Congress that recognizes that doing nothing is only leading to more shootings and that its time that we start doing something when it comes to gun violence. Attorney general Jeff Sessions is out. Sessions forced to resign as attorney general. Now replaced by someone a whole lot more loyal to president trump. His letter of resignation says that hes resigning at the president s request. Trump is a street fighter, he has no loyalties to the republican party. He has figured out that actually making a move on mueller himself is harder and so hes figured out how to go after everyone else. I think its a big mistake to let Jeff Sessions go. I understand the Mueller Investigation is wrapping up. I find the timing very suspect. Our paramount view is that any attorney general should not be able to interfere with the Mueller Investigation in any way. All right. We will get to that in a bit. I cant believe im about to say this but we are now covering the worst mass shooting in this country in 11 days. 11 days. 12 people were killed overnight at the borderline bar grill in,0in Thousand Oaks, california. College night. The Police Officer credited with saving lines is being honored in a processional, that is the hearse carrying the body of ron helus. Helus and a colleague arrived at the bar within just three minutes of reports of shots being fired last night. The Ventura County ver live says helus ran inside the bar packed with college kids and was immediately hit with gunfire. Other deputies rushed him to the hospital where soon after he passed away. Flags across the country are flying at halfstaff again. You are looking live. This is a processional. Those are people, citizens and journalists lining a route. This is just taking his body from the hospital to the medical Examiners Office. But the honors are already there for a man who ran into the line of fire. You are going to hear a lot of other stories of heroesism about what happened last night. This was College Night at a bar in Thousand Oaks, california, outside of los angeles. Gunman opened fire. 12 people were killed, including this Police Officer whose body is in that hearse. You see those people lining up to show their respects. Ali, this morning i was talking to joe fryer who was at the scene and he said that some of the eyewitnesses who were in the bar when the shots were first fired, they thought it was fireworks, and ali, i closed my eyes and i had deja vu. You and i one year ago speaking to joe fryer on location and he was in las vegas. The same exact explanation from those who were there for that Vegas Shooting at a Country Music festival, the first shots they heard they thought were fireworks. Thats what were hearing again, one year later. [ sirens brems] let me just tell you about ron helus, he was a 29year veteran of the Ventura County sheriffs office. His body is in that hearse that you are looking at. He was a patrol sergeant nearing retirement, 54 years old, with a wife and a son. He spoke with his wife just before responding to this call. He went in, he distracted the shooter and he exchanged gunfire with the shooter and then he was shot multiple times and killed. He was planning on retiring next year and his goal was to go back to studying. He was, by the way, a firearms expert, had a masters degree from the university of oklahoma, he wrote, as you said, that he wanted to pursue his doctoral degree. He actually trained people, by the way, in the safe use of firearms, he instructed people for concealed carry weapons, permits, he used to fish, he used to go out. 54 years old. Almost at retirement. Went in to save peoples lives. Sheriff geoff dean who gave a press conference early in morning wasnt just a colleague, wasnt just his boss, he was a dear friend. And he described him as follows, ron was a hardworking, dedicated sheriffs sergeant. He was totally committed. He gave his all and tonight, as i told his wife, he died a hero. And he went in to save lives. To save other people. He said, theres just no way to describe this, it saddens us all and it tears at our hearts. Well, the sheriff was right, it certainly tears at our hearts today. And you see the people. When you see the cameras clear from the trees you will see that at intersections there are people, citizens, just standing there to pay their respects to ron shelus. The body is goings to the medical Examiners Office now. There are 11 other people who were killed by the gunman who was then killed by police and we are going to be hearing from them, but thats what youre looking at right now, the body of ron helus, 54 years old, going to the medical Examiners Office. While he left the hospital, there are still ten people there who are injured, who are being treated. Lets bring in holden harrah, who was at the bar last night and saw the suspect start shooting. Holden, this is a tough conversation to have and we appreciate you being with us. What were you doing there and what happened . So what i witnessed was a gentleman who walked in, but i just want to tell you where i was placed. I was on the opposite side of where the entrance was to the bar and at the time where i was staring was directly at the front entrance and i saw the gentleman walk in and just pull out a gun and start shooting. Right away where the front desk was and where you would walk in. Yeah, thats basically what i saw visually. I got a good clear vision of what he looked like. He was wearing like a black hat, he had some glasses on, he had a beard, he had like a black like shirt or jacket on. Then as all that was happening, i was in shock, you know, i was just still in disbelief about everything that was happening and immediately just flew down to the floor, just to get cover, just to make sure i was