Democrats using the democrats lawyers and now they want to impeach him. Ive heard this. I think its an insult to the American Public and i think youre going do see a lot of things happen on november 6th that would not have happened before. I think a lot of democrats are going to vote republican. The main base of the democrats have shifted so far left that well end up being venezuela. Im traveling with rod. I didnt know rod before. But ive gotten to know him. I get along very well with him. Well be talking an the plane. I have a Good Relationship other than theres been no collusion, folks. No collusion. And but i have a very Good Relationship. Well see. I couldnt be prouder of the Senate Republican conference. We were standing up for the presumption of innocence in this country. What i think this has done for us is provide the kind of adrenaline shot that we had not been able to figure out how to achieve in any other way. I believed that a Sexual Assault had happened to her. What i think shes mistaken about is who the perpetrator was. Hes going to be on the Supreme Court with a huge taint and a big asterisk after his name. Justice kavanaugh should not be seen as tainted. He should be seen as somebody who went through seven fbi investigations, including just in the last week. All right. You heard it there. President trump on the attack again over now Supreme CourtJustice Brett kavanaugh. Trump claiming democrats are planning to impeach kavanaugh and dismissing the allegations that were lodged against him. Kavanaugh will be sworn in tonight in a prime time ceremony at the white house. This after a private swearing in that already occurred over the weekend. His first day on the bench is tomorrow. Giving the high court a potentially solid conservative majority for the first time in decades. Without a swing vote in several high profile cases possibly coming before the court, including daca, the protections for young undocumented immigrants. This week, cases of firearms and undocuments immigrants. Joining me is nbc news justice correspondent Pete Williams whos been tracking all this, knows the court well. Pete, that is the line thats out there. Republicans are hoping for it. Democrats are fearing it. The idea that the balance of the court with Brett Kavanaugh is going to shift and thats going to show in some major rulings. What are the prospects of that Going Forward now . Well, the balance of the court certainly going to shift and that has very little to do with Brett Kavanaugh and everything to do with anthony kennedy, the justice whos left who sometimes voted that the liberals in some of the high profile cases. So thats the change. Any Trump Nominee to fill Justice Kennedys seat just as Brett Kavanaugh does will have made that change. Yes, thats true. You will have five solidly dependable conservative votes. On some of the high profile cases. Now, to be sure, most of the Supreme Court cases are not decided 54. And thats probably going to be true of the ones that you talked about early on argued this week. Brett kavanaughs probably lucky that this court is off to a this term is off to a fairly low key start. Some rather technical cases involving interpreting federal statutes. We could get to some high profile cases, though, if the court agrees to take up, for example, a case that asks whether the federal civil rights law that bans job discrimination on the basis of sex also applies to Sexual Orientation and another case of a big 40foot cross in suburban washington near here and the question is, does that violate religious freedom or does it violate the separation between church and state . Yeah. Those decisions you are talking about at least potentially whether to take up cases, potentially explosive cases, politically another key player there then becomes the chief justice john roberts. With the addition to kavanaugh to the court, the new role to play compared what Anthony Kennedys been playing, how do you think this is how do you read john roberts and the moves he will make now . Okay. I say theres two parts to the answer of that question. First of all, a lot of the cases, for example, gun control, the court shied away from gun control for eight years since saying there is a right to have a handgun in the home for self defense. They didnt want to take up any other cases and some other similar controversies because i think the people who believed in gun rights and expanding them did not know where Justice Kennedy comes out. Having Brett Kavanaugh on the court voting on what cases to hear removes some uncertainty. So thats part a. Youre right. Chief Justice Roberts may want to go slow, maybe concerned about the perception that this court has become partisan. For the first time in decades, all the conservatives were appointed by republican president s. And all the liberals were appointed by democrats and thats something that concerns him and the other members of the court so perhaps his role is not going to be as a swing justice but perhaps as a lawyer here paul clement former solicitor general, maybe the governor switch. And theres also been a lot of talk about the image of the court, about the courts stature in this country. Of course, the controversy over kavanaugh, you had almost two decades ago, the 2000 election essentially decided by the Supreme Court, clarence thomas, a lot of these battles over Supreme Court nominations. Justice sotomayor