Were going to begin this morning with more evidence that we may be reaching a Tipping Point in the debate over guns. Govern govern governors, corporations and schools now adding their voices and doing it loudly to call for change. I have a Wonderful Team to break all of it down. Beginning with nbcs Tammy Leitner in parkland. You have been there for the last two weeks. Lets start with the latest investigation and whats happening specifically at the school. Todays the First Official day back. What can you tell us . Good morning, stephanie. Its been a long couple of days for these students and their parents returning to this school for the first time. And keep in mind, this school has essentially been frozen in time since valentines day when the shooting happened almost two weeks ago. The kids have been coming back to the school really reliving the shooting for the first time. All of this going on as the Broward County Sheriffs Department is coming under fire. An internal investigation going on. While as many as three Sheriff Deputies are being looked at for possibly staying outside the school while the shooter was inside the school shooting. Our own Kerry Sanders sat down with the sheriff, sheriff scott israel, and asked him about this investigation. Lets go ahead and listen to what he had to say. Right now, im not going to tell you that other broward sheriffs deputies didnt go in when they should have, but im not going to say the opposite either. We are going to investigate. Were going to do it more thoro. At a time where i see, if i see, anybody, a deputy, a sergeant, a lieutenant, did anything else wrong, i will bring that out and have a press conference on that. Thats what leaders do. Leaders hold their people accountable. Governor rick scott has asked the state to conduct a second investigation which is being done. Also at the same time, 74 members of the Florida House of representatives have written a letter to the governor asking him to suspend sheriff israel for incompetence and neglect of duty. The sheriff has said he is not going to resign and he welcomes any kind of separate investigation. Now to the white house where guns will be one of the main topics. Nbcs Kristen Welker joins me now. We know this white house loves their listening tours. President trump listened. He heard the students and families from parkland a week ago and then not 24 hours later, hes at cpac and basically reciting talking points from the nra, so what do we expect today . Its a great point, and i think you can expect some discord here. One of the proposals that President Trump has put forward is highly controversial, arming some students he says those who have been trained firearms im sorry, teachers, yes, an important correction, some highly trained teachers to carry conceal weapons. Thats an opinion some of the governors disagree with. Including floridas governor rick scott who has been very clear, he wants to see other changes, but not that one. He doesnt think thats the way to solve this crisis. Another notable divide, stef, is between the president and the nra. Thats on the issue of how old someone should be to buy a weapon like an ar15. President trump has been advocating to increase the age from 15 to 21. The nra says they dont back that type of proposal. Take a listen to what President Trump had to say over the weekend. Doesnt seem to make sense you have to wait until youre 21 years old to get a pistol but to get a gun like this maniac used in the school, you get that at 18, i mean that doesnt make sense. Frankly, i explain that to the nra to great people. What we learned is a number of companies, major corporations, including delta and united, are essentially splitting with the nar. Pulling out all of their advertisements or support. The nra saying the loss of a discount will neither scare nor distract one single nra member from our mission. Some 5 Million People who are a part of the nra say they support the groups defense of the second amendment. President trump is pushing for some type of a vote on guns, gun control. This week, he wants to see expanded back ground checks, in addition, stef, to everything weve been talking about. It is highly unlikely well see a vote this week. The house is back but really only a day or so. If the president decides to make a move here, he has a moment an extraordinary moment, to do something on gun control. And win support from people he never thought he could. I want to bring my panel in. Phil rutger is White House Bureau chief for the washington post. Ron insana is a cnbc contributor. And the reverend, who hosts a program at sirius xm progressive talk radio. He must have had roller skates on to get here this quickly so i thank you for that. Phil, i want to talk about the president s meeting today with the governors. Walk us through the politics. Are they as decided down party lines as we see members of congress are . We know a lot of members of congress spent a lot of time in washington so they dont have to face the music back at home. The governors are in a different situation. Back at home, students, teachers, corporations, parents, theyre pushing here and its not politics, its safety. Yes, thats exactly right, stef. The gun issue is not a cleancut partisan issue in the states. There have actually been a number of states that have been far ahead of washington on enacting tougher background checks and other restrictions. So i think the president s going to hear an earful from these governors about whats working in their states. And just look at governor scott. Hes taking a pretty interesting approach on guns just in the last week or so in reaction to the last parkland shooting. But hes not alone. A lot of state executives are trying to create some reforms. Remember, its only a few states. All people need to do is walk across state lines and get those guns. Thats right. 