Humanitarian and medical assistance, new technology, the democrats need to come to the table and start negotiating. Documents provided by this administration to congress, that nbc news has obtained, show that on the southern border six immigrants in a sixmonth time period were encountered by u. S. Officials who were trying to enter the country. On the northern border, the number was higher. Youre not talking about a wall or a barrier with canada. Wa whats the difference . Were now seeing 60,000 people a month attempt to come into our country illegally on the southern border. With regard to terrorists, weve seen more than 4,000 known or suspected terrorists attempt to come into our country through various means. On the southern border let me stop you on that number. It is a misleading claim thats been fact checked, as i believe youre aware, because that number is for all ports of entry. It is from all ports of entry. On the southern border, last year alone, 3,000 special interest aliens were apprehended trying to come into our country. Which former president s told President Trump as he said that they should have built a wall . All their representatives denied that was the case. Well, you i know the president has said that was his impression from previous administrations. Previous president s. If the president wants to call a National Emergency, it will be if the president , frustrated by congress, could declare a National Emergency and go around congress, we would have seen this before. Become obama would have declared a National Emergency on health care. Obviously he didnt because he couldnt. Breaking news on the russian lawyer connected to the now infamous 2016 trump tower meeting. Federal prosecutors in new york city have charged her with obstruction. The indictment lays out just how tied into senior russian golf officials she is. My goodness. We have a lot to cover. Were going to get to the shutdown and President Trumps fake stats. I say fake not to be sassy, but i say it because thats what the president , sarah sanders, and even mike pence misrepresenting numbers. Thats exactly what they are. Fake statistics on the southern border. We have got breaking news. This involves a russian lawyer who was present at that Infamous Trump tower meeting. Natalya has been criminally charged with obstruction of justice in connection with a civil Money Laundering and forfeiture case. Separate and apair from the investigation into trump tower and the trump campaigns connection to the russians. She is believed to be in russia. Shes named in an indictment that was unsealed in a new York Federal Court where she is accused of filing a misleading document relating to a Money Laundering case. The indictment receiferences documents first reported exclusively in an nbc news report in april of 2018. Joining us now, nbc legal analyst mimi roka and reporter tom winter. All right, tom, i start with you. What . This whole case we could spend the next hour of your show going over what is this Money Laundering ali thinks its a painkiller. What is the magnitsky act. But the bottom line is this. A woman who was somebody who was billed as somebody with close ties to the prosecutor is attended the meeting with donald trump, paul manafort, all the people just laid out. There were a lot of denials she was actually that well expected to anybody in official russian government and now we know from todays charges which do not reference and have no ties at all, we see here in these documents, no ties at all. But it does say that she definitely has ties to the Russian Prosecutors Office because she helped draft and put together documents which their assistance. Its kind of like youre teaming up with the russian government in the case where it wasnt advantageous for her. Its a little bit bizarre. It certainly does underscore the fact that she has official russian government ties. I think for the purposes of our discussion today, thats ways important. What are you going to say on the subway . If someone asks you . Maybe thats the question. People are going to say, oh, the only reason we know is because of the conversations we. We know she attended the meeting at trump tower. This doesnt speak to any of that. It does speak to the one thing. Even when nbc spoke to her after that trump tower meeting, she had initially denied having any ties to the russian government. The part that strikes me the most is that we now know that or at least the implication from this indictment is thats just not true. Right, ali. I think a couple of things. First of all, i dont think it should be lost here that what the Southern District has said is that this is a charge about someone submitting a deliberately false declaration, really very calculated way, obstructing justice in an ongoing case, and that is something that they couldnt just let go. Once they had the evidence to prove this, they had to charge this. She now cant come back into the country. Maybe she tries to work something out. Maybe she doesnt. But if they hadnt charged it, you know, she would be free to come back here. This is about the integrity of the courts which i think is an important point to note. In terms of the broader picture, it shows first of all that she has zero credibility. She has said not only that she didnt have ties to the russian government, shes also said that