Hes vowed to be in New Hampshire every monday until the state votes on february 9th and hes right now talking about the poll numbers that just came out, the nbc news polls that show him very ahead in New Hampshire. Hes not talking necessarily about his poll numbers in iowa right now and thats where hes finding much stiffer competition from ted cruz its the first time that hes attacked cruz in front of cruz in one of his rallies. He was testing the lines to the press katy, stand by. We want to listen to donald trump talking about the rest of the republican field here. Ill come back to you in just a bit. Time magazine did a cover story of me this week. Its one of the best stories ive ever read about myself. But its really not about myself. Its really about you. Its about a movement thats going on. And ill tell you, ive been on the cover now a number of times in the last three months and obviously i should have been picked, right . I think the reason next year would be even better because well prove that we can do things but they didnt and they picked Angela Merkel who is do you see whats going on . And we talk about immigration, we talk about borders. Do you see what shes done to germany, just coming over just before this morning im watching television. The riots, the rapes. What is happening is unbelievable. Its unbelievable. Unthinkable. And theyve been there for two weeks and the place is going to hell and she got person of the year. I didnt. I guess i came in second. So they felt guilty so they gave me another cover. But i have to tell you, you have to go out and get Time Magazine because its a movement of great people and its a Movement Like they have never seen. Many people are saying theres never been anything like this in this country whats taking place with us. Not me. Im a messenger. Its with us. [ applause ] i mean, like an amazing, amazing thing. And im very proud of that story because that was the story usually theres ill get a story, it will be good and theyll always put a shot in. Theyll have three good paragraphs and one total killer. And then theyll have five good paragraphs and its just a total killer. So you tell people, dont read it. You dont want to read it. Because the killers make up for it. They have to do it. They have to do it. And their dishonest but the Time Magazine piece time is known as a pretty liberal magazine. It talks about what weve done and what weve accomplished. So lets talk a little bit about what were doing in terms of the competition and the problems of the country and how to fix the problems. Basically, how to fix the problems, elect trump as president. If you know congressman alan grayson said hes going to bring a suit and its going to say that he wasnt born in this country. So whether you like it or not, they have to figure it out. You cant be having a nominee i think im going to win very solidly, if you want to know the truth. But if you get the nomination, you cant have the person that gets the nomination be sued like hillary might be sued. Shell be sued the emails she should not be running. Oh would i love to run against bernie. I tell you. [ applause ] i mean, can you imagine remember, they took the microphone away. Get off the stage. They told him. This is our president. He goes like this. Oh, excuse me. And everyones out there saying, get off the mike. We wanted to hear him. He walked back like a little puppy. This is going to be our president. I would love, please, go after hillary. I want to run against bernie. Oh, thats a dream come true. This guy, he would make some president. 90 tax, everybody. Does anybody mind paying 90 tax . Go with bernie. Youll have yourself a nice 90 tax. He wants to take it all away from you. You know, hes sort of dampening the he wants to keep it low key. He wants a big, fat, beautiful tax and i dont think the people here are going to go for that very easily. Want to run against bernie. Thats my dream. Thats my dream. Thats the one. Thats the one i really want. But hillary will be fine and the polls show that we beat hillary. Fox poll just came out. Honestly, well take anybody. I think were going to be with the people we have, with the movement we have and we have, by far, the largest audiences and, in all fairness, bernie is second but way down by comparison to the audience, were going to pensacola next week. They dont even know if we can have it the number of people showing up at pensacola, its unbelievable. But we had 20,000 people, 21,000, 30,000 in mobile, alabama, 20,000 in texas. The maverick arena filled up. Its unbelievable the crowds that we get. Its only determined by the size of the space. I want to thank the fire marshal because they allowed a lot of people here. People are standing in doors. Nothing is going to happen but people are standing in doors. But the fire marshals they are the most important people to me because they let us get more people into the rooms. And every one of them, they have been great. So i appreciate