We begin with the House Democrats on offense hitting hard against the trump team efforts of what they call stonewalling the probes. Plus a new release of a voicemail that reveals Donald Trumps own criminal defense lawyer trying to get a heads up on whether Michael Flynn had evidence that would implicate the president. Democrats pushing ahead on their aggressive plans as they face what they call a stonewalling. Theyll hold attorney general barr and don mcgahn in contempt. Thats not all. Theres this new report that theyll grant other Committee Chairs the power to go to federal court to enforce any subpoenas. That could be the Mueller Report, evidence from barr, future subpoenas. So it is another way that were seeing the escalation of this inner branch war even as the larger question over whether the impeachment questions, the impeachment debate is up or down. Heres a clip. Also new. Speaker pelosi, shes dialing up her rhetoric telling senior democrats that while she may not be for impeachment now, she wants to see donald trump in prison. Pelosi saying that impeachment was unlikely to come any time soon. She controls whether that would become real. She wants democrats to focus a longer term alternative. You have the Justice Department policy that a president cannot be indicted. And then separate from whether they repeal policy, if a democrat does defeat trump, what you have is the speaker of the house openly suggesting that after his presidency, maybe he should be prosecuted. Maybe he should be jailed. Thats tough talk and trump responding in kind in a fox news interview. This was part of the war cemetery discussion. Part of the normandy 75th. Nancy pelosi, i call her nervous nancy. Nancy pelosi doesnt talk about it. Shes a disaster. Shes a disaster. Let her do what she wants. You know what . I think theyre in big trouble. If the democrats are in big trouble, that raises the question of why theyre stone walling in the first place. Why not just get this over with and provide the witnesses . This was a very stressful hoth time. Reports were out that he would make a deal with mueller. Today for the very first time, that voicemail is up. Let me see if i cant state it in starker terms. It wouldnt surprise me if youve gone on to make a deal. If on the other hand, there is information that implicates the president , then weve got a National Security issue. We need some kind of heads up. Margaret, youve been covering a lot of these characters over the years. Rarely do you get that private recording. What do you read from it . What do you see in the atmosphere . Hearing it like that, its chilling. It sounds like something that could be in the sopranos where you say, you were our friend but you might not be our friend anymore. It could create a National Security issue. All the times when the white house has tried to dangle favor, pardons, anything to keep people silent is a disgrace. And now theyre doing it by ignoring subpoenas. And forcing democrats in this case, and i dont think they need to do it through impeachment. I think the tools that democrats need are available to them by other means. You this the judiciary committee, through oversight committees, and to use the contempt method, if they dont, thats how they have to enforce the subpoenas against people who are really not under trumps control anymore. Don mcgahn had his heroic moment as youre reading the Mueller Report. And i assume he would testify. But hes been intimidated by trump into not testifying. The same with hope hicks. So we have to hope theres a branch of government left. The senate is amoral. Not going to do anything. Dont count on them. Theyll never impeach. But the judicial branch, there are judges who will still do the right thing. Take a listen to senator warren. Donald trump as president , delayed, moved, fired, did everything he could to obstruct justice. If he were any other person in the United States, based on what is documented in that report, he would be carried out in handcuffs. Is this the new democratic message instead of them actually doing what one would do if you thought someone should be carried out in handcuffs . Which is go forward with congressional remedies . Senator warren is consistent because shes come out for impeachment. If nancy pelosi believes this is criminal conduct justifying jail, doesnt i justify an impeachment probe . I think the strategy here is lets be strategic. Lets get it right the first time. Bucks shes opened that flood gate with impeachment proceedings, there is no taking it back. What pelosi is fully aware of, sure. There might be success in the house but the senate is a graveyard. As weve seen, for any positive legislation that House Democrats have put up. The other thing about senator warrens statement that springs true, no one is would have the law and that includes president trump. So let me press you on that. Youre in washington. Youre dialed in. Im not saying thats the same thing. As you articulate some of the analysis and the rationale, doesnt the counter argument become, is this the democrats version of lock her up . I mean, there was a judicial legal process. Weve covered it extensively. It did not result in an indictment. Whether you like it or not. The next step would be does Congress Want