Today the Clinton CountyDistrict Attorney gave details about the woman authorities are questioning in relation to the escapes. Specifically about all investigations that she may have passed illegal contraband to them prior to their escape. Joyce mitchell based on our investigation, has not provided power tools. She brought contraband in the facility but im not going to get into what it was. Joyce mitchell has not been arrested or named a suspect. However, as the search enters its seventh day with 800 federal state and loy call officers now involved authorities clearly believe she is a key figure in determining how richard matt and david sweat escaped. Joining me now from upstate new york is nbc news correspondent john yang. John, i want to talk about the search. Tell us about what the da is saying about Joyce Mitchell and ebbs plaining the contraband and relationship with the other prisoner sweat. If you heard, thomas he was very clear he did not according to their investigation bring in power tools to the prison to give to these two escapees. I should stress he kept saying power tools. And on sunday the head of the major of the new York State Police for this region for company b told me that they had found what he said not sophisticated Cutting Tools in the prison, which suggested to me some sort of cutting edges or cutting blades. So we dont know if that was part of it. He does say she does acknowledge she did bring in contraband to the prisoners. He said he wouldnt be specific about it. He said contraband can be anything from toothpaste to extra food to magazines, not supplied by the prison, to cocaine. When we asked him if he could be more specific he said its not toothpaste and its not cocaine. Its a pretty wide gap there that were left with. We also know the District Attorney told us that in the past 12 months there was a complaint filed against joyce with mitchell, saying that she had an improper relationship a too close relationship with donald sweat. We know from investigators that she was close also to richard matt. But they investigated, the prison investigated this didnt find enough evidence to discipline her and so the matter was dropped. It was handled internally within the prison. The da said he never knew about it until the questioning began. He said that theyre still talking to mitchell. She has, he said the information she originally gave was a little not very detailed but shes giving more and more. They do expect her to be charged. Thomas . John real quickly, we know we have new imams out of the two men and also from your reporting it seems were seeing a really hightech manhunt as we enter day seven. Reporter thats right. Theyve got the bloodhounds on the ground. The area that theyre focusing on now continue to focus on is because of that scent that the dogs picked up the other night. They also found some wrappers of food that are consistent with what food that would have come from the prison. They found bedding. Theyve also got some very hightech eyes in the sky. Theyve got lenses on these highpowered cameras on helicopters that can read license plates at 2,000 feet. Theyve got infrared devices. You know weve seen these helicopters passing over these woods at night without spotlights. They dont need spotlights. They wait for everything to cool down from the day, go over these things. They can see heat images. They can detect patterns even detect people down there. So thats what theyve got going for them. Thomas . I mean, it shifts from a traditional manhunt to more of a fugitive investigation. But there seems to be more, you know physical evidence that the investigators are finding, the dogs are picking up on a scent, candy wrappers. Was that from day one . Were in day seven now. I think what the focus should be on is the power of the people and how being engaged in our system in a constructive and intelligent and civil way can effectuate change. This judge has been a judge for 31 years. Hes a Public Servant and he as well as the people perceive an injustice. Its very interesting to see what the prosecutors will do who are also Public Servants in honoring the peoples wishes. Its not its just a simple matter of procedural justice. Thats all that anyone is asking for. And if you cant do that its really not fair or genuine on your part to expect people to give you legitimate authority and respect you back. Tell us about the civil case. How does this influence that . Well, i think i think the crux of the matter is that at all corners is closing in on the foot dragging of the city in all respects. The judge in federal court has indicated that there needs to be an answer by these officers to the complaint. Thats a signal that time has moved on i guess, to a point where its perked where weve got to have some movement in this civil matter. In a criminal case youve got a judge probably one of the senior most judges in the entire state of ohio who has said look theres probable cause for murder warrant. And so in essence what you have is a murderer a potential murderer going to work collecting a check from the taxpayers. Federal judge this week ordered woodfoxs release, barred the state from trying him a third time in the 1972 death of a prison guard. So the state appeal as we just heard there, his attorney talking at the fifth circuit, and whats happening right now were going to check in with nbcs mark potter standing by now at the camera who heard the full account from the attorney for woodfox and, steve mark whats the breakdown . Well, Corrine Williams just came out. I dont know if you saw the beginning of her statement. She said we are deeply addition