And was saying that about the threat posed by isis that we overcome these challenges in front of us and our union is more perfect at the end of it. I think this is really Rudy Giuliani searching for a way to undermine Barack Obamas credibility. It goes back to conservative beliefs that hes not one of us but is not rooted in fact. The defense rested its case earlier than expected today in the trial of Eddie Ray Routh, the former marine accused of murdering chris kyle and chad littlefield. The defense had a psychiatrist testify that he suffers from schizophrenia, and believed that chris file and chad littlefield were going to kill him as part of a world takeover by pigs. Dr. Dunn said Eddie Ray Routh told him when i first got here to jail i thought i was going to be cooked for people to eat. Dr. Dunn who did not meet Eddie Ray Routh until after a year after the shootings, testified he was delusional and believed his neighbor, a police officer, was part of the mexican mafia, that his former girlfriend was half human, half pig, and that pigs were going to take over the world. Dr. Dunn testified there was something really wrong with Eddie Ray Routh on the day of the offense, and that something wrong was a mental disease. He told jurors Eddie Ray Routh admitted that the killings were a mistake, saying as soon as i did it i realized i made a mistake. On crossexamination, dr. Dunn testified that Eddie Ray Routh knew in a general sense that killing is wrong. Prosecutors are expected to call two expert rebuttal witnesses, a psychologist and psychiatrist on friday. Joining me now is diana hunt who was inside the courtroom today covering the trial for the dallas morning news, brian weiss and Patricia Zach a clinical psychologist with the john j. College of criminal justice. Diana, in court today, the defense had a second psychiatrist they wanted to call but who was disqualified. What happened there . He was disqualified, he was put on the stand and the state questioned his certification as a forensic psychologist, and the judge agreed with their concerns and did not allow him to testify as an Expert Witness. So they went with the one expert a psychiatrist who took the stand later. What was your assessment of dr. Dunns testimony . It was an astonishing day of testimony, quite honestly. The pig people and cannibals in the workplace, and human rotisseries. It was a bizarre story that was that Eddie Ray Routh told to him while he was in jail. He said that this is what people who have Mental Illness are like. You may not know it or be able to spot it but thats what is underlying some of these problems. Brian weiss, two things. The disqualification of one psychiatrist, which is fairly unusual. Usually when an Expert Witness is being called credentials have been tested. And secondly what do you make about dr. Dunns testimony and how you think it landed in terms of the legal requirements for an insanity defense . Well dealing with the second part first, lawrence it certainly gets them there. All they have to show by a preponderance of the evidence the fancy legal term for more likely than not, at the time he pulled the trigger, Eddie Ray Routh couldnt comprehend the difference between right and wrong. But the sound bite but dr. Dunns testimony that really impressed me was the notion that he told the jury folks, insanity is not like you think it is in the movies. I think thats something this jury can certainly understand. Turning to the first point, lawrence, it kind of was a rookie mistake for their expert to pretty much get bounced before he had a chance to talk to this jury. Its not like anybody can walk in and say hey, im a doctor. I play one on tv. Its like mark twain said an expert is just some guy from out of town. And before you get to testify, your credentials have got to past the smell test and in this case the judge decided not quite close enough for this jury to hear with this psychologist. Dr. Zaff talk about the difference between the Legal Definition of insanity. Here you have a diagnosis of schizophrenia, but that in itself isnt good enough in an insanity defense. Right. That diagnosis or Mental Illness is a foundational construct that needs to occur. But then theres also a legal test or a Legal Standard typically. And so in this case and many other jurisdictions, its whether the defendant knew right from wrong at the time. Texas has a very narrow or limited standard. So theres not as much latitude in their standard. It must be shown that the defendant did not comprehend, was not able to comprehend right from wrong at the time of the crime. What are you hoping that people might take away from this, what our understanding is of schizophrenia and ptsd . Well these are major Mental Illnesses. Certainly schizophrenia is a psychotic disorder. Its always difficult for us to look back on someones behaviors or actions at a different point in time. Now were looking back and trying to make sense of these actions, which at the time are just not rational. The person is not in touch with reality. They do not understand typically whats going on. Theyre not thinking in a linear rational fashion. And for the rest of us that think in a linear rational fashion, its difficult to grasp that. So even in evaluation when youre speaking to the defendant and trying to get that defendant to tell you about what they were seeing hearing, thinking what was going on at the time of the crime, you know at the time youre evaluating them theyre usually on medication and have their mental state somewhat under control. Theyre in an in touch with reality typically when youre evaluating them. So theyre trying to make sense of their behavior at an earlier point in time as well. It can be confusing and hard to understand for a member of the jury or a member of the pub hick to look back and see, you know how someone could act so differently at a particular point in time and not be responsible for their behavior. Las vegas police in a quiet neighborhood arresting 19yearold eric noush, wanted in connection to the road rage death of 44yearold tammy myers. The suspects vehicle caught on surveillance tape may have helped lead investigators to his home. The real takeaway here is that the suspect involved in the killing of mrs. Myers is in custody and off the streets. Reporter she was taking her daughter home after giving her driving lessons when the road rage incident occurred. The mother of four dropped her off at home and picked up her 22yearold son, who was armed. After finding the suspect, the suspect tailed the myers home where he and her son exchanged gunfire. Reporter today police made the arrest one block away from the myers home while her husband watched it unfold. They treated my wife like an animal, and my son. Theres the animal a block away. I couldnt tell you this before. He knew where i lived. We knew how bad he was, but we didnt know he was this bad. My wife spent countless hours at that park console thinging this boy. She was really good to him. She fed him. She gave him money. She told him to pull his pants up and to be a man more times than i can count. Las Vegas Metro Police say they are still looking