trump tower meeting was not about discussing sanctionings. And shes just not a credible source for that. If she ever was this really proves it, that shes not. I think as tom said, this is complex. We could spend a lot of time talking about the intricacies of this, but there is a tie to the trump tower meeting in that she was there, but these facts that underlie this obstruction are about, you know, her schemi to protect the government officials that comes back to magnitsky, whos behind the magnitsky act and is sort of purported to the subject of the trump tower meetings. I would see a building up of this case. Whatever evidence theyre putting that on, if thats something he needs. If its a brick in the wall, that case against whom . If its only about one trump tower meeting that jared and donald trump and so on and so forth attended. And there was no further contact or meeting. Because remember, don jr. Always says we said there was going to be something and we never met again. What does that mean then for all the cohorts i just mentioned . I think it raised the question, if there was any further contact. So far, we havent seen anything. They all have denied if it turns out to be a bad egg and they said we never met her again . Then thats fine. Thats where the case lies. I think what shes alluding to, if this is a brick in the wall, then you have a situation where youre basically building a case that says look, this person is much closer to the russian government or is russian government essentially. And so youve got to look at that meeting in a different light. Or you may have to look at any sort of followups in a different light. It may have nothing to go along with it at all. Really have a problem where we lie and misrepresent yourself in federal courts. You know what, youre going to face the music for this. So it could just be as simple as that. The first claim, terrorists come across the southern border. The president and the aides continue to say that terrorists use the southern border to enter the country undetected. A wrbriefing released by the whe house included this slide. Now if you look at everything on this slide, it talks about the sou sou southern border. Theres a line about known or suspected terrorists prevented from traveling to the u. S. Or entering the u. S. No mention in this line of the southern border. Nowhere near that number was stopped at our southern border. Accord to data provided to Congress Late may and obtained by nbc news. Only six foreigners whose names were on a list of known or suspected terrorists were stopped at the u. S. mexico border in the first half of the government fiscal year 2018. Compare that with 41 such people stopped at the northern border. As you know, theres no wall to canada. Thats nearly seven times more stops at the northern border than the southern border due to the federal terror list. While any terrorist entering the United States is bad news, there are not thousands entering over the border. Then theres this claim. You know, ive heard numbers as high as 275 billion we lose on illegal immigration. Also simply not true. A study by the conservative think Tank Heritage Foundation found the cost was closer to 54 billion. But keep in mind its difficult to calculation costs and benefits of undocumented immigrants because many do pay taxes into the system even when using fake Social Security numbers. Thats how theyre allowed to work. When they pay sales tax and property taxes through rent payments and other types of payments they make. So the president i dont know where he gets his numbers from but not even close to the truth. Theres the entire premise of the president s address, that the immigrants are overrunning the southern border. According to the department of Homeland Security data, more than 415,000 people were stopped at the southern border in the governments fiscal year 2017. That very same fiscal year, the latest data available, more than 700,000 people who legally visited the United States overstayed their visas. This is a commonly known fact. The Biggest Issue we have with people in the country illegally is from people who legally get visas and overstay them. Canadians, by the way, made up the Largest Group of visa overstays. Canadians made up the Largest Group of visa overstays in the United States. Again, the United States governments own data, this is not secret stuff that were digging up, shows that our southern border is not the primary source of unlawful immigrants into the United States. Now, stephanie, none of this means we should be having any terrorists at all or immigrants or gang members coming into the United States. Theres something to fix here. Thats a fact. Why not just be honest about what needs to be fixed . This is the problem, much needs to happen in terms of immigration reform. Absolutely. The issue actually to me is less about this specific problem and more about the fact that our white house, right, conservative news outlets, are putting out straight misinformation propaganda now. I just think all of those good americans out there, those loyal viewers, deserve better. Theres lots of people in this country who say i obviously believe everything the president tells me. Hes the president. Its stunning to me the two weeks leading up to the midterms, the president devoted much of his social media time