over the weekend about where the courts image goes after this latest fight. Heres what she had to say. I think our image is the thing that we have to guard most jealously as a group. And for that, it requires us to be working together in a way in which we uphold the sense of integrity of the court. We very quickly learned that we have to put aside our own individual interests and work on behalf of our nation and this court that we all revere. So, pete, she is talking there about rising above the image of sort of part sonship and you just said it. If you have the liberal justices, the liberal wing of the Court Appointed by democrats, the conservative wing appointed by republicans and you start getting rulings on potentiallidy visive and polarizing issues, what does that do to the courts image long term . A couple of answers to that, steve. Remember. We have had a fair amount of that. Anthony kennedy, we talk about as a swing justice, but for most of his career and decisions he did join the courts conservatives. Citizens united case, gutting the Voting Rights act, hobby lobby. Those kind of decisions from a conservative this is a primarily conservative court. So weve already been through that phase. The difference is we no longer have him sometimes voting with the liberals and it is strictly partisan. Justice chief Justice Roberts has some control here because he gets to sbid wdecide who writes opinion in the majority and is thats something to help influence the perception of the court to keep decisions from being perhaps too strong and throttle them back a little bit. All right. Nbcs Pete Williams, its been about whether Brett Kavanaugh will be confirmed. Now the story moves to what does it mean for the court. Well be talking with you about that a lot i think. Coming up, live from florida, President Trump set to speak at a convention for the Worlds Largest association of Police Chiefs. We are voting and fighting for the government we have now and for the future of this country. All right. Hearing a lot of that over the weekend. A lot of this as we start the new week. Republicans saying the kavanaugh fight will be a turning point in the fight for the control of the house. Republicans on defense all year trying to keep democrats from picking up those 23 seats. Let me show you first of all why republicans are starting to talk this way. It has to do with some of the numbers we have been seeing. This right here, this is a measure of voting enthusiasm, energy. People who say the midterm elections to them are very important. This was over the summer the story and since donald trump became president. On the democratic side, the number higher, significantly higher than on the republican side. Over the summer, this poll and npr poll taken, a 78 68 a. Tenpoint gap. Then another poll, as the kavanaugh controversy was heating up and this is what it found. Look at this. Democrats, yeah. Uptick here. Republicans and explosion. And what it means is energy gap in the poll and there have been some others showing a similar thing. Shows that energy gap narrowing to a twopoint democratic advantage and that is a huge difference when youre talking about can democrats get to the 23 seats or not . Heres another way of looking at it. Same poll over the summer, democrats with the energy advantage, this was the generic ballot. Which party plan to vote for, democrats or the republicans, democrats were up 12 points over the summer. They had the energy advantage. They had the big lead in the generic ballot. Remember, the closer this thing gets to high Single Digits the better position democrats are in when it comes to controlling the house. But then during the kavanaugh, same poll, during the kavanaugh controversy, that number gets cut in half. A rise of republican enthusiasm and the generic ballot fall from a place of democrats are taking back the house if its at 12 points. At six points, republicans have a fighting chance so thats why republicans are talking that way. The question, though, is, we still got a month to go. Think back a month ago. Think of the headlines were then. Cohen, mccains funeral. Still talking about this and will it have an energizing effect for republicans a month from now . Joining me the New York Times nick canfasoria. The optimistic version is they say basically, hey, the election is close now and a question of finding a way to wake the voters up but now that theyre awake they stay energized. The flip side is, hey, maybe we wont talk about this and the energy dies. What do you think . Well, steve, it is partly a confidence game. I think people like Mitch Mcconnell out there trying to instill some confidence in the democrats on some increasing confidence on his team but as you point out there are some signs that its true. And the question is, how narrowing is that gap and will it last . I think theres something going on here which is most republicans with a problem with trump are not angry about mcconnell and didnt have a problem with nominating a republican to the Supreme Court. I think the confirmation of a fifth justice whos a reliable conservative to the court is actually a way of reminding some wavering republicans of the price of trump and why they stick with trump. And that can bring some of them back to the fold. But look. Its also going to unleash even more anger and energy from people on the left, especially from women. And its going to be a