155 heads of schools penned an open letter. It was printed in the New York Times. To the president and lawmakers. Urging them to do something to help keep school safe. The letter was printed yesterday, as i said, 155 heads of school. Already, its up to 235 school heads. They were originally from the new york area. Now its pushed to new jersey, florida. I want to show a quote from it. Where they write, we implore you, mr. President , and our National Legislative leaders to do everything necessary to stem this tide of senseless gun violence. We stand ready to help in this effort and encourage our colleagues leading schools across the country to join us. Above all, we demand that reason and compassion prevailed. This, as i said, was in yesterdays New York Times. The man who penned it, dr. David ohalarian. But theres nothing political. They are saying were educators, we want to educate students. A true spike since even we saw even after sandy hook. Is there change here . I believe so. What were seeing in the reaction to parkland is the reaction i think a lot of us felt we should have seen after sandy hook. Unfortunately, it didnt happen. But this momentum led by these Young Students in florida has been tremendous and overwhelming. If someone whos been involved in the black lives matter movement, have been very critical of police, but let me say this, i have empathy for those Police Officers in Broward County. We need to hear their side of the story. Because im not certain that they knew how to handle that situation. Do you run into a burning building in that way . Its interesting, normally the nra and i are on the opposite sides. They would defend police in all matters. But in this situation, theyre attacking police, because it hurts their argument of teachers having guns, which, by the way, is absurd. This is not something im not certain this is something you can absolutely train for. More guns increases gun violence. So more guns, teachers having guns, not the solution at all. I think we need to look at this. I think people are finally saying we need some sensible solutions and the solution is not bringing more guns into the equation. Ron what do you make of corporations cutting ties . The nra saying no big deal. The nra might have a point. Because nra has single issue voters behind them that all show up to vote. We can applaud them, First National bank, metlife, stepping back and saying we will no longer be tied to the nra. Will that impact any votes . Because thats what actually matters here. Not to dismiss the importance and the beauty of this movement. If the movement ends up simply being talk, then well, of course. I think its an important symbolic first step insofar as these companies do not want to lose a generation of customers who are becoming increasingly vocal and who will vote. But its not enough. From the corporate perspective, there needs to be more social responsibility in this regard. We never banned cigarettes, but you can ban assault weapons. You can ban semiautomatic weapons. They had the law on their side we kind of know that with guns. States attorney generals led the charge against the Tobacco Industry if youll recall. They could launch suits against these companies to make them liable for the deaths of those who are fallen because of gun violence and you can also see class action civil suits by individuals. I think that would really change the tide. I think that conversation needs to be had. Thats interesting. Phil rutger, the nra has now come out against age limits for gun purchases. The president has said he supports it. How much of this argument do you buy here . Is the president going to defy the nra . Are they going to have a side winkwink, nodnod deal here . What do we know . We hear rhetoric and the president wants to raise the age limit. White house Officials Say hes willing to ruffle some feathers with the nra on this point. But i also know this is a really important point for the nra and particular for the leaders of the nra, chris cox and wayne la pierre and others who are speaking personally with the oth president about it. They want that age to stay at 18. It matters to them. Theyre going to put the full muscle of the nra behind it. If hes willing to defy the nra or just willing to say a few things publicly but behind the scenes cut a deal with the nra and keep that age at 18. So well have to see. Well, youve got to wonder what motivates President Trump. And while all of this is going on, youve got the muller investigation going on. If there is one group that will not believe Robert Muellers findings, if they come out and hurt the president , it is that far right nra trump supporting group. And President Trump cares a lot about that support. Because while he may bring some people over from the left, if he takes action on gun control that same group of people, theres a good chance theyre going to believe what Robert Mueller has to say if he does have negative findings. I think that having a teacher who is armed, who cares deeply about students, and who is capable and qualified to bear arms, is not a bad idea. But its an idea that needs to be discussed. My team and i have reached out exhaustively to find teachers, school heads, who support this idea of teachers carrying guns in school. I cant find any. No. What is your thought on this . I mean, to ivanka trump, this list of 155 school heads are new York City School heads. Im pretty sure wherever your children do or will plan to go back to school in new york dont support this. So where is this coming from . Stephanie, my mom was a teacher for 25 years. My mother was hell with a wooden spoon. But there is no way on gods green earth she could have operated a firearm in a classroom where she had 35 students. If somebody walked in with an assault weapon and she had to unlock a pistol, in addition to the panic attack that would have ensued, there would have been no way. At any age that these teachers should be responsible for holding firearms. One of the ladies who was shot and killed was hit nine times as this gunman went on his shooting spree. Also mass shooters, theyre wearing helmets and kevlar vests. If School Budgets dont include an aide in class, you have teachers who cant handle that amount of students, from a risk perspective, how do you look at this . I was a teacher. I come from three or four generations of teachers in my family. Its absurd. And, you know, some teachers dont have resources in the classroom that they need. They have to come out of pocket to even have some of those resources. Nobodys focused on having a gun. And i would imagine that many teachers are interested in teaching. And not learning how to use a weapon and being trained to use a weapon. Not to mention, this is the same argument that is used in the aurora