to the caravan. To the threat the caravan was going to bring to this country. All that it would do. Then the election happened. And we barely heard about him speak after. By the way, thats where the caravan would have arrived after the election. How could you possibly say its a humanitarian crisis, clearly used as a political ploy . Six people whose named were on the terrorist list got through the southern border. How do we solve that to get to zero . To say its 3,000 and to drop numbers, its six, its a lot more at the Canadian Border and maybe thats something we have to solve. I think it is something we have to solve. If were suddenly worth smithing specialist, i mean, come on now, were all rowing in the same direction. At the end of the day it comes down to facts. There are things you can hold on to to prove what is happening. When we unpack this, we are able to see according to data they gave congress, the latest data they gave congress, customs and Border Protection said there were six nonamericans, nonu. S. Nonresidents, they picked up at the southern border in the first half of 2018. Judging on those trends, it would be hard to see how you go from one person every month to suddenly reach 4,000 by the end of the yert. And another thing, they found is more people are entering from the northern border. There were 41 immigrants from the northern border. Totally undercuts a lot of what the president s going to try to lay out tonight. The other thing, when you talk about how it feels like ard smi. Dhs put out a statement saying the media was conflating terms when its actually the administration is conflating two things that are pretty different. One is a special interest alien and the other is those on the watch list. Neither group has been arrested or charged or convicted of terrorism related charges. That is far above what were talking about with these two groups. Theres enough intelligence the United States has your name on a list. Really just means a customs and Border Protection agent took another look at you because you didnt come from a country they expected. The majority of those crossing the border come from central america. When they see somebody pop up from india, from africa, from the meeciddle east, they want t check that person. Figure out how they got there. If theyre using a correct passpo passport. If they are who they say they are. They just go threw a little more scrutiny. That does not mean they rise to the level of terrorist or even someone who would be on a database. Were seeing the white house just over the past 24 hours turn to that term, special interest alien. This time its heathrow airport. Reports of a drone in the area. Its causing a lot of problems. For me, lets bring in nbc news chief global correspondent bill neely. Whats the situation there . Here we go again. At left thats what it looks like. Heathrow is not only britains largest and busiest airports, its one of the busiest airports in the world. All departures from that airport have now been stopped. That is after reports of a drone being seen near one of the two runways. The northern runway and the metro police say as a precaution all departures have been halted. There is a second runway and aircraft are still arriving at the second runway, but this is obviously very serious. Because its just a couple of weeks since Gatwick Airport was shut for 36 hours. It affected more than is00,000 passengers. More than 1,000 flights. Because of drone sightings, several drones. It was believed in an extraordinary development, the airport was closed. And yet nobody was found. The police arested a couple of people. But actually nobody in the end was charged with flying those drones near gatwick. Here we are, a couple of weeks later. It looks like Something Like this is happening again. As i say, heathrow is one of the worlds busiest. Nearly a quarter of a million passengers every day. About 1,200 flights come and go from heathrow. Undoubtedly, there will be american flights at this time of day that are affected. So one runway closed, no departures from heathrow airport, planes still arriving and the police are involved. Obviously trying to track down anyone whos flying this drone. Also they say as a precaution nary measure, to prevent any threat to operational security, theyve closed one of the runways. That is remarkable. The disruption at one of the worlds busiest airports. Vice president mike pence says President Trump has not decided whether or not to declare a National Emergency in order to build his border wall. What exactly happens during a National Emergency . Theres actually no clear federal definition of a National Emergency. Its declared by the president if the president deems it necessary. Gives the president special executive authorities. The ability to quickly amend laws when the legislative process is too slow. Under the act passed by congress in 1976, the president must specify which powers he intends to use. There are 136 statutory powers that could become available if he declares a National Emergency. This is according to the Brennan Center for justice. There are at least two statutes that could allow trump to build his wall. The law allows military officials to order troops to stop any civil project and instead work on authorized projects essential to support the military and national