theyre using dogs. Theyre using helicopters in the search, and its under way again this morning. Jose. John yang thank you very much. I want to bring in contributor and former fbi agent cliff van zand. Good morning. Lets start out with the development. He said Joyce Mitchell brought contraband to the escaped inmates but did not provide power tools. What would that be . Contraband theres at least one report jose that suggestion of contraband is drill bits and hack saw blades. Something that she easily could have smuggled in in her purse and on her person as well as perhaps allowing them to use her cell phone. And the possibility that maybe she has given them either that or other cell phones so they could use once theyre outside or to communicate from the inside out. Let me ask you something. If she didnt give them the actual power tools and the power tools that were being used in the prison are all accounted for, what does that tell you . Where did they come from . If all of the power tools are accounted for, and knowing most prisons, when you look at where the tools are, theres a black outline on a board where you hang that tool up. So the guards can just look on that board and say, hey, theres a drill missing. Theres a saw missing. They lockdown the whole prison until they find that. So if in fact thats not the case, then it has to suggest the tools came in otherwise. We know workers have been in and out of that prison from the outside, did they accidentally louvre a tool and it disappeared . Did they provide the tools willingly . Thats part of the internal investigation while authorities are handling the fugitive investigation outside. And mrs. Mitchell has yet to be charge said with anything. Let me ask you about the 30acre search area. You know early on last week we were talking about the possibility that they were anywhere from canada to mexico to philadelphia. What tells you about this 30acre area and why do you they think theyre concentrating there right now . Jose theyve got nothing to indicate these guys got out of the area. No stolen cars stolen trucks. They cant put them on a train. They cant put them on a bus. Theres no transportation that theyve been able to identify whatsoever, and as you know, theyve had recent findings of candy bar wrappers on the ground where they may have slept for the night. There was a sighting at a gas station. That gas station has a subway restaurant. They could well be doing remember eric rudolph, the socalled olympic park bomber. He was going behind restaurants at night doing dumpster diving going in pulling out food and using that to eat. These guys could very well be feeding themselves that way. We just learned moments ago, according to a democratic aide on capitol hill president obama is going to be attending a meeting this morning with House Democrats ahead of a really important vote later on today. In fact democrats, republicans, are going to vote on two pieces of legislation that could ultimately give president Obama Fast Track Authority to secure a broader trade deal a landmark trade agreement, which is really one of his signature pieces and key goals of his second term. Now, heres whats at stake, jose. In this case you have democrats who a lot of them are opposed to this. They have expressed concern this will cost jobs. President obama, the white house, pushing back saying that the trade deal has protections against any job losses any Environmental Impact that we might see. But again, a lot of democrats are skeptical about this trade deal. Now, again, just to be clear, jose, whats at stake today are two pieces of legislation that would ultimately give president Obama Fast Track Authority to secure a broader trade deal. And in order to get it he needs democrats onboard. So that is why youre seeing this fullcourt press from president obama himself. This is not something we have typically seen from this white house, so this morning, hes meeting with House Democrats. Last night, he went to a congressional softball game to try to secure those lastminute key votes. One of the things that well be watching for today, jose is what Minority Leader Nancy Pelosi does. She could be key to making sure that these two pieces of legislation in fact pass. White house officials tell me they have been working very closely with Nancy Pelosis team trying to get her onboard with these two pieces of legislation. I am told that this is going to be a nail biter, still a lot of people are cautiously optimistic that these two pieces of legislation will pass ultimately giving president Obama Fast Track Authority to secure that landmark trade deal that hes hoping to get. The fbi has arrested a second man in connection to that plot. Officials say necklace ruvinsky of rhode island was aware of plans by usama rahim to carry out attacks with knives. Rahim was shot to death last week by police and fbi agents seeking to question him. Police and the fbi searched the home for several days last week and took him in for questioning. He was arrested last week and we expect charges to be announced any minute. Pete williams will join me with more on this story as soon as the charges are unveiled. Now to whats shaping up to be an important weekend in president ial politics. Hillary clinton is gearing up for her campaigns ceremonial kickoff. Reports say shell evoke franklin roosevelt, but her speech not expected to focus on policy but her personal story. Half a dozen republicans are heading west in hopes of a gold rush. Mitt romney is hosting prominent members of his own party. Some already in the 2016 race. Those republicans are hoping to woo the 2012 nominee and his friends with deep pockets. One guy who hasnt even said if