theater shooting. Thats why we need to talk to those cops in broward. If you show up and everybodys got a gun and you dont know who has a gun, how do you know who the assailant is and who the good guys are . According to the trace, so far this year, there have been 8,256 incidents of gun violence in the United States. Including 34 nas shootings. Yesterday alone, there were 16 shootings in the United States of america. As devastating as parkland was, it didnt happen in a vacuum. Gun violence is an issue in this country every single day. The democrats rebuke said the Justice Department did disclose that it is funded by political researchers. And only a small part of the Justice Departments surveillance application. The gops memo alleged that surveillance of page, a former adviser, was politically motivated. My panel, ned price, a former special assistant to president obama and former spokesman for the National Security council under obama. Ron insana, Mark Thompson back with me. Congressman schiff, you know who he is, spoke about the importance of their memo. Whats important for the public to see, the facts, that the fbi acted appropriately next seeing a warrant on karcarter p. Do you think the memo clears the fbi of wrongdoing or does this memo speak into an echo chamber of already existing believers . The same thing that the nunes memo did . Well, stephanie, what i think the release of the schiff memo does is put to rest the idea that this was a case of he said she said. In fact what we can see is this a case of nunes baselessly claimed and schiff came back with a tenpage body blow that debunked the entire press of the nunes memo. The premise being, as youve mentioned, a u. S. Citizen, a campaign associate of the Trump Campaign, was wrongly surveilled. The schiff memo goes into great detail about how that is not the case. How the steele dossier was only narrowly used in justifying that surveillance. The nunes memo was not about fisa abuse. Nunes has always been one of the biggest cheerleaders of fisa and surveillance. It was about discrediting the mueller investigation. It was about tarring the good men and women of the fbi and the department of justice. And with the release of schiffs memo, what he has done is he has explained how they were in the right, how they acted within the proper parameters and how what they were doing was consistent with the rule of law in this country and thats why we owe adam schiff a big debt of gre gratitude here. Ron, while we could owe adam schiff a debt of gratitude, while it could be a body blow, does it change anyones pinup of the investigation . I certainly doubt it. I dont mean to pour cold water but lets get real. I dont think these change anyones opinion of the investigation itself. Youre on one side or the other. This is a fairly binary set of discussions. This all just basically is going to come down to bob mueller. What he comes up with will be the final word in this. Well have these discussions as both sides fight it out. In political terms, the reality is how far does it go and does it go farther than anyone imagines. Is that definitely the case because mark, to you, mueller has obtained five guilty pleas at this point into the investigation, into russia meddling. Three of them are former Campaign Associates of President Trump. And President Trump continues to brush this thing off to the outside world. Now, i spoke to people inside the white house who say the president is sort of more unhinged than ever. They cant even get close to him. They cant say for sure why that is, they certainly think it has to do with russia. Well, first of all, you cant overshadow a dud. So the schiff memo, while it is helpful and i believe truthful, i believe what it says, it doesnt have an enormous impact. Because the nunes memo was so insignificant. The schiff memo would oppose what many of us thought and establishes the credibility of those warrants and the credibility of the surveillance from carter page. Youre right, the real big fish are those who have pled guilty. Former white House Counsel john dean has said that the flipping of gates could spell the end of the trump presidency. Thats a very strong statement coming from someone like john dean. What hes really saying there is if gates can tie manaforts actions directly to trump, with trumps full knowledge and instruction, donald trump is finished. And the other thing, just to draw together, this whole thing with the nra. The nra and trump are attacking local law enforcement. The white house is attacking the fbi. Weve never seen anything like this coming from republicans. From republicans, thats whats key. To me, thats a high cream and misdemeanor. If i were mueller, i would pick him up today. A very big if. It seems mueller is well, while obviously investigating collusion. Mueller, while hes investigating collusion, hes also focusing on Money Laundering. Hes focusing on other aspects that may bring this to a different end than we may think. I think if john dean described is very wide still. Mr. Mueller knows more than any of us do. To rons point, you could put collusion aside and you can talk to Business People who have known President Trump in business for decades and theyve said uhoh, follow the money. You could have a Money Laundering issue. Ned, to you quickly, maureen dowd of the New York Times says papadopoulos, flynn and gates have flipped. How long can manafort keep his lips sealed . Those russian indictments show muler is digging like crazy. So walk us through this. Do you think were getting anywhere closer to Paul Manafort flipping . Well, its really hard to say. I think with gates flipping, the question is what we will know is he was a means to an end. Gates was there longer than manafort was. Maybe he is a bigger fish in terms of flipping. The interesting thing about gates is he was both part of the campaign and transition. Like the hotel meeting, the trump tower meeting. Also the transition that featured very prominently in the defense of Michael Flynn that the mueller team filed. Is the mueller team using gates just to go after manafort who, yes, is a big fish, or using them because they have the goods on people like kushner, don jr. , possibly the president himself . I think thats what well find out in the coming days and weeks. 