defense. These powers are meant to authorize military construction during war time according to former Homeland Security secretary jay johnson. These Emergency Powers are vast and the National Emergencies act doesnt require the powers evoked match the nature of the emergency. Among some of the enhanced authorities is the power to seize control of u. S. Internet traffic, blocking certain websites and assuring protrump process pops up first during searches. He could impose economic sanctions on american citizens suspected of providing support to foreign terrorists. He could also deploy troops inside the country to act as law enforcement. Since 1976, president s have declared, get this, at least 53 National Emergencies, inclaude g i including the iran hostage crisis, 9 11 terror attacks and the spread of Nuclear Weapons in north korea. Thats what were looking at when were talking about the declaring of a National Emergency. Joining us, ned price, former cia agent and National Security council spokesperson. The administration describes the situation at the border as a security and humanitarian crisis. I want to stay on the humanitarian i remember the first time i heard it this morning, id, like, are they talking about yemen . Are they talking about the children separated at the border . The two that were killed . Or they died, excuse me. What exactly are they referring to . Because the president turned it into a massive crisis. Leading up to the election. It turned out america didnt make it their top priority. And then he kind of went crickets and now were back. What the president is referring to is not a National Emergency as ali was outlining but in fact a political emergency for this president. The president started during the 2016 campaign has put himself in this political straight jacket promising his base. That a wall will solve all of our problems. Whether it was crime. Whether it was drugs. Whether it was terrorism. And now that debt is coming due. What we have learned in part due to the fantastic reporting by some of your very colleagues is that the threats that the administration has touted on the southern border, on the southern border are illusory. Take the terrorism threat. We now it hasnt been 4,000 people stopped over the course of the past six months, its been six. Even take that number six. That does not mean that border a gents on the southern border have stopped six dastardly terrorists trying to sneak into our country. Those were six people whose names at least closely enough matched one of the hundreds of thousands of names on one of multiple u. S. Government watch lists. It was senator ted kennedy who often used to complain that he had trouble flying because his name often did the same thing. We know 85 of those watch listed enter our country by air. Even trumps own state department in july of last year said theres no credible evidence that terrorists have attempted to cede operatives via the southern border. This is made up to help the president achieve this political emergency. Lets talk about how committed the president and his staff are to this. Kirstjen nielsen has repeated the numbers and the claims the president s made. Sarah sanders was challenged on fox news and Kellyanne Conway was challenged on fox news about this as well. Lets listen to her interaction about this. This is the 3755 number does not refer to people at the southern border. Quote, no known or suspected terrorists prevented to traveling to or entering the u. S. By dhs in fy17. I believe that includes in International Airports overwhelmingly at the airports. The other two statistics were about the southern border. I think it got unfortunately i get it. That is an unfortunate misstatement and everybody makes mistakes. The fact is, its corrected here. What do you make of that . That sounded a little like a walk back. Then we heard the conversation with pence and they dont seem to be walking back. These are facts, ned. It would stand to reason that if you tell people that there are 3,755 terrorists or terroristlike people making it through the southern border, a lot of people on the fence about this would say build the damn wall. The reason these facts matter so much is that the majority of americans dont live at the southern border. When you tell them there are immigrants, terrorists, pouring in, they believe you, because they have no access to see that. These are also supposed to be facts about our National Security, ali and steph, and the executive branch has a monopoly, or at least close to a monopoly, on information pertaining to our National Security. The executive branch controls what is classified. What is considered classified. And what is not. Yes, it was unfortunate that Sarah Huckabee sanders spread what i think are lies far and wide, as did some of her colleagues. Its actually more than that. Its not just unfortunate. It seems to me this is the deliberate weaponization of classified information. You will notice that once julia ainsleys reporting indicated the number wasnt close to 4,000, it was actually six, it was then last night that we heard secretary nielsen, the secretary of Homeland Security, say, well, we cant provide the specific numbers because thats classified. It seems to me that the administration was more than happy to tout large numbers. When it comes to specific and