Those charges but also admitting to a whole lot more. And legally, thats very important. What im about to report here are activities that as of today, brandnew breaking news gates t admits to and that means he can testify about them against other people. And now Paul Manafort has been hit with more charges, which include lying to federal investigators. These men were partners both in business and in donald trump land. He is in a sense the last one standing but with a lot coming at him. Gates agreeing to cooperate fully, to turn over all documents and potentially to testify in court. Mueller already had a ton of evidence on Paul Manafort, whats different tonight, he now has cooperating incooperating, alleged coconspirator. But it also tells you that mueller is staunchly defending the institution he loves and spent so much of his life working on behalf of the Justice Department and the fbi, going to lengths to include in this plea bargain for gates the requirement that he plead guilty to lying to the fbi during his investigation. Mu thats a message that goes out to anyone whos being investigated in this probe. He will go after anyone who lies to him. Bill, i often talk about both sides of the case, this is one of those where theres no other side left, hes confessing, admitting, pleading to spooer conspiracy to the united states, and Paul Manafort says, n notwithstanding that rick gates pled today, i continue to maintain my innocence, this does not alter my commitment to defend myselves of these charges. Rick gates, one side of the story, how do you view the pressure mounting on manafort tonight. Im thinking what do you think donald trump is thinking . I think donald trump is thinking this is getting awfully close, i have got to think either moving against mueller on the one hand, or pardons on the other hand. I think kushner is the key now i suspect. I suspect that mueller wanted to send the signal to kushner, who i think has only spent an hour or two with mueller, if im not mistaken, that if and when he chooses to testify, that lying will be taking very seriously. I dont know if kushners lawyer will allow him to testify, he may say, this is a trap, theyre going after my family. Remember, trump said months ago, that was the red line. Maybe im wrong, maybe this will play out, maybe trump will passively watch it and be quiet about it and tweet about it. Hes tough when hes cornered in a way. I cant believe hes going to not touch this unspooled, i think he will react. Do you think hes afraid of what gates and manafort know about him . Yes. Hes also worried about what manafort and gates can testify about those close to him. Do they have the who else in their inner circle can they talk about because remember they were both involved during the convention when there was the weakening of the Republican Convention against russia. And that was the first time we saw it and they may know more details about who was involved and what was traded for that change in the republican platform. So i agree with bill. You make a great point there and it echoes in what we have seen today. Saying Jared Kushner was not pay, well manafort was not paid. There are people that are unpaid but have debts because of their own conflicts. This is a show i have to say journalistically im very excited about the all the experts we have. But lets look at who gates was as a member of the Trump Campaign, he was there you can see it on the stage at the rnc convention, you can see him there with donald trump, and they were on a firstname basis. We have a group of people that really wants to win, and i think knows how to win. Pmanafort brought gates in ad you will see him here being touted as the core four. The core four, Paul Manafort, rick gates and myself are the core four. Im thinking two things, first of all, i think this has been a week in which we have seen mueller really flex his muscles when gates struggled a little bit. He sent a message to manafort and gates that if they didnt tell the truth during the plea bargaining session, hes going to go after them. The other thing that strikes me, th this is this week, last week it was 13 people talking about the russian troll factories in petersburg. We havent even had the conversation yet on the russian hacking of the election, we havent seen roger stone yet, we havent seen the people involved in the collusion yet. George popadopoulos pleaded guilty, he has nothing to do with manafort and gates in this particular story. So if im donald trump, i dont just see one superhighway leading at me, im at the center of a round about. Theres six or seven or eight roads, im in the center of all of them and muellers message is, im coming, im coming with both guns blazing and i am going to use every tool available to me to ensure that when i get to you, youre got. Wow. And you know, rick stengel, and david rothkopf, that was this week, this it was a lawyer, last week it was the russians. This thursday is just as important as last thursday, which is almost a spiritual level, but makes the point that at the legal level of the heat, muellers not done and next week could bring more surprises. Im a little mystified about the focus on manafort and what im going to do is commit some geo politics here, and put it in a very larger context. Because what manafort represents is a connection to Vladimir Putin. Because manafort and gates worked for Viktor Yanukovych, who was the president of ukraine. What did Viktor Yanukovych start. He started the great revolt in ukraine against russia, why . Because he wanted to veto legislation that would have put ukraine in the eu market as oppose pd to what russia wantedo go into the russian market. Viktor yanukovych was a pawn for russia. Reading for you again, this brandnew material we just got. Because youre Digging Deeper into why this is so important. Youre looking at what gates pled to, directing these companies to lobby members of congress about the quote, inpropriety of the ukraine president symbolling his rifle. But i think going back to ricks very clear point, this investigation is at its core about a bigtime war that Vladimir Putin is waging against western democracy. Right. And he was waging it in ukraine and hes waging it in europe. Hes involved himself in other campaigns, whether its in france or in austria or the campaign involved with brexit, or perhaps now