very big deal. They see a president accused of Sexual Assault, elevated a man whos so accused to the highest court. That is going to inspire a lot of anger and passion on the left. And it really is striking to me looking back really since donald trump became president. The energy on the left, the energy on the democratic side is impossible to miss. We have been seeing poll after poll showing an energy gap and republicans, you know, they tried to get democrats to embrace impeachment. They thought to make an issue out of nancy pelosi. Theyre looking for a way to generate energy and enthusiasm. Can you think of anything else thats out there that they might be able to tap into over the next month if this doesnt prove enduring or sustainable for them . Steve, in trumps washington theres always something, right . I think part of what we are seeing is republicans are coming back into the fold and saw a similar phenomenon in 2016. People who were maybes are coming back the fold. Im not sure the kavanaugh thing stands in the end but i think there are many republicans out there who are threatened by the images of women and people of color on tv angry and protesting and the same way threatened by black lives matters so i think thats going to create some fear and some counter vailing energy and what i dont know, steve, wheres the energy actually at in terms of congressional districts and senate races . If the energy on the left in the wrong places it wont matter as much on election day. Theres probably about 70 of them at best to be in play in deciding this thing. Theres a lot happening elsewhere, as well. U. N. So with Justice Brett kavanaugh about to hear his first case on the Supreme Court, lets take a look back at his record. What we know about it. Where he might stand on key issues to come before the court. On abortion, had one major ruling in his time on the federal bench. It was in 2017, the d. C. Appeals court ruling in favor of an undocumented 17yearold seeking an abortion while being held by immigration authorities. Kavanaugh dissented creating a new right for unlawful minors in government detention for abortion on demand. For roe v. Wade, kavanaugh said the landmark decision settled as precedent of the Supreme Court. That has been reaffirmed many times. When it comes to lgbt rights he has no judicial record. In the hearing he wouldnt say whether he believes obergefll versus hodges saying, quote, they have all declined when asked to answer that question. However, in remarks of george mason university, excuse me, in 2016, he spoke positively about justice antonin scalias dissent arguing it was not the courts job to update the constitution for new rights. On gun rights, he believes in the right to bear arms. In 2011, the majority of the colleagues upheld the d. C. Ban on possessing semiautomatic rifles and argued the ban unconstitutional because the weapons have not been banned and in common use by citizens in the home, hunting and other lawful uses. Defended the opinion in the confirmation hearings saying, quote, my job to follow the Second Amendment opinion of the Supreme Court. And finally, one issue thats considered most important to President Trump, the question of executive power. Kavanaugh writing in 2009 arguing we should not burden a sitting president with criminal investigations or criminal prosecutions. Though he added to take an act of congress to provide that kind of immunity. In the hearings, kavanaugh argued his writings quote ideas for congress to consider. They were not my constitutional views. The confirmation process is an emotionally fraught whirlwind. Look at how it played out in the days leading up to the weekends final vote. There is a sense that a delay of kavanaughs vote is essentially a death sentence. How did he get home . I dont remember. How did you get there . I dont remember. How many years ago . I dont know. Three of the four key senators voting to end the debate and proceed to a final vote. I could not conclude that he is the right person for the court. I will vote to confirm judge kavanaugh. The nomination of brett m. Kavanaugh of maryland to be the associate justice of the Supreme Court of the United States is confirmed. Senator, do you think that theres still a place in the Democratic Party for you after this . Kavanaugh has got to go just an extraordinary person, a great, great talent and i think he is going to make us all very proud. And joining me now, jennifer reuben, opinion writer for the Washington Post and josh barrow, business columnist for new york magazine. Jennifer, first, just thinking back here, you know, over the last week or two when you had that testimony in front of the Judiciary Committee of Christine Blasey ford, i think in that window between her testimony and when the world heard from Brett Kavanaugh, i think if there was conventional wisdom that formed in the moment it was that the nomination might be finished. What was key when you look at it now . What was key to him actually being able to get confirmed . What happened . What was he able to tap into . What were republicans able to tap into here . I think republicans have rerun their methodology of 2016 to rely on white male anger and resentment and thats what they did and they made it virtually impossible for a republican to call themselves a republican without joining into that. I think we have a different problem much more serious and