probably much smaller numbers, theyre resorting to this age old excuse that no, we cant talk about that because thats classified. To me, that smacks so thats political . Thats political. That is what politization, pure and simple. The politization of National Security stuff is just really dangerous. As ned says, people like you and me dont have the ability to prove them wrong. The irony is ainsleys ability to prove the administration wrong comes from the administrations own sta tichtices. At least were getting that from the government. If they just decided to not tell us or decide things are classified, we may not know the truth. You can go out there. The president can go out there on tv tonight and say things that we may not be able to prove as wrong because we dont have access to some of that information. Ned, thanks very much. Trade negotiators representing the United States and china have reportedly made progress trying to work to end the president s trade war. Nearly a year after her first imposed tariffs on chinese goods. As the talks are set to go into a previously unschedule third day, lets look at the core issues many u. S. Administrations have faced involving china. A long time complaint is forced transfer and theft of intellectual property from western companies that are doing business in china. A top motivation cited by the president , chinas steel exports were declining since hitting a high in 2015. While they declined further in 2018, the rate of decline does not seem to have increased due to the tariff. Then theres the trade deficit with china. The president loves to talk about the trade deficit. It is rising. According to the Commerce Department data, the deficit of trade in goods and services went up more than 85 billion in the Second Quarter of 2018 to nearly 96 billion in the third quarter. Well look at the fourth quarter. Once the shutdown is over. And its really important to go through this because some people had given the president credit for saying take on china. Theres been unfair Business Practices for years. And theyre right. The issue is, what hes done thus far hasnt done that. No. The trade deficits gotten worse. Former u. S. Trade representative ron kirk. This is complicated stuff. People like to buy their stuff and get it at a good deal. We dont often think about how theyre made or shipped or imported. But we laid out the issues. There are valid issues about intellectual property and how china deals with the e intellectual properties. There are issues with trade. The president s approach doesnt necessarily get to those. Were not even solving. Were creating a whole lot of other problems and not laser focused on the problems we actually have. Stephanie did a wonderful job of laying out what the factsters are precursor, and i do want to emphasize, as you both have, the United States should confront china, particularly on the protection of u. S. Intellectual property and copyrights and patents. And it has been a challenge and a struggle. But we should be smart about how we do that. And the reason that many of us have been concerned about the tariffs is that they ultimately get consumers and as you know part of our challenge, this president just continues to misstate the fact. And say china has paid billions in tariffs. Thats not true. Those tariffs are being born by American Consumers and manufacturers and its been reported in the press over the last couple of days you now have american manufacturers saying, hey, the price of steel has become so difficult for us in manufacturing, were now having to look into whether we should go to china or go to mexico. We just have to be smarter about how we confront china on these. We should be smart enough to use the reality that chinas own Creative Class is now one of our best allies to make the case to china. Its in their economic interest to have a much stronger regime for protecting intellectual property. Thats very interesting way of looking at it. One of the other problems weve got is as much as theres a massive trade imbalance between the United States and china, in some ways, thats the nature of the beast, right . They make cheap stuff and were massive consumers. Theyre developing as you said a Creative Class, a middle class that will become bigger consumers. That may even out over time. Acting chief of staff Nick Mulvaney said if no deal is reached by midnight tonight, payroll will not go out as originally planned on friday, meaning employees likely wont be paid until late this month. Right now it does not look likely a deadline will be met. This is all being called, quote, borderline insanity, by the New York Times editorial board. President trump now wants hundreds of millions of dollars to address the humanitarian crisis he caused. The situation is an especially rich example of the trump doctrine, break something, then demand credit, and in this case a lot of money for promising to fix it. Joining me now is jay david cox, National President of the American Federation of government employees. Jay david, thank you for joining us. Your union represents more than 600,000 government workers, many federal employees are now filing for Unemployment Benefits to get them through. Talk to me about what you know about how your members are surviving without a paycheck. Number one, its 800,000 federal employees who are