that. But ted cruz has a problem because the question is, is he a naturalborn citizen . And the question was asked on meet the press, asked by Chris Wallace this weekend. And i said, i dont know. Nobody knows. And lawrence tribe of harvard, who is a constitutional expert, one of the best in the country, said and i wrote it down, this is not a settled matter. Its wrong to say it is a settled matter because its absolutely not. Its not a settled matter. That means that you know, a lot of people think that you have to be born here. John mccain, he was born outside of the United States but he was born in a military base born to two people in the military. Thats different. I would never question that. But in the case of ted, he has to figure it out. Now, i think he can go in for some kind of a judiciary proceeding. Look, it doesnt matter what he does. You cant have a nominee whos going to be subject to being thrown out as a nominee. You just cant do it. So youre going to make that decision, folks. Its one of those little decisions. Im sure hes thrilled that im helping him out, but i am. I mean, i am. I mean, hes got to go and hes got to fix it. Ted, i have a very strong immigration policy. And all of a sudden, somebody is coming many i way. They are saying, wow, youre right. We could not have and all sorts of discrimination and they are always being looked at. Macys went down and these people that attack me, they go down. And thats a good thing. Because you want to have wins. We dont have wins anymore in this country. We dont win at anything. Weve been listening to donald trump, republican frontrunner, there in windham, New Hampshire, listening to familiar lines of attack. Donald trump saying that they have now asked him to consider buying some ad space there and also talking about a Time Magazine cover, he recently was featured in that magazine. Also spent some time talking about ted cruzs citizenship, questioning whether ted cruz is actually a citizen of the United States of america. Youve been traveling with donald trump. Youve been talking to voters out there on the trail. Is this a line of attack that seems to be resonating with voters . Reporter certainly when youre hearing them cheer for lines of attack like that. I think the campaign was a little bit unsure how his supporters would react if he started hitting ted cruz, especially since there is some crossover between the two candidates. A lot of people who liked ted cruz liked donald trump, especially in a place like iowa but not so much in a place here like New Hampshire where their support teams to be a little different. But i think what he was doing was trying out those lines in the press to see how they play with conservative media, people like rush limb augh. He started bringing it up in reno and in New Hampshire, not going quite as hard on him in iowa where there is more of that crossover. But were hearing him talk about, as you said, the union leader. Hes taking credit for abc bumping the union leader out of their debate coverage. Donald trump is saying, look how powerful i am. I can get people i dont like off the agenda whenever i raise my hand to do so. So hes certainly doing a victory lap at the moment when it comes to that. Whether or not it will work in the case of ted cruz with these birther attacks, that remains to be seen but hes certainly trying to cast doubt, throw some questions out there and see what sticks. They are neckandneck in iowa right now. Katy tur there in the back of the room in windham, New Hampshire, where donald trump continues to speak to the crowd there. I want to bring in steve kornacki, msnbc host. I want to get to these poll numbers but before we do that, can you shed any light on this canadian birther stuff . What do we know about ted cruzs citizenship . Well, what we know is he was born in canada to a mother who is an american constitution. Theres a term in this constitution that to be a president , you need to be a farfar naturalborn citizen and its a term thats never legally been defined. Its a little up in the air what that means. Basically, if you go across the board, just about every legal experts who has been questioned about this says not an issue, ted cruz is fine to be president. There are a few who have expressed a different view. The case that donald trump is trying to make there is to plant the seed of doubt with republicans. Maybe you republicans think hes fine but the democrats are going to put a lawsuit up there. They are going to get him bogged down and do we want to put a candidate up as a nominee who is going to face that kind of a legal challenge. Thats what trump is pointing out. Very interesting to hear him citing congressman alan grayson. Hes running for the senate in florida. Hes talking about bringing a lawsuit against ted cruz. Theres an old saying in politics that is sort of the fringe is the extremes on each side reinforce each other. And maybe youre seeing a bit of that with trump and with grayson. They