getting safe and then i started to crawl on the floor toward where the side exit was, where i was near, and then i saw the opportunity for me to, you know, get up and to start running out and i heard more gun shots that were behind me and they sounded a lot closer, so i didnt know if they were directly behind me or just coming toward me, but immediately just started running out and finally got to my car, but just in the process of me running, i started i hyperventilated, my hands started to curl in, i was feeling all sorts of ways. Once i got into my car, i saw people that were just running just in the streets and i was just, you know, making sure everyone was okay, i opened up my doors and said, look, get in. I dont want anyone on the road, i want to make sure everyone is okay, so i had people get in my car and one of the girls that ended up being in my car had a broken arm and then i drove her to the hospital and after i dropped them off i went home as fast as i could to my family to make sure i was in a safe environment, but still in disbelief of what i personally saw. One thing that was just blowing my mind was when the suspect came in, he didnt say a word. Yeah. He just walked right in, pulled out his gun and just started shooting away. Did it look random to you. Right when he walked in at the front desk. Did it look random . Oh, yeah, of course. Of course its random. Out here in Thousand Oaks, california, all of Ventura County, we consider this like to be our safe haven. A lot of this kind of stuff never happens, you know, like you can walk the streets down here at 1 00 and 2 00 in the morning and you wont even have a worry about someone coming up to, you know, mug you or shoot you, just any disrespect like that. This blows me away what i saw with my own two eyes tonight. When he walked in i actually knew the girl excuse me . You can continue. No, you go. At the front desk, i actually knew the girl that was like working it at the time and we werent really good friends, but it was just someone that i was running into because ive been coming here for about six months and, you know, i would just always have nice small chat with this girl, just catching up, hey, how is everything going, good to see you, and, yeah, just loss for words, seeing her basically for the last time tonight and seeing those first two gun shots go directly toward her way. It still puts me in shock that this kind of stuff happens out here or that did happen out here, im sorry. We are so, so sorry you experienced this. Yeah. What were asking is when he came in and he started shooting, did it appear that he was targeting anyone specific in that bar or he was just shooting at anyone in his path . Yeah, just basically shooting anyone in his path. I dont know how borderline was like a main target, i dont know if he had a past with borderline, but it was just i guess there was smoke bombs that were going off that he was throwing. I wasnt in the building at the time, but just when i first saw everything, saw the man walk in, not say one word and just start firing right away. Thats when i went into shock. Everything you are ascribing makes sense to us because weve heard it so many times. Thankfully we have never been in that situation but weve heard people describe these things. Weve heard people tell us in corners of this country that this was a safe place, we never thought it would happen here and now it is. Now Thousand Oaks joins that list of places that have been terrorized by a mass shooter. I will tell you weve been hearing reports that there were some offduty Police Officers who were in there when the shooting began who tried to shield some club goers. Did you see that or have you heard that . I didnt see it. I was out of the building as quickly as i could. It all happened within 15 to 20 seconds. Right when i saw the gunshots happening i actually saw the flash when the gun was being fired, so i saw that and i immediately just fell to the floor, got covered and started crawling my way and once i had access to run out of the building i did so. You said that you started feeling you know, we are not medical people, but something that sounds like a panic attack or the adrenaline was wearing off and you started to hyperventilate and your hands were curling. Definitely. This is as close as i hope youve ever come to death. I mean, but for where that gun was aimed, it could have been you. Thats why im very, very lucky to be here. Im very lucky to be on my two feet. Yes. Were lucky to be talking to you and im so sorry that you will you will live with this. You are you have joined the ranks of many thousands of americans who have had to see almost through their lives go before them. Stephanie, weve talked about too much with too many people in too many communities around the world. Holden, how are you doing and what are you doing to keep your wits about you now as it all becomes more real . I mean, the day afterwards it now starts to all settle in, how serious this was. And im just trying to process everything. Like i said, this is our safe haven, nothing like this ever happens and it just blows me away that it did happen. You know, because i remember back in like middle school, elementary school, we would do those drills that prep us for this and never would i thought i would ever have to put it into action. You went to the bar to meet friends, you were with some friends last night, how are they all now . Where are they . The friends that i was with when i saw the shooting they are okay, they made it home safely, but i did have a friend that was closer to the shooter, he actually go get shot, so hes one of the people in the hospital and he is doing okay, thank the lord, but unfortunately he was a part of it. His