currently either being required to go to work, about 400,000, and are not being paid on payday. Another 400,000 are being locked out of their jobs. So its unconscionable. And youre correct, many of them would start receiving their paychecks tomorrow through friday. Theyre not going to get paid. Most of these workers have an average take home pay of 500 a week. Thats 500 a week, not a lot of money. They are living paycheck to paycheck. They are feeling the pain of the trump shutdown. And by the way, if thats paycheck to paycheck, that means something gets affected, right . Rent may not get paid. Mortgage may be late. They may need a loan, credit card payments arent getting paid, or maybe a car payment isnt getting made, which then affects their credit and their ability to function well beyond this shutdown. When the politicians in washington get this sorted out, many of your members may face longterm damage. Oh, clearly, longterm damage. Also, along the fact their children will go to School Monday morning without lunch money to buy their lunch. So yes, there are lots of things our members are going to be affected by. Alexandria ocasiocortez, the new democratic congresswoman from new york, is already making waves by calling on americas uber wealthy to pay a bigger share in taxes than everyone else does. She says all individual income above 10 million a year should be taxed at a 70 tax rate. That way the extra revenue generated could be used to fund things like Green Infrastructure and medicare for all. Now, the current highest tax bracket on the books for individuals is 37 . Thats on all income above 500,000 a year. This is down from a previous high of 39. 6 on income of more than 418,000 a year, thanks to the republican tax law that President Trump signed in late 2017. Now, you see, the United States has whats called a progressive federal income tax system in which americans are taxed at progressively higher rates within rising income brackets. Americas lawmakers decided long ago that a progressive system spreads the tax burden more equitably between americas rich and poor. Now, this is how a progressive system works. Right now you pay a 10 tax rate on your first 9,525 of annual income. Anything above that up until 38,700 gets taxed at 12 . In the next tax bracket, up to 82,000 and so on until you reach the highest tax bracket after you make 500,000 and you pay 37 . All right. Everything earned beyond half a Million Dollars gets taxed at that rate. Ocasiocortezs plan is not fully fleshed out, but as proposed, it would add a new tax bracket for all income above 10 million a year. If you earn 10 million, only the 500 would then be taxed at that 70 rate. That kind of increase could generate 720 billion over the next decade. Thats not enough, by the way, to foot the bill for medicare for all, which has a projected cost of, are you sitting down for this, 30 trillion over ten years. But it could fund a number of other proposal, like Free College Tuition or universal prek. Many republican opponents and even some democrats would have you believe that ocasiocortezs plan calls for a 70 tax rate on all income generated by wealthy americans. That would be disingenuous. Others would have you believe a 70 top tax bracket is unheard of, except the richest americans did pay top tax rates of 70 or even 90 on incomes over a certain amount as recently as the 1970s. The question should really be, how progressive do we want our tax system to be . Joining me now is cnbcs editor at large john harwood. John, i would love your take on this. Well, youre making the right points. First of all, the fact that the nominal top rate is at a certain level doesnt mean thats how much of that persons income is being taken, as you just explained. In the 1950s when the top tax rate was over 90 , the average tax rate that people paid at the highest level was less than half that. In 1980, when Ronald Reagan was elected president , the top tax rate was 70 at that time. If you look at the average tax rate that the top 1 was paying at that time, it was only 35 . Today with the top tax rate at 37 , the average tax rate for the top 1 is about 27 . So when you actually look at what people are paying, it is not that big brother is taking away most of anybodys income. Its taking away most of those last dollars of income, and thats a value judgment. How high should it be . Thats what politicians and political campaigns and elections are about. So let me ask you this. In addition to the value judgment, the fear is if you impose that sort of marginal tax rate thats very high and other similar countries dont, whats to stop all the rich people from, a, either leaving, or in america, as you just said, the rich dont pay that percentage of their income because they figure out other ways to work around it, loopholes that were not closed in the last tax reform. Well, thats precisely what happens. I dont think that many wealthy americans would leave the United States. There are a lot of good things about living in this greatest country in the world, so i dont think youre going to see a lot of defections, but you might see an increase in tax avoidance. Thats part of a judgment people writing tax law have to make. Does the amount of income you yield from that higher rate offset what might be tax avoidance that reduces revenue at the other end .