appointed that after 48 years of incarceration in mr. Woodfox will not be released today. She said that the ruling originally from the District Court freeing him was the right one. She said the facts in this case are extraordinary. Its very clear that he should be released. Now what this means is that he will be held in jail through the length of an appeal thats being argued right now. She did not say how long that would take. He will be incarcerated for the length of that appeal. And she also would not say whether there was any reaction from her client mr. Woodfox. Obviously a very disappointed legal team and the supporters will be disappointed. We have been told earlier that mr. Woodfox will be held here in this jail for the length of that appeal. He will not be going back to the state prison at angola. This is a prison with 39 that can hold up to 49 prisoners. Its a small jail. I dont mean to say prison. Its a small jail. He is currently not being held in isolation. Those are some of the things we know. And thats about it. The decision has come down from the fifth Circuit Court of appeals in new orleans that he is not to be released. We will get more details shortly. Thats the announcement right now. And again, a great disappointment on the part of his legal team. For woodfox, mark the extended order was going to run out today. How close were we to that running out . We were about 20 minutes. Everyone expected that the judge that the judges would rule. This is not a surprise that we got a ruling. And so it was anticipated, we were all here waiting for it. And a lot of people thought that because of what the District Court did that the Appeals Court would follow suit and free him today. As you can see, podium was set up for him to come out and talk arrangements were made but he is not getting out. He will not be getting out now for the length of the appeals process on whether there should be a third trial. The state wants there to be another trial, another murder trial for the 1972 killing of a prison guard, a brutal stabbing. There have been two convictions against mr. Woodfox in connection to that case. Two of those convictions were overturned. The state went back to file a third indictment. And the judge threw that out. But now its being appealed me want dont know how thats going to go. We have folks coming up to the microphone right now who is going to speak to us thomas, if you want to listen to them. Can you tell us who you are, please . My man is Stan Miller Brett millers brother. My sister wanda calendar his sister. And the only thing we really have to say is its been a Long Time Coming and were very happy that the Appellate Court decided with the das office. You believe he belongs in jill . Yes, sir. Yes. Yes, sir. Why . What made you convinced . There are all witnesses, two court cases. All witnesses and two court cases and a jury that convicted him. Twice. Twice. And our constitutional right to have a trial by jury. And we could not understand why a jury was not accepted twice in this case. What were your thoughts about all the people who rallied together arguing that he should be released that the trial was unfair . Well, we had just as many rallying that he should not be released. But the media only covered the ones who were rallying for him and not for us. What do you make of the fact that your brothers wife supported the rulings . My brother was married to this lady only two months only two months. And several occasions shes tried to go on different deals, movie deal book deal whatever for money. And we still believe thats the reason shes done this is for money. Her view did not represent the family . No, sir, not at all. No it didnt. We havent really seen her three or four times in 48 years. Another thing, she never showed up at a court case. I think she visited his grave one time after he died. She never was present. She never went to anything to represent brent. Thats what the judge said with no witnesses we feel that hes had fair trials, sir. Hes already had trial by jury twice and found gullity twice. So to us he has had fair trials. The judge said there was prejudice in the case. Do you believe that. Opinion. Thats his opinion. Thats not our opinion. We have no racism or prejudices in us. Were not made that way. Were hearing from them asking questions along with other media representatives that Albert Woodfox would not be released today. The brother and sister of brent miller killed 43 years ago, allegedly by the man youre seeing right there, Albert Woodfox. Hes 68 years old and said to be in poor health. We just showed a image, black and white photo of the prison guard brent miller. The order for him to be released today has been overruled and he will be held until they can further the appeals process. We heard from his attorney who came up to the microphone. As mark potter reported there had been some thought he might be released and set up the microphones to hear from woodfox but we heard from the brother and sister of brent miller instead. Were going to hear from mark potter in our next hour. We do want to return to the mass i manhunt for richard matt and david sweat. New York State Police say the focus of the search continues to be centered along state route 374. Thats in the town of plattsburgh. More than 800 Law Enforcement officers are involved in this. The search will now go into its seventh day. It is the longest escape from a new york state prison. My colleague is here now with the look at the length of other new york escapes. Not nearly as lodge as seven days. This data comes to us from the new York State Department of corrections. Community