that is the question of the courts legitimacy. I think his rant, partisan rant accusing unnamed democrats of being out to get him and his threat that Goes Around Comes Around poses a big problem for him and the court specifically and we heard kagan speak saying she is concerned on the court concerned that now the United StatesSupreme Court which was the jewel of our legal system is viewed as simply skins and shirts. Red and blues. It lacks legitimacy. Thats the problem for all of us. Josh, im curious what you think of that because obviously theres concern of that among kavanaugh votes in the senate and supporters and put wall street journal oped out the night before the vote. Im thinking back to after the 2000 election and the Supreme Court decided the bush gore decision. The threat jennifer is describing, how real is that . Its real but the responsibility with chief Justice Roberts than kavanaugh. Roberts will be the new middle of the court. But roberts has a record. He is a conservative but also very concerned about the public sense of legitimacy for the court and a little bit more modest in terms of his view of how the court should operate than the other conservative judges. He is more inclined toward recognizing precedent. There was a decision of sales tax this year where roberts wrote saying that the decision they were looking at 25 years ago, a wrong decision and standing for so long, congress could have changed it. Instead of the Court Changing this policy, we could stand back and say, let Congress Change this if they dont like the precedent and might set a road map for issues before roberts to face a choice about should he join with his other conservative colleagues and overturn a precedent or look for a more modest road . So i think that he will view that as a key task for him. Kavanaugh made the job harder because kavanaugh primed democrats to even more think that conservative decisions by the court are purely political and a difficult road for roberts to walk and on him to preserve that sense that the court is at least one or two steps remauved from politics. Kavanaughs basically just another conservative vote on the court is my expectation. He is going to be a key vote for those conservative decisions and ultimately up to roberts whether they have that fivevote majority. Jennifer, just in terms of the Cultural Division in this country, i mean, just based on the polling the most polarizing Supreme Court nomination fight since bork 30plus years ago and didnt get confirmed. Kavanaugh is confirmed and we have talked about the opposition. The opposition to the nomination. The Womens Movement against donald trump in the last year or two, how those two things synced up and a femaledriven movement against trump and accelerated by this and curious to hear republicans saying a traditionally they were hearing they were hearing from traditional female voters in this country who looked that the and said from the kavanaugh perspective saying if its my son, my husband accused of something and they said they didnt do it and found sympathy there. Its vast Cultural Divide here and how people viewed this. I think thats huey. Looking at polling data, negative to kavanaugh, negative among women, even more negative among suburban women. I think thats Wishful Thinking on behalf of the republicans. But its not just the Supreme Court justice. I have written that column that hes sort of outlined right there many atime. It is up to each one of the justices. It is up to i think kavanaugh to frankly recuse himself on some key cases. I think it it is up to all the justices to lower the tone, the tone of the opinions has become combative and personally nasty. I think it behooved the justices to avoid going to clearly ideological groups and kind of cheering their side on. I think they should stop commenting on politics. In this regard, Ruth Bader Ginsburg bears a responsibility. The people will not take it seriously. And we will have states and individuals testing it. As Justice Kagan said last week. We dont have an army. We cant make people live up to our opinions. And we will have some legal chaos if this goes on so its not just roberts. Its all nine of them now and you know what . If they dont do that, next time democrats get in power we will have a Court Packing scheme. And thats where were headed for if they dont pull back on this rabid partisanship. Thats the other question, josh. Does it lengthinger in the poli . Some talk about investigating kavanaugh with congressional power, impeaching him, the possibility as jennifer said broader reforms, changes to the system here that do you see democrats taking this fight and looking for specific changes to the way the judiciary organized . Specifically going after kavanaugh . Do you see it playing out that way . Theres a push to impeach but you need a two thirds vote in the senate to remove him. If theres a push it doesnt lead to the removal from the court but only a political exercise. The more substantive question is when they control the presidency and will add seats to the court to solidify the majority on the court and i think the way the nomination plays out makes it more likely and the key thing to determine that will be the decisions from the court. I take jennifers point that would be good for judges to project less of a political image. I have not been a fan of the way that some judges have been more directly