hes running is already talking about forming a ticket with marco rubio. I have had quite a few people, grassroots supporters donors and others make that suggestion. Campaign aides tell me this speech will be very personal, which is a marked contrast from 20008, and also the Hillary Clinton we have seen so far this year. Shell focus on the story of her mother, who was abandoned as a child, sent to live with really cruel relatives and ran away from home at 14. Kind of made her own way in the world. And Hillary Clinton will say that story, her mothers experience and trauma made her want to get into public life to be an advocate for women and children and people who cant fight for themselves. Thats the entire purpose shes running for president. Shell also lay out policy and get into economic tones, but this is the first time well hear Hillary Clinton talk about her personal motivation for running for president and lay out of the rationale. Weve always been focused lately on the rough relations between this white house and congressional republicans. But its not as if this white house has had great relationships with congressional democrats. And by the way, if this thing goes down thats where the roots of this going down came from. Thats where they sort of grew out from what has been just terrible tending to of even allies on capitol hill by this president. Has he been working for a while now on the democrats . Because it seems as though if you just take this as a cold analysis and youre saying now, three hours before the vote he goes to capitol hill . Or has he been behind the scenes working with democrats . They have been working behind the scenes. This isnt a case he hasnt been doing that. Thats been done. Look, i tell you, it is amazish watching House Democrats. Theyre shooting at each other in ways we havent seen this Democratic Party in the house of representatives do in a long time. Frankly, they look like the way senate they look like the way the conservatives in the house caucus fight with each other normally and make John Boehners life miserable. Youre seeing the same effort playing out here. We know a majority of House Democrats are against this deal and i think part of it is while labor has less influence today in american politics than they have had since the creation of the movement as a political force, among the House Democrats, they still have influence because of gerrymandering. So many House Democrats represent strong democratic districts that labors threat of primaries and primaries have deeth because they can do that. Its similar to say a club for growth on the right. Who really cant have an impact in a general election but can in a primary. Lets talk about isis, the paulolicy of 450 additional troops sent to iraq to train folks to fight isis. Is this you know is this something were going to be dealing with through 2016 . Obviously, well be dealing with it through then. Look theres clearly a divide between the military leaders and the civilian leaders on what to do in iraq. I think the military people have said to the president and his team that you know this strategy isnt going to work. Additional trainers probably arent going to be the answer here to actually getting, you know, finishing the goal of destroying isis. It probably means more troops. This president is determined not to hand his successor a quagmire of any sort and i think that the problem they have is any time they war game a scenario. Lets say, they say okay, fine, well send 20,000 stroops in destroy isis in iraq. Then what do you do about them in syria . Thats another problem. I think theres no nobody has been able to give the president a plan that says heres how you defeat them and then be able to get out. Because nobody believes defeating them means being able to get out after you defeat them or Something Else will rise up in its place. Were learning now information about the prison workers being questioned in the case. In the past hour the Clinton County District Attorney said Joyce Mitchell provided inmates richard matt and david sweat with contraband but he could not say what the contraband was. He also said mitchell did not give them the power tools used to cut out of their prison cell. Right now, were continuing to work with her. Learning more and more information each day from her. As far as establishing a timeline on how this process occurred and what her involvement was. These breaking details come as investigators look deeper into the relationship between mitchell and the two escaped killers. Stephanie gosk has the very latest. She thought it was love say sources familiar with the investigation about the relationship between convicted killer richard matt and prison worker Joyce Mitchell. But according to the wall street journal prison officials suspected mitchell also had a relationship with david sweat. An investigation conducted in the last 12 months didnt find enough evidence to discipline mitchell, but the paper reports that sweat was moved out of her tailor shop. A former guard at clinton correctional told nbc news that some prisoners were targed the, quote, weakest workers. Civilian workers like Joyce Mitchell were not considered as hardcore as the guards. The inmates even have a name for it grooming. Prisoners are mastered of manipulation manipulation. Ted is a former guard. Theyre trying to establish an ounce of flirtation. They have everything to gain she has everything to lose. In most cases, sources familiar with clinton correctional say the game was generally small, cigarettes food newspapers but they pushed mitchell for more. Sources say mitchell was supposed to be the getaway driver. On the day of the escape the 51yearold didnt