supervision. And this one by richard matt by far the longest, at the maximum security level now on day seven. Lets look back. According to this report from 2009 and 2013 there were ten escapes. Lets break those down as far as how many were captured here. Take a look as we find this out, within that time 20092013, within just six hours, five were apprehended during that time. And all were taken back into custody within just one day. Lets look even further back. Look at the escapes from 200520 09 and see how that breaks down. Nine inmates broke out of new york state prisons in that time period. How long did it take to catch them . Heres what were looking at when it comes to that breakdown. Two within five hours. Five people are those inmates were apprehended. All of them in custody within just three days here. Those numbers are quite low compared to the data we got from even further back from 20022006. And that is when 18 inmates escaped, almost double the pamt weve seen in years after. And during those years the data shows that those inmates, they were captured within 12 hours as far as bear with me here as we move this right along. Those were captured within 72 as far as the 12 hours later. And then all were taken into custody in less than four days. This is what were looking at here. The reports say that historically most escapes at new york state happen at minimum secure facility when it comes to the outside perimeter fence that medium or maximum security prisons. The last escape from inside a maximum security prison in the state business the elmira escape back in 2003 thomas. Fascinating look. Within the last half hour we have reports from others in an area further away from us of increased activity especially in the air. The ceiling is low but its high enough that theyve been able to get those helicopter assets into the air. If you think of this search area as a triangle the prison in dannemora, were at one corner we are at the southeast corner. The activity seems to be at the Southwest Corner about as far away from us as you can get but what were hearing is that the helicopters seem to be guiding the searchers towards something. Now, the helicopters that were let me start on the ground. The bloodhounds need fresh scent. Sometimes the wet weather can hurt. This cool wet weather can actually help with that thermal radar that the caller was talking about. It the different shl between the area the atmosphere over and the body temperature is increased so it makes it easier to spot people so we know that theres a helicopter up there and thats maybe what theyre using. And so, john do you know when we talk about how hightech this is from especially the air and the images of canines on the ground and other teams of investigative force that is are out drag dasnetting this area have they been able to concentrate on one specific spot . Its not that my sense that im getting, obviously, we are not getting a lot of details but the sense im getting from putting all the pieces of what were hearing together is that its not that concentrated. That it is an area where theyve had some good hits. They have had some good hits on scents and physical clues. There are wrappings from food consistent from what food you would come from inside of a prison. They found bedding. And i think all of those things have led them to this general area and then specific tips from people sort of direct them into various places and i think with that they feel theyre narrowing in. With cctv and other things in place. I dont know that it would or not fly but relationships need to be paid to inmates, contractors and guards. Mitchell admitted that she was going to be the getaway driver and popping up out of that manhole and she wasnt there, they had to go with whatever their plan b was going to be. So if they didnt have her to depend on an theyre only depending on themselves and on foot, they dont really have survivalist training. Its rainy, cold. It would that they must have some backup plan of another person on the outside that could be helping them. Possibly not because if they were depending on her and if that relationship was such that they knew they could count on her, they may not have even developed a plan b. Thats the reason he was reelected into this office three years ago and its what he is going to continue to keep at the top of the agenda for 18 months and if were going to walk the walk coming to those progressive values then its going to be important for democrats and republicans to come together around trade adjustment assistance. This is a program that will lapse on september 30th. Thats a problem because republicans have traditional opposed trade adjustment assistance and republicans enjoy significant majorities in both the house and the senate and if democrats want to make sure that were looking out for the interest of middle class families, we need to make sure that this that trade adjustment assistance doesnt lapse. The good news is we are not just going to extend the program. Well significantly expand it. The proposal before the house right now would nearly double that program in size. And according to an analysis put up by the white house today this is actually a program that will benefit 100,000 American Workers each year for the next six years. That is a substantial benefit to middle class families willing to go and make sure that they can get the training and skills they need to compete for good middle class jobs. Thats always been at the top of the policymaking agenda. It is today. And it continues to make that case in the house to build a bipartisan majority in the house