13 russians indicted. Paul manafort who had worked with russian oligarchs for decades. The president s sons who had said in the past years on record they get outside investments from russia. And the president did not up sanctions against russia and has yet to say anything except Vladimir Putin is a strong, strong leader. Its a head scratcher. I want to take you live to nbc news justice correspondent my dear friend pete williams. Pete, give us the details. This say sis a setback for t Trump Administrations efforts to try to put a stop to the daca program, the children that were brought to the United States illegally by their parents before they were 16. The lower courts had blocked the administration from stopping the program. You may recall it was put in place by the obama administration, the Trump Administration wanted to shut it down by march 5th. But a judge in San Francisco last month said no, you cant do that, because you illegally tried to shut it down. The Trump Administration asked the Supreme Court to take the case immediately, bypassing the court of appeals. A rare move if it had been granted. And today it was not. The Supreme Court said its not going to hear this case in a very brief order. It simply says this, it is assumed that the court will decide this case. Number one, the march 5th date is meaningless, the date on which the administration wanted to shut this down. The date often referred to as the daca deadline for congress to act. Number two it means were not going to get a Supreme Court decision on this case until next year at the earliest. Because the calendar is already full for this year. Courts not going to hear the case this term. So it has to go through the Appeals Court and then be appealed to the Supreme Court, probably in the summer or the fall, so the Supreme Court might hear it as early as this fall or early next year. Would mean the decision next year. So the daca program as a practical manner lives on for at least another year. Its a legal setback for the Trump Administration. Who had hoped the Supreme Court would get to this case and decide it this year. But now thats not going to happen. Stephanie. Okay, so lets just make sure i understand. That march 5th deadline that was this do or die headline thats a deadline that mattered to Daca Recipients is now null and void. Theyll keep on proceeding with their lives and this will now be heard six months or a year from now . Well, i would say two things. Number one, that daca deadline became a dead letter last month when the judge in San Francisco said you cant shut this program down. Now, the Trump Administration had a decision to make here. They could have asked the Supreme Court to take this case and block that lower court order while it was deciding what to do. But they didnt ask for that. They said they thought that would be too disruntive, turning the thing on, turning it off. Too much of an on off switch. So they didnt do that. March 5th i think has been a dead letter for over a month now. Number two, this now stays where it is, in the federal court of appeal in San Francisco. They have yet to schedule a i dont think theyve scheduled a day yet for oral argument. I dont think all the papers are in yet. So this case is not going to be decided by the Appeals Courts for months. And then maybe the summer or this fall it will issue its decision. The Trump Administration will come back to the Supreme Court. Which probably then will take the case. Now, one other thing to note here, stephanie, in the lower court ruling, in San Francisco, the judge said that current daca people are allowed to stay in the program, but that the government doesnt need to take new applications from people who have never been in the daca program before. So thats one difference between where we were before the Trump Administration tried to shut it down. But in the main, the daca program that covers hundreds of young people which remain in effect for at least another year. Ron insanta, weigh in. Whats your take . Shortterm victory fors who who support the dreamers and daca. This will be a retracted legal battle clearly. I think theres still the possibility that we can get some sort of bipartisan agreement out of congress. Whether or not the president approves of it remains to be seen. Senators have been working very hard at trying to deliver something that satisfies both parties. Whether or not that happens in the short run is an open question. At least theres a oneyear reprieve and this can maybe be discussed with a little less intensity, maybe a little less vitriol, if theres a longer time frame with which to work. And the Midterm Elections. Your colleague, john harwood of cnbc. John, whats your take on this announcement . I think that means were not going to get daca legislation this year. Congress works on deadlines. If theres no deadline, i think it is likely to be kicked into the campaign. And its probably in the long run a good sign for the Daca Recipients not only to get the reprieve for the next year or so but also given the likelihood of democratic gains in the fall elections, the chances that daca protections will be removed in the long run i think have diminished. While neither of you have a trump crystal ball, how will the president take this . Because we know that he often says you play games, you go to easy courts like in San Francisco, but the Supreme Court, kneel goresuch, the president thinks these are my boys, these are my judges. By boys, i dont mean men alone, i mean in a un aeiversal sense. My team. My crew, my posse. Except there are no women on that team. There you go. I would be unusually constrained in tweeting about this. I dont think you want to necessarily take on the Supreme Court while this may still come up as an argument before that court a year or so from now. Well see whether he responds to it or whether he just says something negative about the Appeals Court process and leaves the Supreme Court alone in the interim. John. Well, first of all, i dont think the president has the same leave of discretion that my friend ron insana has. So i dont know if he will think similarly about tweeting. I do think lately the president has been taking the stance on twitter that democrats have forgotten about this issue. They dont care. And i suspect now that there is no impending deadline, he can continue that line of argument.