processional, his body is being moved from the hospital to the medical Examiners Office. What message do you have for his family that might give them some comfort . Im very, very sorry that he was the one who had to take his life for this, but you do need to remember he was there to save everyone. You know, he took that risk to go in there and help save everyone. So to his family, i love you guys so much. Please keep your head up. Everything he said to us right there, he knew the girl at the front desk a little bit, he sends her family love. To the sergeant, his family. And his message. We worry so much in this time of violence that violence will be met with violence, yet those who experience these horrible tragedies firsthand, like the people who were in the synagogue last week. Thats right. They respond with more love and more of a feeling of community. In his car a girl he didnt even know who broke her arm, he took her to the hospital. We will hope that love triumphs because we have to report on these tragedies. It does. A lot. We can make it triumph, we just have to do it. Msnbc Senior National correspondent Chris Jansing is at the Family Reunification Center where families have been going to get support. Whats going on there . Reporter ali, stiff knee, there really is no other way to describe whats been unfolding here except maybe beyond heart breaking. There are no adequate words, just about a half an hour ago we learned that some family notifications had begun and we were able to speak to the father of cody kaufman, 22 years old, he had recently moved back home in anticipation of enlisting in the army, his dad said he had been talking to recruiters. Like so many people of the 60 who have been here, it has been a long and unimaginable night into morning. He got a knock on his door, his dad did, at 1 00 in the morning, he went from hospital to hospital to hospital looking desperately for his son. Finally ended up here and just a very short time ago was told that his son was among the victims. Here is part of what an understandably shattered father had to say. I talked to him last night before he headed out the door. First thing i said was please dont drink and drive. Last thing i said was, son, i love you. That was the last thing i said. The companionship that my son had with his other two brothers, this is absolutely going to crush those two boys. This is not going to be this is not going to be easy for for a very long time. I just want him to know that he he is going to be missed. Reporter cody coffman, as i said, 22 had two younger brothers, joshua eight, dominic six. Their dad says that they are going to take them to church to tell them the devastating news. His wife is pregnant. Shes due at the end of this month, and he said one of the things cody was looking forward to most in life, already having two younger brothers, was having a younger sister. This is just the first of what will be many such stories of families who went to bed last night and everything in the world seemed as it should be or at least as it normally is and they woke up to this. In the meantime there are still so many people out there, ali and stephanie, who just dont know. Again, a short time ago before we were able to speak to Cody Coffmans dad there was a young girl, 20 years old, jennifer of a lows, who came here in tears looking for her best friend, a College Student at Moorpark College where a lot of the people who were inside the bar last night were from. They had met in church. Here is what she told me. I didnt know she was there until people were texting me and calling me a couple hours later. Im sorry, did you say she is your suite mate . No. Best friend. How long have you known her . Weve known each other for almost two years now. Shes been there for me for good and bad and thats all i can say. I have to keep looking for her. This obviously is a difficult and painstaking process that officials go through, but they do expect to have all of the notifications made by the end of the day today. They are planning a vigil at city hall at 6 00 tonight for this community that is grieving. When asked what people could do, because we have seen people showing up here wanting to do something, they say there is a desperate need for blood. In the early press conferences the police, the sheriffs deputies who were inside there, describe unspeakable scene and they really are asking people if theres something that they really want to do, that they are putting out a desperate call for blood. I just want to end by saying you were talking about how people find somehow love or something positive in the most terrible of situations. Cody coffmans father was asked what he would want to say to the shooter and he said, i feel sorry for his parents. He was being supported by his fatherinlaw who just wanted to send a message life is fragile and we all have to love one another. Stephanie, ali. We do this too much. We talk about this stuff too much. Its hard. Reporter way too much. Its hard for us, imagine the families, the father going to hospital, hospital, to hospital, looking for his son. The families who have learned that theyve lost their siblings, their children. Their kids. What is it like for people who live through this. But their kids and every person at every age their life is precious, but when this news was first reported and i heard it was a bar, i thought it was older people. When we just interviewed holden and he was talking to the two of us. 20 years old. With mickey mouse on his hat. Cody has brothers that have to find out and theyre eight seasoned six years old and his mom is pregnant. Amazing that his fathers response that he feels bad, he praise for the shooters parents. We are learning more about