are touting the same message, each getting political benefit from that. Just in terms of the polling, though, we can give you the latest numbers from the msnbc marist survey. This is in the last 24 hours in iowa. Donald trump is only four points behind ted cruz right now. This is good news for donald trump because the story of the month has been ted cruz surging in iowa. There was talk that cruz may run away and hide with the race, open up a doubledigit lead and trump is only four points behind in iowa. We still have three weeks to go but the idea that cruz was going to really put distance there hasnt happened yet. You can quickly look at why that is. Evangelical voters is a huge part of the equation in iowa. Donald trump is losing with them but still getting about one in five of their votes. Theres also intensity here. How strongly do you support your candidate . The intensity a little higher there for trump. About 70 of his voters say they strongly support him. Less than 60 for cruz and finally we can look at New Hampshire. Weve put those numbers up a minute ago. Again, look at that. Donald trump continues to lead by basically a two to one margin in New Hampshire and the one thing to draw your attention to is this. Marco rubio, you called him an establishment candidate. Bush, kasich, establishment candidates. Four of them bunched between 9 and 14 . If you add you will of those up together, you get 44 . That would be more than enough to beat donald trump but the problem is, no one has emerged from that pack. Until and unless one of them succeeds in doing that, donald trump is going to continue to lead in New Hampshire. Steve kornacki breaking it down for us on a monday morning. Thanks, as always, sir. New video just in to msnbc appears to show that predawn raid on joaquin el chapos safe house last friday where he was captured. This appears to be governmentshot video. It first appeared on televisa. Meanwhile, the process that could bring el chapo to face prosecution is now under way. Mexico formally started the extradition process which could take months. Mexican authorities want to also talk to Actor Sean Penn after this weekends stunning revelation that the oscar winner met secretly with el chapo while he was on the run to write an arlg for Rolling Stone magazine. Jacob rascon is joining me live from the maximum security prison where he escaped from in july. First of all, how are they making sure that he doesnt get out again . Reporter we know they have done construction inside of this prison since he escaped last july. But the question is, can you really protect against bribes . So still the safest has always been the safest and most secure prison in mexico. Hes back for a third time inside this prison. What a lot of people are talking about today is what happened in between his last escape and his recapture and it involves, as you said, Actor Sean Penn. It is proof, according to Actor Sean Penn, of a scoop nobody saw coming. [ speaking in Foreign Language ] reporter drug kingpin El Chapo Guzman, the worlds most famous fugitive, being interviewed for the first time in decades for Rolling Stone. The reaction on social media has been swift. Many finding it impossible that penn would meet el chapo, eat tacos, drink tequila for seven hours and not turn him in. Authorities say his meeting might have helped find el chapos hideout which led to his arrest. That, and the druglords apparent infatuation with star kate del castillo. She played a druglord in a popular soap opera on telemundo. What do you do . I kill people all the time. Dont interrupt me. Reporter she also played a drug trafficker on the showtime special weeds. In 2012 she wrote, mr. Chapo, wouldnt it be cool if you started trafficking with love . You would be the hero. Slough a business, dont you agree . While mexican authorities have said that they are looking at whether sean penn will face exposure here, getting him extradited to the United States as soon as possible called it a sideshow. How was it that this soap opera actress and sean penn were able to do something that the two governments were not . First of all, apparently it was that visit that kate del castillo and sean penn held in october of last year deep in the jungles of the sinaloa area that actually tipped off authorities as to where he was. So all of these efforts that sean penn and kate del castillo said they took to not be followed were moot because they were being followed or at least tracked. So they were not able to do what they thought they were able to do. But apparently, the question is, was the fact that these two actors, one, kate is really well regarded in the latino community. She is very, very accomplished. And then sean penn who apparently was acting like a reporter to try to interview el chapo, whether the fact that they were there actually delayed the capture by a couple of days and thats something the mexican officials want to talk to sean penn and apparently kate del