involved in politics but i think the main thing that drives that perception is key rulings that the court makes and for example test cases of roe v. Wade, will the court uphold or overturn . A full overturning i think would fully outrage the entire left and make it extremely likely to try Court Packing when they could. I think more likely outcome is in the middle and weakens it without overturning it and i think key on roberts mind, how far can they go with legitimate sy to not face Court Packing. We have been talking about potential midterm ramifications for the kavanaugh nomination. Republicans out there saying the energy is up, the polls showing the Republican Energy up a little bit. The question of whether that lasts, take a look at the senate side, though, in particular. Some of the early readout were getting on this. Check out the new polling we have seen. This is north dakota. This was taken before Heidi Heitkamp voted no on the kavanaugh nomination. 12 points behind kevin cramer. Heitkamp vulnerable. North dakota went for trump by 36 points in 2016. She voted no on the nomination. Clearly, the most in dangered Democratic Senate vote. The flip side, joe manchin, only democrat in the senate to vote yes over the weekend and encouraging polling news out of West Virginia even before this vote. West virginia went for trump by 42 points and manchin separated himself from the National Party. He was already in decent shape. He further separates himself from the National Party with this vote. That might have improved his chances of keeping that seat democratic in november. Tennessee. This ones interesting because you saw this poll come out yesterday. Blackburn leading by 8. Another poll a couple of days with blackburn ahead by 5. Is there momentum behind blackburn . Is this one starting . Trump won the state big. Is it starting to become a republican hold . Texas, you mentioned cruz, show cruz there. Continuing to lead in texas. Heres the other interesting one. Incumbent in a state that Hillary Clinton won. Only republican senator up in a state Hillary Clinton won in 2016. Hes trailing a couple points in this poll and he voted for the kavanaugh nomination so this could be a flip side politically. The democrats in trump states have to explain no votes. Hellers got to explain a yes vote to a state that voted for Hillary Clinton. And hes already in some trouble in the polling right there. So thats a quick look at the landscape. Joining me on set as i make my way back over, patrick murray, the Monmouth University polling director. Patrick, thank you for taking a few minutes. It is interesting going through those senate numbers. We talk about the house all the time. We talk about the suburbs but thats a reminder that when youre talking about battle for the control of the senate youre talking about Trump Country being to decide this. Thats absolutely it. But one of the things we have been seeing is that the republican Enthusiasm Gap of earlier in the hour that republicans have been closing that has been happening slowly and surely since labor day and was just a natural correction that the democrats were just abnormally enthused over the summer. I remember sitting across the desk from you probably a couple weeks ago saying i dont necessarily see a blue wave yet. I see a high tide. I think we are in that kind of area right now. Thats interesting what you are saying because the question were asking is if its a kavanaugh surge in republican surge, does it recede and kavanaugh feels like it happened ten years ago . If you have been seeing an uptick since labor day or so, that might be more sustainable. I think it is sustainable. And the races we have been polling over two weeks we have been asking about the kavanaugh impact and every single race it is not changing voters minds because where they stood is baked in. Do they go out to vote . Thats where we see a slight shift with points of republicans coming out to vote than the summer. Which is keeping these races very tight. So were seeing a whole bunch of races where the democrats lined up particularly in the house lined up just a couple of points ahead but really nothings moving there. And they could all swing in the opposite direction by the time we get to election day and then the senate races where things are up and down and senate races have a lot more issues involved in them than the house races because its a larger electorate we are dealing with but well see how it plays out because i think that the initial impact of the kavanaugh affect and particularly the threat to the nomination and why i think it recedes and an underlying sustainable decrease in enthusiasm. Is it going to be enough to just overcome democrats and not lose too many seats or will it tick just a few points the other way and democrats pick up the extra seats . Huge difference there and the generic ballot or the trump approval as they move a couple of ticks. A couple of points. Changes a lot. Thank you. Said they had a very good talk an alluded obviously to the drama and suspense that was the major story in american politics just before the kavanaugh nomination. For more now on the president , the relationship with Rod Rosenstein, and the path to the midterms, katy tur is joining me live from california. She is at ucla, home of the bruins. So, katy, from the campus of ucla, first of all, just the president right there, i dont know