the suspect in the mass shooting at the borderline bar grill in Thousand Oaks, california. Her name is ian long, he is 28 years old, lived in new bury park, he was a marine corps veteran serving for nearly five years with a deployment to afghanistan. Police say he was known to him. Investigators have been at his home all morning long searching for some clues. They believe he killed himself at the scene of the shooting. Joining us now is Jill Schneider who was an atf agent for 31 years, most recently the special agent in charge of the las Vegas Shooting investigation. Jill, thank you for being with us. What are you hearing . Based on what weve heard so far does this sound like a planned shooting, something in which the gunman knew exactly what he was doing . Yeah, it does seem to be that it was premeditated, thought through. Typically these shootings are and also typically in these shootings we find that the guns were purchased legally, which was the case here. He was a legal purchaser of the fun. My understanding is that he had contact with the police regarding a possible Mental Health check, but to be prohibited by federal law from buying a gun you would actually have to be adjudicated in a court of law by a judge to not have the capacity to get a gun. Hold on. What does that mean . Thats a high it means its a very high standard. No, i mean that he had been contacted by the police about a Mental Health check. What do you mean . That was my understanding, that in april the police had contact with him based on a phone call to check on his Mental Health, i believe it was the parents that was reporting. One of the things that we see a lot with these types of situations or even things that feel like hostage situations, but when police get a report of a shooting, you know, in times gone by they would set up a command post, they would set up positions and a perimeter, maybe bring in someone to negotiate, these days police tend to go right in there and often its responders who are not the you know, the wellarmed fully protected sort, these are people who would be responding to a 911 call. Thats correct. The active shooter protocol for Police Departments is to respond, everybody who is able to respond, respond as quickly as possible. You are responding with what you have in your car. Typically your vest, a long gun, your handgun. You may have Specialty Equipment if you are on a specialized unit, but you may not. You may just be a Patrol Officer and whatever the Patrol Officer is issued to carry, thats what they will be responding with. And to respond, that does mean to run inside . That means to stop the person from shooting, yes. The active shooter protocol for Police Departments is to engage the shooter and stop the shooter from shooting anyone else. All right. You mentioned that the suspect purchased his weapon legally, and, you know, that becomes the big part of the discussion, whether somebody had guns legally or illegally but as you pointed out and as stephanie and i have been reporting so many times, way too many times at Mass Shootings, in most cases the gun is legal. So what in why you are mind is the way in which we get to a world in which on an almost weekly basis we are not reporting on Mass Shootings . Sn i think in the perfect wor it would be to not have any guns. You know, he had one handgun. One handgun in a very short period of time killed 13 people. In california high capacity magazines are banned from being sold, which means a magazine that has any more than ten rounds of ammunition in it. He had one handgun, my understanding is he had a high capacity magazine, a high capacity magazine for the glock 21 can hold 27 rounds of ammunition. Wow. And thats a. 45 caliber bullet, thats a strong bullet. If you do not have a protective vest or protective clothing and you get hit by a. 45 caliber gun in short range it is quite likely to kill you . Yes. Definitely. Jill, when you said in a Perfect World no one would have them, what do you say to those out there who say, well, if more people carried them, if there was a good guy with a gun, they could stop shooters like that because to me the thought of college kids carrying weapons in a bar where theyre drinking and dancing doesnt seem to make sense. Seems like a terrible idea. I agree with you, stephanie, it is a terrible idea and im not an advocate that more guns is the answer to less violence. It takes one gun with one bullet to kill someone and we saw today it was one gun. This man didnt have an assault rifle, he didnt have multiple assault rifles, he didnt have multiple magazines. My understanding of what was found at the scene was one. 45 caliber pistol with a high capacity magazine. Killed 13 people including a Police Officer. Now, i dont know what the what guns the Police Officer entered the bar with, if he had a handgun, if he had a long gun. Usually Police Officers respond with a long gun and a handgun. Obviously that im sure that the heroic actions of the sergeant definitely saved lives and, you know, my heart goes out to his family and to the department. He was doing his job. He saved lives. But i think having more guns in the club, i dont know that that would have prevented anything. Jill schneider thanks very much for your analysis of this. We will baek down what we know about matthew whitaker, including his views on Robert Mueller and his ties to the Federalist Society. From 2004 to 2009 he served as the u. S. Attorney for the Southern District of iowa, later becoming a managing partner at an iowa law firm before joining the administration in 2014. He unsuccessfully ran to be the junior senator from iowa on a very conservative platform. Whitaker has been outspoken about his feelings on the Mueller Investigation. In