castillo about. So they did it but, look, whats interesting about this is that when you think youve heard it all about El Chapo Guzman, more information comes out that is just jaw dropping. Jaw dropping to say the least. Mexican authorities, as you know, jose, have previously said that they would never extradite el chapo to the United States. Now they are apparently moving to do so. What changed . Well, what changed, craig, is a great question. They built three the equivalent of super max prisons here in mexico from which no one was ever to escape. And el chapo managed to escape from two out of the three prisons. One he did from the first time, he actually got out in apparently a laundry cart. They put him in a laundry cart, put laundry and wheeled him right out of the prison. And then the second one, which is the 11th of july, from the prison hes currently now in again, he tunnelled out. They said, just the construction of the tunnel was a Million Dollars cash. But, you know what, craig, El Chapo Guzman is known as the king of tunnels here. He built tunnels from mexico into the United States to funnel in the drugs that he poisons the United States with. And then he built tunnels on the prison to get out and had tunnels built in this safehouse that he was at in los mochis, a beautiful coastal town here in sinaloa. They had built tunnels underneath the safe house. Televisa is a network friendly to the government, lets say. While this raid was going on, he was already going down one of the tunnels that his engineers apparently two of whom had been sent to germany to study perfection of tunnelling were already going underneath these tunnels, going underneath the citys sewage system to get out. This time, they were not able to do so. So can any prison hold them . Thats a big question. Thus, extradition looks pretty good. Jose, thanks as always. Good to see you, my friend. Thanks. Sean penn facing a whole lot of criticism for interviewing el chapo and not telling authorities about it. Republican president ial candidate marco rubio calling the interview, quote, grotesque but did acknowledge that penn had a constitutional right to meet with guzman. I want to bring in msnbc chief legal correspondent. Lets start with the big simple question, the likelihood that sean penn faces charges . The likelihood is zero. The legal word for this criticism is stupid. Its stupid, craig. Look, there is a whole rich debate about el chapo, about his murderous operation, the drugs that have cause sod much trouble and suffering in mexico and the United States. I dont diminish that. But what reporters do is go to where the problems are, tracking what isis and hezbollah are up to, government leaders of iran who are hostile or sometimes fugitive. We could run through examples out of the heat of this moment, think about other big fugitives who have been interviewed by major news organizations. Julian assange, Osama Bin Laden interviewed by cnn. This idea that sean penn is a journalist. I didnt say he was a journalist. News organizations typically do these kinds of interviews. Rolling stone is a news organization. They have, as their choice, as a magazine, had an actor go on and do this interview. But, no, legally the First Amendment doesnt care that much about whether you are a reporter or not. If an average citizen, craig, happened upon a fugitive, they cannot help them. And if the facts change and there was an allegation here that an actor or journalist was aiding or abetting or hindering apprehension, all different legal questions. What were looking at, what people are currently responding to is the idea that these guys broke bread, had some drinks and had an interview. You could see some of the silliness, sure, but legally, yes, this is what reporters do and i think a lot of this is an overblown reaction that people dont like el chapo, for good reason, so they dont want people interacting with him. Having said that, the extradition process is very important. U. S. Authorities want to act on what the president had already requested in the summer, which was to get him here. We can put the map up on the screen. El chapo faces very serious indictments in several parts of the United States, in arizona, in california, in texas, illinois, new york, florida, in chicago. Theres some of the most devastating evidence here if the u. S. Wants to have a strong case against him, craig, you look at the margarita flores, two twins who have cooperated against el chapo, according to u. S. Authorities. And some of what they say they have is amazing. Cooperation starting secretly in 2008. 