if you heard very briefly alluded to Rod Rosenstein, talked about having a good conversation with him. What did you make of that . You know, i think its interesting that he was with him on the plane. The president has historically been reticent to fire anybody so to fire him on the plane to orlando is a long shot. Usually hes in another room in the white house by tweet and not in person. Thats been during the campaign, as well. A good conversation. Who know what is that means . But Rod Rosenstein seems to be in at least a more secure place today than he was a couple of weeks ago. The big question, steve, still whats going to happen after the midterms . Will Rod Rosenstein be forced snout will the attorney general be forced out and if so who will replace them . It is a reminder, too, we were talking about this question of the kavanaugh affect on the midterms. What thats going to be and the fact that it was, what . Two weeks ago that the only thing that seemed to matter in american politics for a minute there was Rod Rosenstein. And a couple of weeks before that yeah. It was the mccain funeral and how trump handled that. Anonymous oped in the New York Times. It is just striking here on columbus day to think about the incidents, eruptions feel distant and kavanaugh and we are still a month to go before the election day. Yeah. No. Totally. And the question with that is, will it sustain enthusiasm for republicans or democrats or will it get totally drowned out by something that could be coming down the news cycle in the next hour or tomorrow . There is just a constant stream of controversy and drama and unrest within the Trump White House that one story inevitably drowns out another story. Rod rosenstein could reappear as a controversial figure in the Trump White House, and he may be gone, and that could be the main story more when we get closer to the midterm elections. Its still very unknown. One story thats gone completely off the radar since it broke and its surprising because it is such a major story, and thats because of all the kavanaugh news, is the donald trump taxes story and the New York Times deep dig they did on how much money he was paying and how much he and his family were able to get around the tax law in order to benefit themselves. Its a major story that is not getting any attention. Well se e if that resurfaces i the days to come. Kavanaugh, week three, i still a big story theyre talking about on campus. What part of fox are we talking about here and whats the role going to be . Sure. So the part of fox were talking about the essentially what 21st century fox could not sell to disney stoshgs disney, so Fox Broadcasting and sports and fox business. The ties between the white house and fox news, the lines of communication there are very well established. I think a lot of folks will look to this move and say how much closer could these two organizations get. You have bill shine, who is formerly an evp, executive Vice President , at fox news, number two to roger ailes, whos become Communications Director at the white house. You have hope hicks, formerly Communications Director at the white house, now serving as top e veshgs evp at new fox. It feels like freaky friday. From a business perspective, this is a pretty logical move. If there was anyone in the Trump Administration who sort of kept their head down and just did the work and up at least until the last 24 hours avoided controversy during their tenure in the white house it was hope hic hicks. Shes not even 30 yet and demonstrated herself to be incredibly capable in chaotic situations. So if you are rupert murdoch, lachlan murdoch, youre coming into basally owning what is effectively a new company and you have a network like fox news that is as evecontroversial as is, she is a key person. This was a logical move. What does this job i mean the title were reading here, executive Vice President and chief Communications Officer. Do we know what that entails . Is this a public facing role . Is this strategy behind the scenes . Thats right. Its a Communications Role and its effectively, you know, running defense, very much actually what she was doing for trump. It is protecting the corporate image, and now that the murdochs are giving up all of these entertainment assets to disney, what they are left with, fox news is a much bigger piece of that pie. Fox business is a much bigger piece of that pie. You think of all the sort of controversy that surrounds that network, there are some competitors to fox news who have gone out publicly and called it staterun media for donald trump or, you know, protrump propaganda. So shell be running defense for that, and shell also be doing the more mundane tasks of sort of corporate communications. I should mention, by the way, fox is also bringing on danny obrien, whos actually a veteran of democratic politics, who worked for senators biden, senators menendez, so theyre pulling for both sides of the political spectrum. What are they bringing him on for . I saw that in the moumt announc as well. Thats Government Relations and effectively amounts to basically running defense and offense in washington. Basically, the ties to not just the Trump Administration but all the business that any Media Company has to do when it has to do with lobbying, dealing with senators, congressmen, basically dealing with the politics of being a Media Organization these days.