to deal with it . If the speaker doesnt want to go that route. She has every right to explain it. If she is making prisonesque, jailesque references, does she risk, i ask for your analysis. Does she risk getting close to a lock her up type thing . It doesnt deal with the evidence. I think shes not moving as quickly as some would like. In the conditions in which she would like to move forward is with one, a lot more buyin from the general public and two, some bipartisan support. I think shes dealing with it as they ramp up the Committee Chairmen and the ability to file suits against people who, and hold people in contempt of congress had a choose to not abide by subpoenas. It is being handles but not in a way, with the you know ency that a lot of people want to see. Do you see it as risk of lock him up . Yes. And just as silly. It is a chance theyre not willing to go through. You have nancy pelosi saying we have a monster here. And you can use holy water and garlic but dont use the Silver Bullet. Even if we have him in the chamber. It makes her leadership sound weak. Im down here. I saw a speech by maxine waters. She led the entire audience in a chance of impeachment 45. The base wants to see this process. Nancy pelosi is speaking against her own leadership. It is certainly not one that people are agreeing with. Im saying, shes just saying, lets not jump to that Silver Bullet yet. There are still some things that need to happen. Shes just moving strategically. Everybody is saying, cant get the public involved until you begin impeachment proceedings. We dont have to go back and repeat again. You cant get public involved. She is constantly moving the goalposts in ways that dont make sense for anyone. And putting them on the line and republicans have to say, during, right before an election year, this is why i want to keep a president who is engaging in possibly illegal activities in office. Thats the greatest Campaign Slogan you can have. And she is denying that to the country. Hearings that are televised will get public buyin. I think the hearings can be done. Look what trump did with the Mueller Report. He exonerated himself. He had the help of william barr. This is the part of the movie where you find out the Police Captain is on the take. So barr did everything he could to help trump make the case. So the public, at least a portion of it, think that trump was found innocent by the Mueller Report. He said no collusion and i was exonerated. Imagine what he would do if the senate relieves him of impeachment. What he will do with that. He will have been a martyr and he will declare himself innocent. That will not help anybody. If you know, it makes it worse for democrats going into the election. To have trump have that in his pocket. Hes been caught doing all sorts of inappropriate activities and he will exonerate himself. Heres what we learned from all cop films. The departed. If you take too long, the hero ends up dead. Because they were not aggressive enough when they needed to be. This sort of tepid nonsense. We cant do this because trump will take it another way. He was out there attacking john boehner and calling him hostile. And during the rnc he launched this attack on Mitch Mcconnell. He is the least favorably considered senator in america. He is loathed among by the republican grassroots. Loathed. Cuccinelli blasting the most powerful republican in office and his turn against trump was seen as a real effort at the time. Covering him as the leader of the floor fight for a lastditch effort to derail trumps, even talking about how the party rules were unfair. You violated the rules in e the. He didnt give, its petty. He stressed this is about rules. Insisting this is a key moment. That trump was not even a conservative. This may be living a recurring nightmare for donald trump. It is a recurring claim. He likes to say hes the only conservative. Not trump, not mcconnell. At the convention, you know he did not prevail. Ted cruz is not president. Games that were too much for even donald trump jr. Im not going to do this. The same Group Running around. They take their credentials and try to dramatically throw them on the ground. Are you calling him an idiot . I say they look like idiots when theyre doing that. After that loss, cruz marched out and told them on vote their conscience. This is about what he said. So i want to pause on this. This is 2019. Politicians dont even pretend theyre making the decision on the merits. The immigration policy is important but not as important as what you said about me, they might argue. Or as important as backing a different republican in the past election. This is supposed to be a democracy. It wont work well if the pickup truck for opposing someone is never allowing them into public service. There may be logical objections to cuccinelli. Thats just not one of them. Mcconnell controls the senate floor. He could deny a vote. Just ask merick garland. Let me tell you this. If im still the majority leader of the senate, think of me as the grim reaper. None of that stuff is going to pass. None of it. So another bare knuckled arena. In this one, mcconnell may actually fail. The white house is prepping to do an end run and have an acting role. Avoiding the fight with the