70 recorded conversations. Two with el chapo himself, they say. These are extraordinary witnesses provided incredible witness. Thats where the significant and serious case goes, towards extradition proceedings for a federal trial here in the United States. Not against journalists or other citizens who may have had contact with him at one point. Ari, thank you. We got word of more breaking news here, breaking news were now following in baghdad. There are reports of a deadly hostage situation at a mall. According to iraqi officials, gunmen stormed the mall in a shiite neighborhood. So far, ten people at least ten people have been killed, hostages have been taken. Cal perry has been following all of this. Cal, what more do we know about what is happening at this mall . This is about a kilometer from the old border of the green zone in baghdad which im sure our viewers are very familiar with. This was the area in southeastern baghdad where the americans based their operations out of in the capital. An unknown number of gunmen have gone into the mall. Its still unclear if civilians are trapped in that mall. Were reaching out to iraqi officials now to try to confirm the number of people in that mall. We know that the initial attack was some kind of an explosion. Unclear if it was a car bomb or explosive device set off by the gunmen as they entered that mall. At least ten People Killed from that attack. The investigation is ongoing. At least 25 wounded in the attack. But as cal just mentioned, an unknown number of gunmen storming a mall in baghdad. He took on a newspaper, a magazine as well. All of this with three weeks to go before the iowa caucus. The marist poll finding that hes closing in on Hillary Clinton. Bernie sanders, that is. She now holds just a threepoint lead. 4845. That lead with within the margin of error. Same story in New Hampshire where sanders is just four points behind clinton right now. Those polls also reveal that he is performing better than clinton in hypothetical election matchups. Joined now by nbc news senior Political Editor mark murray. You guys note in first read this morning, quote, these poll results show something larger than just tightening races in iowa and New Hampshire. They demonstrate that both democrats and republicans are facing battles over the heart and soul of their parties. Whats happening in iowa and New Hampshire, mark . Well, the biggest takeaway, craig, is we have neckandneck races going on for both sides for both Political Parties and most agree on the majority of the preponderance of the issues and what needs to be done but they are going in Different Directions and on the democratic side, its a great debate. You have Hillary Clinton whose husband was the former democratic president. Hillary clinton worked in the current democratic administration. And then theres Bernie Sanders who wasnt really a democratic up until this president ial bid. Hes an independent socialist. So a fascinating choice for democrats and fascinating on the republican side as well. Did they go donald trump or ted cruz . Outsider or go back to the establishment or marco rubio or someone else . And so we are not only seeing the jockeying among these candidates, but also jockeying to see where voters go and they are on the parties. Heres something folks have paid attention to. If Bernie Sanders wins in New Hampshire, it is a high probability that he will, favorite son, perhaps, border state to vermont, if he wins iowa as well, he starts out 20 before south carolina, before they get to some of these other races, what would that do to the democratic race if you got Bernie Sanders out of the gate with the 20 start . Sean penn actually has a history, he scooped us a few times at newsweek getting interviews with the ayatollah in iran. So it wasnt that shocking that someone like sean penn would get the interview. The timing of the article, it went to press i think the day he was captured. If thats true, thats very interesting. The article itself, its one of these books, for my book i didnt really pursue el chapo. I was more interested in the Law Enforcement side of that world and the people who live under organized crime rather than the big guy himself. But you know, its a tough one trying to interview a subject like that, and you always know that you are really not going to learn that much. But i think one of the things that a lot of folks have issue with, should we have been interviewing him at all . Is this the kind of work that sean penn should have been engaged in sitting down with someone who is accused of killing literally thousands of people . Yes. That is a very tough question. Okay, is sean penn a journalist, no, but Rolling Stone is a media outlet and i have worked in organizations where the top person will swoop in and theyre not necessarily, theyre not a reporter whos on the ground every day risking their life, but theyre the one who the foreign dignitary or bin laden has been interviewed before. Unfortunately, unfortunately, it is a part of our job in many cases, and el chapo is the enemy. The key is not being, you know, to sean penn, his interview was just not tough enough, in my mind. The whole article, i would encourage folks who have been following the story to at least read the article. The whole article is just this sort of bizarre mishmash at times of craziness.