in italy. What he looks for is people he can have leverage over, people with legal problems like manafort, people without values like manafort, potentially like Jared Kushner, potentially like donald trump. People who have leverage and hes trying to use that leverage. At the end of the day, the trump people could say we were just being used, we were just duped. Donald trump was running for president of the united states, the people around him should know better. And they essentially put themselves in a position to be used and all this other stuff that they do about ethics, where they say youre not going to see our tax returns, youre not going to see who were doing business with, were going to keep doing business with some of those people, open them up further to this kind of blackmail. Lets take your point and pass it over to joyce vance to bring it home as i know joyce is so good at doing intellectually. Because joyce, david just committed to a phrase, people without values, and that itself is a value judgment. Walk us through the difference between that which people from both parties who have done some very unsavory things have done things on behalf of putin and muellers probe not whether someone might see it as a values deficitor whether they lied in a federal investigation, or they committed quid pro quo for government actions. Trump aid rick gates pleading guilty to lying to muellers investigators on february 1, 2018. Thats just three weeks ago and its months after mueller had charged gates. So thats sort of funny, right . Heres a new crime that gates committed, he admits that after mueller charged him. Typically your lawyer wont even let you talk to prosecutors after you get charged, but this came during gates attempt to cut a deal with mueller, during whats called a proffer meeting, where defendants tell what they know during a queen for a day interview. In a queen for a day interview, a defendant can typically admit to crimes with little additional consequences, unless he or she lies. Rachel says it perfectly there, you can admit to any and all of your past crimes without lying in order to show the goods you might have on other people and prosecutors agree not to pi punish you, but you cannot do what rick gates did, lying in the proffer session with his counsel at muellers office. Also breaking tonight, im going to turn to my nexting panel of guests, the Washington Post reporting that the top Justice Department official alerted the white house that theres issues in kushners security clearance. He said Additional Information would require Additional Investigation and would delay kushners clearance. Let me tell you how this works. The call two weeks ago, rosenstein whos bob muellers boss and oversees the probe, trump says this about the issue. We inherited a system thats broken. Its a system where many people its taken months and months and months. Its a broken system and it shouldnt take this long. That will be up to general kelly, general kelly respects jared a lot and hell make the call, i wont make that call. Professor, no shortage of problems over there. Yeah. Im going to read this specifically from rod rosenstein, who called don mcgahn, who is the person who reportedly threatened to resign when trump asked him to get mueller fired. In the call rosenstein did not say whether the information that had come to the attention of the Justice Department was learned by the fbi in its standard background check of white house staff. Translation, this may be information thats come up through the mueller probe. Yeah, so on the one hand, ari, i kind of feel like my mind is playing tricks on me, because this is surreal. I mean this is big. Your mind playing tricks on you, youre raising the stakes for bill crystal to have to make a ghetto boys reference and i dont know if hes up to that. Easy, easy. But on the other hand, this is something we should have expected, right . Donald trump came into office saying im going to drain the swamp and one of the first things he does is he makes moves to put his soninlaw in a position of power which you just dont do. This is an administration that has no problem flaunting the norms, the things that bind people what i would really be concerned about is the fact that he may have had access, for a very long time to classified information, issues which raises issues of National Security. Which is a great point. Bill, lets put the law aside and talk about the National Security implications combined with the fact that donald trump is forcing his chief of staff to do what apparently he wont with his own family member. This doesnt seem like an ideal way to deal with protecting classified information, which you may recall was a big issue in the 2016 campaign itself. We wont know what john kelly necessarily does with kushner and his access, and that will be a bit of a black box unless it leaks out or they make some kind of announcement. But when you talk about rosen ste rosenstein making the call, they go all the way up to the deputy general level, to make the clearance, but if its taking too long, thats a conversation between the fbi Deputy Director and the white house counsel. Thats not a conversation for the Deputy Attorney general, why would it be . Hes not micromanaging the clearance process, hes interviewing people who knew kushner before he came to the white house. Youre saying what were getting at, go ahead. I think its quite possible that what the significance of the rosenstein call and he placed the call to the chief of staff, it got bumped over to mcgahn, i guess kelly was in a meeting or something. Is that material was developed by mueller in his investigation that made kushners clearance even more problematic than it might have been. That makes me think this is coming to a head pretty quickly, kushner seems to be a major figure now, along with manafort, and i come back to trump is not a passive guy whos going to sit there and let the net get snared around him, i dont think. I worry about rosenstein and mueller on the firing side a. I think this is just more evidence that we have a problem that starts a it the top, we look at leadership at the top and we look at what people at the top are doing and we look at what donald trump is doing, and hes not just setting a precedent in establishing bad behavior, but hes flaunting it and so are people on his team.