gop. Congressional republicans have ceded a lot of power to trump. They surrendered oversight or funding powers that might restrict the reliance on the secretaries. I want you to know that our temporary leaders impose the pentagon, Homeland Security budget, even trumps own white house chief of staff and across the government. So maybe republicans dont care about any of this. And they want to keep him out because he was mean to them. Maybe it wont work well in the long run. Now he may be bludgeoned by trumps tactic. A man who would assume these acting powers is not exactly known for being restrained or conservative about federal power. Mr. Cuccinelli has advocated for war powers, like controlling migration. And it was that war footing he invoked accusing obama of an invasion of immigrants. He backed something that could literally be unconstitutional trying to end the tradition that people who are born here are citizens. And he once compared immigration policy to pest control. This is the person that Senate Republicans oppose for other reasons and this is the person, if you havent heard about it, because theres a lot going on. The special counsel is a very, very fragile construct. That it could disappear any moment. The memos are a series of questions. Can the president of the United States unilaterally fire the special counsel . And lets read the answer. It was clearer than some of the other things mueller has said. Heres the answer. The president could fire the special counsel directly and you say that was the moou office conclusion. Right. That was different. All the discussion that you had to go through rosenstein, a set of layers. And the special counsel, this memo concludes not necessarily. One of the other interesting things is what happens to the work product of the special counsel if the special counsel is fired . And the answer is, it is unclear. It could be shredded, gone. So there is a very, reading through this, you come again to the conclusion that they were aware at every moment of the day. And remember, every moment of the day donald trump is threatening them. Theyre aware it could result in a constitutional crisis. And to your point, donald trump is doing in public what past president s would only do in private. He is musing about pardoning himself and others. And you say, muellers office concluded the president can pardon his family members or Close Associates even for people of impeding an investigation. One of our experts said, this sounds like people in muellers office trying to explain why they were not more aggressive. And i dont know if that is what it was but i would rather look at it with what i have. If this is the situation. If the special counsel is as exposed as this, then perhaps if youre bob mueller, if you see your job as defending the institution, rather than first prosecuting the president. Then you might well say, better to give donald trump a slight pass on this. This is fascinating. There is the memos and then the larger depiction. The memos, some may not believe you. The larger reporting, i read the whole book. It left me with the impression that your collective account was that for all of the basically, the excitement around the mueller probe, there was inside it a great deal of consternation or even legally required weakness. I came to the conclusion that one of the missions, the primary missions, became not to be fired. Not to be closed down. Was that a mistake . I dont know. In a world you would say, thats the alternative. Donald trump literally creates, as i say, the mother of all constitutional crisis. End of the world style. Or you run this out im reading into what he probably thought. That donald trump will pass. Donald trump will pass. So when you say it that way, people do understand that interpretation. Because mueller certainly seemed like someone playing by the book and not trying to overshoot or be too aggressive with the president. Ive always thought it would be interesting to see if there is someone else in this role rather than bob mueller. I thought what if in a different world, Rudolph Giuliani had been the special counsel . No doubt in my mind, he would have indicted him. Your first book was quite influential and had a lot of detail and back room detail. In this book, you seem to sketch a paradox. Where on the one hand, donald trump and his team are inexperienced and often undisciplined. But on the other hand, when it comes to selfpreservation, donald trump is quite canny and you show that basically, you show he got where he needed to get with the mueller probe. Is that right . Everybody pointed out again and again, hes been in litigation almost 45 years. His whole life. Its not real estate and business. It is fighting legal battles. He spends as much time in court as judge judy. It is little rally him running lawyers in a way that is either absurd or possibly brilliant. Was he underrated . I think that Donald Trumps version, his approach. One of the things toggled between. The story of donald trump. Richard iii, is it shakespearean like that or is it Beverly Hills go to washington . And i kind of think there is that beverly hillbillies thing. The whole institutional establishment approach in conventional ways. Your book lands at an interesting time.