for at least one more suspect. Joining me now is former atf special agent jim cavanaugh. And back with me defense attorney brian weiss. Jim cavanaugh, it doesnt seem as though the police have indicated in that gun fight that turned fatal who fired the first shot. And does will that matter in the investigation . I dont think so lawrence. Certainly Defense Attorneys will race that issue and try to make him a selfdefense candidate, but the shooting happened at ms. Myers home after this road rage incident. And if you look at the facts and listen to the Police Commanders they clearly believe she was the victim. She left the home, dropped the daughter off, picked the son up and left to go to try to find the car. But only for five minutes. So its quite possible that she thought that eric was involved because she knew him and he didnt have a vehicle. So she might have said lets drive around and see if that car is around the block at erics house. They were only gone five minutes when they drive by possibly eric and another sees them follow them home and the shooting happens. Shes the victim here she didnt do anything criminal or anything wrong. Maybe sometimes its a good idea not to do those things and mr. Myers said it was a mistake. But certainly nothing criminal and its murder and thats what he will be charged with. Brian weiss, what do you make of the fact pattern in this case in terms of how it began, and then how mrs. Myers deliberately went and picked up her son with a gun and continued whatever it was that had begun . In retrospect its easy to say that decision certainly wasnt the brightest thing that could have been done at the time. But at the end of the day, they believed they had the right to go out and do what they had to do to seek out some type of reconciliation or to try to figure out what they could do to maintain their own safety. I agree with jim, i think the defense is going to have a difficult road to hoe in getting any traction at all with selfdefense. Were taught the first day of law school you cant provoke difficulty and claim selfdefense. While this defense will be charged with murder the best Case Scenario might be voluntary manslaughter that is the shooting occurred during the heat of passion when the bullets started flying. I think jims right, i dont think this is going to be your typical selfdefense defendant that catches the elevator when its over, lawrence. The legalities of this aside and the upcoming trial aside, theres some pretty obvious life lessons here about how to handle yourself in a situation like this, and if you find yourself behind the wheel getting a letle enraged and engaged with another driver. Everyone in this case did everything wrong that they could possibly do wrong. Right. We all sympathize with mrs. Myers because were all drivers and weve all gotten mad behind the wheel. But get away from it if theres an incident of a threat or accident call 911. The police have got to find the gun, theyve got to find the confederate. Theyre looking for the other man. They think the man they arrested is the trigger puller. When they get the other guy, hell tell the story. The 15yearold is the witness as well, the son. So theyll wrap the case up. Hunter moore hosted a website as a form for people to post revenge forn. He posted apong other things nude pictures of victims, being submitted without the persons permission. To obtain more photos, to populate the site moore allegedly instructed an accomplice to gain unauthorized access to in other words, hack into victims email accounts. Moore then posted the illegally obtained photos on his website without the victims consent. The indictment alleges that email accounts belonging to hundreds of victims were hacked. The king of revenge porn faces a mandatory minimum of two years in jail but could be sentenced up to seven and pay 500,000 in fines. Mitch, we talked about these issues before. Whats interesting about this particular prosecution, hes not actually being prosecuted for running a revenge porn site. Its actually a more basic kind of crime that he got caught. Just explain that. Thats right. I think this indictment and the guilty plea is important, but its an indirect attack on the revenge porn issue. Mr. Moore was indicted for hacking into peoples computers and paying people to hack into peoples computers to steal the photographs. He was a pioneer if you will in the revenge porn industry. Right now, its become so popular, theres no need to pay anybody to hack into peoples accounts or to hack in at all. People voluntarily go there and post pictures that theyve located themselves either by hacking or not. And so the operator of the website itself doesnt have to do the types of activities that mr. Moore was indicted for and that he pled guilty for. So this is its important, but i dont think the importance should be joseph stated in terms oh of the problem of revenge porn as a whole. The reason is so if somebody posted eded deflam toir article, the owner is not going to be held liable for that the person who posted it is. The problem with the revenge porn sites is they deliberately set out to make it impossible to determine who posted that information. And they go ahead and they passively host this. They invite people to post the pictures. They make it easy for them. They refuse to track the identity of the people posting, then claim theyre immune under federal law. Theyre technically right. The law, until its changed to remove that immunity, these attacks based on criminal prosecution of mr. Moore or the state laws that are being enacted to go after the people who are doing the posting, theyre indirect ways of attacking the real problem, which is these website operators do it for fun and profit. And until you take away the fun with prison terms and take away the profit with financial liability, theyll continue doing it. Mitch, could you rewrite the law so that it would make this kind of website impossible, but not harm not do any harm to all the rest of the websites out there that have input in them from users, that they do not control and that could then also possibly get ensnared . How do you adjust this law . The easiest way is to carve out websites that host sexually explicit photographs without the permission of the people being depicted. That would leave free the website that mosts product reviews or other posts where people might say things that are defamatory or otherwise. We have a lot to share, and a lot that we can benefit from and i hope that this is seen as we see it as a bipartisan effort that should be embraced by the two countries. So thats the big main event. So everybody is kind of frantically playing their part to try to move this along. And theres a lot of pieces that have to happen before that april summit. And the dynamics seem to be very much two way, when i watch senator Claire Mccaskill go down there, the video was, shes trying to charm that island into buying everything missouri makes. Its all about agriculture, but theres already an agricultural opening to cuba. So when you see nancy pelosi i dont see someone who needs to be sold on opening up our relations with cuba.