show up instead, checking herself into a hospital with a panic attack. Stephon gosk thank you. A judge in cleveland said there is enough evidence to charge the two officers involved in the shooting death of tamir rice. This is an advisory opinion. The prosecutor will decide whether to file charges and plans to take the case to a grand jury. The 12yearold was playing in the park with an air soft pellet gun last november. Police were dispatched to the scene after someone called 911 reporting a gun that was, quote, probably fake. Rice was shot in seconds after the patrol car pulled up to the scene. Opponents, they view themselves as down, if this is the world series, they are down 32, and they need a win today just to stay alive. Otherwise, they think the president and the republicans could take it all today. And is it i mean just how strong is that opposition . Im just wondering, if youre opposed to something on principle, doesnt matter how much youre talked to about it youre going to stick to those principles. How strong is the opposition to tpp amongst some on capitol hill democrats . Its very strong jose among the liberal wing the labor friendly wing, labor unions have gone all out. They said they want to expend every last bullet they have fighting this thing to make it painful even if it passed. There are a group of democrats on the middle who have not come down one way or the other, those are the critical votes president obama will be going after. You can expect a lot of oneonone lobbying, a lot of attention from the president which typically has not happened. This is not a president who spends a lot of time on capitol hill who has developed those rip relationships with lawmakers, and here hes coming with hat in hand asking them to make a tough vote to get his key legislative accomplishment over the line. Were watching what happens on capitol hill. Now to developing news out of lose and what could be a major day in the case of three prisoners known as the angola three. Albert woodfox who has been held in a Louisiana State penitentiary for more than four decades could walk free as soon as today. His 1973 murder conviction of a prison guard was reversed last week, woodfox the only member of the angola three still behind bars. We bring in mark potter who is in louisiana, just north of baton rouge where woodfox remains behind bars. Give us the context of the story. Hey good morning, jose. Were outside the parish jail where Albert Woodfox is waiting the decision whether hes going to be released after spending 43 years in a small cell for a murder that he says he never committed. He was convicted for the murder of a prison guard, but both of those convictions ss were overturned, then a federal judge said too much time had passed witnesses were dead little physical evidence, that he should be released. However, the state disagreed with that, is filing an appeal and asking that woodfox stay in jail for the length of the appeal. His attorney though says hes in poor health. He needs to get out for proper medical care, and he has endured decades of inhumane treatment. Lets listen to the attorney. I dont know of any other prisoner in America Today who has been held in 23houraday lockdown for over four decades. Thats an extraordinary amount of time. Theres no harsher punishment in america than that. So he has been harshly, harshly punished for decades for a crime we believe he did not commit. Now, his lawyers and supporters say woodfox and two other men known as the angola three, were all falsely convicted of murders in the 1970s and were targeted because they led a black Panther Movement inside the jail protesting harsh prison conditions. The state says woodfox is a violent criminal he was twice convicted, three times indictment and despite the cases being overturned he was never found not guilty. The widow of the slain guard says she believes woodfox should be released for the lack of proper physical evidence but his brother says that does not represent the view of the family. So we wait. The court has until 1 00 central time to make its decision. If hes released hell come out the door there behind that van, and were here waiting. Jose. Weve heard quite a bit from District Attorney andrew wylie as he stopped here at the checkpoint this morning. He also told us there had been an investigation within the past 12 months into Joyce Mitchells relationship with one of the inmates, david sweat, one of the escapees, david sweat. We know that theyve been looking at her relationship with richard matt. But david sweat, there was a complaint apparently from a guard in the prison that they seemed awfully close. The investigation went on. The two were separated, their shifts were changed in the tailor shop so they wouldnt be in the shop together but there was no evidence found to support the claim or the complaint, so nothing was done. It was all handled inhouse in the prison. The d d. A. Said he didnt know about it until the investigation began. He said mitchell gave only marginal information at the beginning of the questioning but has given more information, more helpful and useful information. He did say she gave some contraband. Wouldnt go into what it was. We do know also she was supposed to be the getaway driver and because of the fact she did not show up because there have not been reports of any hijacked cars any hijacked trucks they believe these men are still relatively close and on foot which is why the search is focusing on this area on an area about 30 acres big southeast in a Triangle South of the prison. Were sort of at the southeast corner of that triangle about eight miles away. This search has resumed this morning after getting the