for that legislation. How does appointed is the president that she turned against the legislation after remaining uncommitted for so long and made a personal appeal to her. What happened there . Well the the president has enjoyed a very long warm productive relationship with nancy pelosi. As the speaker of the house, she helped shepherd in one of the substantial progressive legislative agendas in history. That on her watch working closely with president obama we pre prevented a second great depression. We reformed the Health Care System in a way that it has benefits of which are becoming clearer every day and bigger every day. She presided over house of representatives that voted to reform wall street. To make sure that taxpayers would not be on the hook for bailing out big banks that make risky bets. She works legislateively with the administration to end dont ask dont tell and achievements that the president is proud of. Achievements that required the skillful leadership of then speaker nancy pelosi. Since that time there have been other important theres been additional important progress on other priorities the president s identified from the fiscal cliff and making those at the top of the income scale were paying their fair share to protecting the president s ability to prevent iran from obtaining a nuclear weapon. You know i dont know if anybody wants to talk about the iran negotiations today, but if they do one of the points of emphasis to remind you of a letter written and signed by just about every democrat in the house of representatives, the president feels confident that hell be able to use deploem sy to prevent iran from obtaining a nuclear weapon. Theres an active effort by some in congress to try to interfere with that ability but since House Democrats have signaled theyre prepared to stand strong with the president , we think we can accomplish that goal. I dont think anyone that suggested that priority is threatened with a disagreement over this particular issue. Well make an aggressive case to the House Democrats including leader pelosi yitds important to support trade assistance. Whats the president going to do to try to turn that around with the next vote . Well, the president has spent a lot of time talking to members of congress about these issues being a priority. And the fact is as i mentioned at the top, making sure that workers have access to trade adjustment assistance is a top priority of the president s. The truth is its a top priority of every democrat, too. Last time on the floor of the house of representatives it wasnt just a situation Many Democrats voted for it. Every democrat voted for it and 195 members of congress who democrats who were still in office. So, and as i mentioned earlier, were not suggesting to merely renew. Were suggesting or four years ago, were suggesting that they should actually support a legislative package to enhance it. It would almost double the size of the cap. Freeing up additional funds to help workers. It would allow 17,000 workers who over the last 18 months had the eligibility for trade adjustment assistance denied to allow them to have the applications reconsidered again. But for the little that i did see, i have to tell you i was surprised when i heard that this happened. That huge wall that you see in the videos goes up 40 feet. It also goes down 40 feet. Than they told me last summer theyd never had an escape. In the hour and a half i was there interviewing a man for the crime that he was convicted of murder, in that hour and a half there were three alarms went off and prison personnel was running to the area in full almost what i would call s. W. A. T. Gear. Its a very secure maximum security environment there. No sounds like its pretty intense and obviously your assessment of what to physically see by the walls itself it sounds impossible to escape from and here we have two men able to accomplish that. But it seems as if mitchell really is the lynch pin here to being the person who cannot only give the investigators the insight they need about the mindset of these men, but also the proper details about what she was able to assist them in for their own escape. I was surprised to hear that they believe she brought contraband in. I can tell you that when my camera crew and i went through, we were searched all our equipment was searched. It took at least 45 minutes to get in. And leaving, they did the same thing. I was surprised to hear that this happened. I was also there when we were checking in the prison personnel going through the same procedure. They cant just walk in with a backpack or a purse. It has to go through the xray machine. Was there for you guys obviously you were a larger group coming in but a checklist, not just on the way in but out and inspecting to make sure that everything that you were approved to take beyond their walls was also being removed back outside the walls. If youre going to be africanamerican in your mind then why not actually follow it all the way out . But shes caught in a gap here and i think she should have to explain that. But, you know i dont think she should in the cases where she signed, you know participated under the grounds of identifying as africanamerican on the citys committee as an africanamerican thats troubling because, you know now we are seeing there might be opportunities for africanamericans to participate that have been denied that are being redressed by inclusion. So for her to take the slots up seems problematic. Running the naacp, you think she would be aware of that and want to give more opportunities to africanamericans with discrimination.