an oped that was written for the hill he defended the president s firing of former fbi director james comey and in another one written for cnn he argued that mueller looking at the president s business or finances, quote, raises serious concern that the special counsels investigation was a mere witchhunt. On cnn he suggested that a new attorney general, ironically now him, could simply starve muellers investigation of funds rather than actually fire him. In that interview and elsewhere whitaker has said that Robert Mueller is highly respected and likely doesnt Pay Attention to news swirling around the Justice Department, but whitaker has also tweeted about the investigation linking to his own writing and other articles commenting things like, worth a read, about the president s ability to fire the special counsel and characterizing the investigation as a fishing expedition. According to the New York Times he was recommended by leonard leo who is the head of the Federalist Society, thats the same group that provided approved lists of Supreme Court choices to the president. Whitaker was involved in a socalled invention Marketing Company based in miami that the federal trade commission has labeled a scam. Stephanie . Joining us now former Deputy Assistant attorney general elliott williams. Elliott, help us out here. This guy has a very, very public view on the Mueller Probe. And a record. He has spoken about it, he has written about it. Wouldnt that require him to recuse himself. I mean, he has already made opinions about the thing he has to oversee. It certainly requires him to seek the advice of the ethics officials at the Justice Department. Yeah, it smells really bad and it looks really bad. Hold on. Okay. Seek the advice of the lawyers at the ethics department. Spare me. This is 2018 and the trump administration. I got it. Does that actually have any teeth to it . Those are career officials. The question is the rules seem not to apply to trump and trump senior officials. Again, nothing mandates recusal in most instances, the question is does this look bad . Does it smell bad . And does it give the appearance of impropriety . And of course across all these things youve identified certainly, look, theres nothing wrong with being a member of the Federalist Society, theres nothing wrong with having been part of this company thats been shut down by the federal trade commission. Whats at issue is these clearly expressed views on shutting down an investigation, clearly expressed views on how it should be funded and conducted. So theres all kinds of conflicts of interest that most frankly any reasonable attorney would ultimately seek recusal for. He will seek and i believe theyre doing the ethics review now, but i guess he has said as you saw some reports this morning that hes committed or has no intention of recusing, which is preposterous. If i were named acting anything i would wait to see what happens before rearranging all the furniture. When it comes to the Mueller Investigation, as acting attorney general, does he have the same authority as a fully confirmed attorney general . He does. Attorney general is one of those positions where some of those nuances with respect to nominating people into vacancies as acting dont really apply. Yes, he can carry things out. Now, if Rod Rosenstein is to stay on, how does that affect the conduct of the Mueller Probe . Potentially he could manage the Mueller Probe through Rod Rosenstein or whatever. The simple fact is regardless of these behind the scenes hr decisions, we know that this individual was put in place because of his views on the Mueller Probe and because of his views on sort of the primacy of donald trump and so on, because he is an insider and someone who is going to be loyal to the president. What got Jeff Sessions in trouble in the first place was the fact that he wasnt sufficiently loyal to the president which is tremendously ironic given that no individual has been more loyal to the president s agenda than Jeff Sessions if you look at everything from immigration and to criminal justice reform. On all of these issuissues. This was all about loyalty and all about the fact that the president expects the Justice Department to be his lawyers, to be his stooges to some extent and thats what i think were starting to see here and its a shame. We know that the president expects that. The question will be, ali, what does the rest of the government think . Will we see Congress Take action to protect Robert Mueller . It will be one of the first things this democratically controlled house of representatives will do. Well see a bill debate and voted on. It will pass the house. We have the votes in the house to do this. The senate, as you both realize, is a bit trickier. This is the first step. The senate will see what happens in the house of representative, the peoples house. Gun safety won this election. The nra lost in the house of representatives. The american public, its not only 67 of people think we need stronger gun laws. People that nbc polled, exit polls after the election showed it was the number two priority of democrats and i think number four of all voters. People want something done. Theyre tired of seeing Mass Shootings happen in our country every single day. Add on top of that the gun violence. We have 36,000 people die of gunshot wounds every year. Shes doing well. Shes committed to making a difference. The laws wehave passed at the state level is savie ining peop lives. Thats clear. We didnt only win this last election at the federal level. There are state legislatures that change control from the republicans to the democrats. That will help us pass more legislation. The turn out from young people was incredible.