strongest leads yet in this area where bloodhounds picked up the scent. Theyre hightech, theyve got helicopters in the sky. High resolution on these helicopters. They can read a license plate at 2,000 feet. At night theyre looking for heat patterns with infrared light. During the day theyre also using lowfashion, lowtech techniques, those bloodhounds sniffing out the scent, hoping theyll get closer to these guys very very soon. Reporter authorities overnight arrest aided a man theyve been questioning the last few days. His name is nicolas rovinsky. Hes 24 years old, and hes now been charged. The charging documents give a little more detail about this plot Authorities Say was under way in boston to attack Police Officers. What they say is that three men, rahim, the man at center of this his nephew david wright and navinsky originally was having him behead the woman in texas. But rahim got up last Tuesday Morning and decided he was going to attack Police Officers instead. That was a fiveminute phone call. Police say it was wire tapped. According to new Court Documents, rahim said in that conversation, you know, i just want to meetal allah, because i know the afterlife is better than the worldly life. When police went to his home, they found a living will he had signed in his bedroom, and in his living room his laptop computer was run ag programning a program that was meant to override documents, in other words, not to leave a digital trail. The other person involved in this plot will be appearing in federal court in boston. Thats navinsky to face these new charges, jose. Even though there were three of them involved only one of them was going to carry out this violent attack the other two were supporting him on that . They say ultimately they think that these two pieces of legislation will pass but they also say its going to be a nail biter. He was saying really gruesome type of things. So again, its one of those things that the jury is going to have to weigh both sides. The defense, indeed is trying to humanize him. They showed a photo of him with his exgirlfriend together pointing out that he baked a chicken for a valentines day dinner with her. That, again, is that going to have an impact a real impact on the jury . Humanizing him at this point, the defense hasnt even started their case so theyll be putting on a lot of evidence with his Mental Health history. And obviously, listen valentines days these are just a couple dates or incidences. These have nothing to do with what was going on in his head. Yes, theyve tried to humanize him, but they havent started their defense yet, and i think youll hear a lot of things that are not normal that he does have moments of clarity, and where the defense goes with this is going to be interesting, because theyre going to go way back to suicide attempts theyre going to talk about the medication that he was on jose but at the end of the day, we have a lot of gruesome deaths and horror and a sixyearold that was murdered. So where the jury goes with the Mental Illness is going to be an interesting question for these juries. Karen, i also want to ask you about the ruling in the tamir rice case. A judge in cleveland says its probable cause for the prosecution to charge two Police Officers in that shooting. Is this an advisory opinion and what does that mean . Its so interesting, jose because in cleveland they have citizen participation statutes which allows a citizen, a private citizen, to ask a judge to review a case for probable cause. And its very unique to ohio. It usually its very rare and not used in murder cases, more minor cases. But it allows private citizens to do an affidavit asking the judge to review for probable cause to arrest. Which is great to the citizens of ohio that they have this. In fact, the statute was way back in 1960. Its not a current statute. And it allows the judge to make a finding of probable cause. Obviously its up to the grand jury to charge. So, therefore, yes, its an advisory opinion and he can issue an arrest warrant and process these Police Officers now, but ultimately its up to the grand jury and the prosecutor whether or not he does get charged. And remember probable cause is just a finding whether there is enough evidence thats reasonable and accurate to arrest a person. But it does put pressure on the prosecutor. No matter what the situation, staff say one thing they must always do is remain vigilant because inmates are like con men, always trying to exploit a weakness. It was inevitable. The escape in new york has prompted prison workers across the country, including here at Iowa State Penitentiary to reexamine the way things are done. We recently had a Restricted Movement lockdown due to an escape attempt in this institution. Do you think thats because they were encouraged by what they heard in new york . I dont know for sure. It certainly well could be. Reporter as in movies like the green mile. Corrections officers daily interactions with inmates are a balancing act. Share too much personal information, and an inmate smells vulnerability. If they know you got something going on marriage is probably on the rocks, anything i can do. Theyre trying to connect. Anything i can do. When they make that connection . They establish that rapport and then use that rapport. Use that power. Bait the hook, if you will. Reporter inmates use everything comparable to catch those in charge especially men over women. They try to manipulate. Its why correction officers watch over each other. The Clinton County District Attorney has confirmed that the woman accused of aiding the two men, Joyce Mitchell was previously being investigated for possible inappropriate relationship.
